Minutes:  There was a motion to approve the minutes of the November 21st meeting.  The motion was seconded and accepted with a vote of 6-0-0.

Mr. George Russell’s Agent’s Report has been appended to the minutes.


Public Hearing - Notice of Intent – Lincoln Street Culverts – Town of Franklin - CE159-1056
Mr. Michael Maglio, Town Engineer, and Mr. Jay Melo, Assistant Town Engineer, both appeared before the Commission for the culvert replacement and stormwater improvements on Lincoln Street.

Mr. Maglio stated that the DPW is looking to replace 2 culverts along with the creation of a small bioretention area on Lincoln Street.  Mr. Maglio gave the Commission some background information as well as an overview of the proposed work for the project.

The bioretention area will be placed just past Meetinghouse Lane to treat stormwater runoff from the project and there will a small sediment forebay.  There will be no new impervious areas for the roadway project.

The work will be performed during the next construction season.  There will be erosion control  used; i.e., compost filter socks.

George Russell, Conservation Agent, stated that he would request a stipulation that the final planting plan in the bio-retention area be approved by the Agent.

There was no one in the audience present for this public hearing.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 6-0-0.

There was a motion to approve with the additional stipulation that the final planting plan is to be approved by the Agent.  The motion was seconded and accepted with a vote of 6-0-0.

The Orders of Conditions for this project was signed by the Commission members.


Continued - Public Hearing - Notice of Intent – 7 Shawkemo Path – LaCroix - CE159-1054
Mr. Paul LaCroix, the homeowner, and Mr. Dennis Anderson, the contractor for the proposed project, both appeared before the Commission for the construction of a 12’x24’ addition with attached deck.

Mr. LaCroix submitted a revised plan and gave the Commission members an overview of what has transpired regarding the project to date.  

George Russell, Conservation Agent, stated that there should be riprap placed at the end of the pipe to dissipate the velocity of any water coming out and prevent further erosion.  Mr. Russell also stated that he has met on the site with the Building Commissioner and Mr. LaCroix at the request of the Commission.  

Mr. Russell also stated that the issues that were raised by the Commission were discussed.  

  • The addition of the pipe from the roof recharge area to the plan,
  • There have been no final quantities of excavation or fill material submitted.  
Mr. Russell recommended that the final details on the daylighting of the roof recharge pipe be submitted for approval to the Conservation Agent.  Also, there shall be riprap placed at the end of the discharge pipe and the final quantities of the deposition and excavation be submitted to the Conservation Agent for approval prior to the start of any construction.

The Commission raised the question as to where will the excavated materials be disposed of?
Mr. LaCroix stated that they will be taken off the site  

The 3 special conditions stated for the project were:  there shall be rip rap placed at the end of the roof recharge area discharge pipe where it daylights, the quantity of excavated material brought in and out shall be approved by the Conservation Agent and must be within a window of 1-3 cu. yds. of material in and out, the number and the placement of the sono tubes must be submitted to the Conservation Agent for approval.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 6-0-0.

There was a motion to approve the Notice of Intent with the 3 special conditions.  The motion was seconded and accepted with a vote of 6-0-0.


Continued - Public Hearing – Notice of Intent – Camp Haiastan- 722 Summer Street – CE159-1053
The Commission Chairman opened the hearing and stated that a letter has been received from the applicant’s representative dated December 3rd requesting a continuance of the public hearing until December 19th.   .

There was a motion to continue the public hearing for Camp Haitian until December 19th.  The   
motion was seconded and accepted with a vote of 6-0-0.

There was a motion to adjourn the meeting.  The motion was seconded and accepted with a vote of 6-0-0.  

The meeting adjourned at 8:00 p.m.
