Minutes:  There was a motion to approve the minutes of the October 17th meeting.  The motion was seconded and accepted with a vote of 5-0-2; 5 Yes, 0 No, 2 Abstentions.

There was a motion to approve the minutes of the November 7th meeting with 1 correction.  The motion was seconded and accepted with a vote of 5-0-2; 5 Yes, 0 No, 2 Abstentions.

Certificate of Compliance:  Lot 2A Silver Fox Road – SE159-907
George Russell, Conservation Agent, informed the Commission members that there are significant deviations from the originally approved plan than from what was constructed.

The changes are enumerated in his Agent’s Report and Mr. Russell reviewed these changes with the Commission members.  The issue of greatest concern is the change of grades from the additional construction that took place without the Commission’s approval.

Mr. Russell stated that his recommendation would be that the release from the Orders of Conditions not be granted and the applicant be required to appear before the Commission with a modification to the Notice of Intent.  

Mr. Russell also informed the Commission that he emailed all of his comments to the engineering firm that made the request for the release and they never responded.

There was a motion to deny the release for Lot 2A Silver Fox Road and request that the applicant submit a modification to the existing Notice of Intent.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing - Notice of Intent – 77 Jefferson Road – Woodcock – CE159-1055
Mr. Paul DeSimone, representing Colonial Engineering, appeared before the Commission for the construction of an in-ground swimming pool.

Mr. DeSimone submitted a revised plan for the proposed project and provided the Commission with a detailed overview of these plans and also some of the observations brought up at the site walk.  There is a construction sequence added to the plan as well as 12” mulch tubes.  There is a small 1 ft. tree planted in the garden and it will be removed and replanted on the site.  

Some additional special conditions discussed to be added to the Orders of Conditions were no phosphorous fertilizers shall be used in the 25 ft. buffer zone and the pool shall have a closed cartridge filtering system with no backwash.  

There was a motion to issue an Order of Conditions for 77 Jefferson Road with 7 special conditions.  The motion was seconded and accepted with a vote of 5-0-2; 5 Yes, 0 No, 2 Abstentions.  

Continued - Public Hearing - Notice of Intent – 7 Shawkemo Path – LaCroix - CE159-1054
Mr. Paul LaCroix, the homeowner, and Mr. Dennis Anderson, the contractor for the proposed project, both appeared before the Commission for the construction of a 12’x24’ addition with attached deck.  

Mr.  LaCroix presented a revised plan for the project and gave the Commission members an overview of the details of the project.  The Commission members had some questions regarding the slab and the walkway details on the plan.

George Russell, Conservation Agent, raised the question if there was going to be any fill brought in to the site.  There will be no fill brought in to the site; the excavated fill will be taken off the site.  There were also some questions raised regarding the level of the basement door and the location of the slab in relation to it.  The plan does not depict the above mentioned details.  The grade will not be changed.

Mr. LaCroix informed the Commission members that he will contact his engineer and request that he depict the changes to the plan that the Commission members have requested. He was advised to seek the approval of the Building Commissioner, Gus Brown, to determine if he has any issues with the new plan.  This will avoid conflict in the future between the requirements of the building department and the Conservation Commission.

There was a motion to continue the public hearing until December 5th.  The motion was seconded and accepted with a vote of 7-0-0.  

Continued - Public Hearing – Notice of Intent – Camp Haiastan- 722 Summer Street – CE159-1053
The Commission Chairman opened the hearing and stated that a letter has been received from the applicant’s representative requesting a continuance of the public hearing until December 5th.  .

There was a motion to continue the public hearing for Camp Haiastan until December 5th.  The
motion was seconded and accepted with a vote of 7-0-0.

There was a motion to adjourn the meeting.  The motion was seconded and accepted with a vote of 7-0-0.
