There was a motion to accept the minutes of the June 13th, 2013 meeting. The motion was withdrawn.
Ms. Michele Grenier’s Agent’s Report has been appended to the minutes.
GENERAL BUSINESS
Certificate of Compliance: 53 Dover Circle – CE159-982
Ms. Grenier stated that she has visited the site and it is in compliance with the approved plan.
The house was built in 1996 and then sold in 2009. The Orders of Conditions have recently been recorded at the Registry of Deeds.
There was a motion to issue a Certificate of Compliance for 53 Dover Circle. The motion was seconded and accepted with a vote of 5-0-0.
Enforcement: 58 Populatic Street
Ms. Grenier informed the Commission members that the homeowners have planted all of the plantings that were ordered under the Enforcement Order.
There was a motion to rescind the Enforcement Order for 58 Populatic Street. The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.
Continued - Public Hearing - Notice of Intent – 5 Alexandria Drive – Tanner - CE159-1046
Mr. & Mrs. Jack Tanner, the applicants, both appeared before the Commission for the construction of an addition to existing single-family house. Two of the Commission members have recently visited the site and determined where the sono tubes will be placed and that erosion control was not needed for this work. A designated area for yard waste was determined behind the pool cabana.
At the last meeting, the functions and characteristics statement, project narrative, construction sequence report and DEP field delineation sheets were requested and were submitted at this meeting.
At the closest point, the addition will be located 51 ft. from the edge of the wetlands and there will be no disturbance inside the 50 ft. buffer zone.
There will be no erosion control required for this project provided that the entire stockpile area is located outside of the 100 ft. buffer zone.
There were 3 additional special conditions discussed with the applicant.
There was a motion to close the public hearing for 5 Alexandria Drive. The motion was seconded and accepted with a vote of 5-0-0.
There was a motion that the applicant has satisfied their burden of proof and issue State and Local permits with 21 special conditions; the 18 State standard conditions and 3 special conditions; all work must be performed according to the plans, the DEP sign with the number must be placed on the site visible from the street and the Orders of Conditions referenced in construction contracts. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing - Notice of Intent – 19 Colt Road – Maliff - CE159-1048
The public hearing was opened by the Conservation Chair and a letter was read from the applicant’s representative requesting a continuance of the public hearing until the July 18th meeting. There was a motion to continue the public hearing until July 18th. The motion was seconded and accepted with a vote of 5-0-0.
