Enforcement:  15 Mount Street
There was a motion to close out the Enforcement Order for 15 Mount Street.  The motion was seconded and accepted with a vote of 3-1-0; 3 Yes, 1 No, 0 Abstentions.

Minor Buffer Zone Activity:  122 Pine Street
Mr. & Mrs. Michael Maslauskas, the applicants, both appeared before the Commission to request the construction of a 12’x24’ shed in their rear yard on a crushed stone pad.  There is a small isolated wetland to the rear of their property.

There was a motion to issue a Negative Determination subject to 4 special conditions; notify the Conservation Agent when the work starts, notify the Conservation Agent when the work has been completed, limit the storage of hazardous chemicals to less than or equal to 5 gallons of gasoline, less than or equal to 10 lbs. of fertilizer and no hazmat.  The motion was seconded and accepted with a vote of 4-0-0.




Public Meeting – Request for Determination – NSTAR – Access Road Maintenance    
Mr. Eric Las, representative of NSTAR, appeared before the Commission for access road maintenance work.  Mr. Las gave the Commission an overview of the project plans and the proposed work to be conducted within Conservation jurisdiction.

Mr. Las stated that there is a section of Right-of-Way #4 between Pond & Elm Streets where they would like to improve the access road and maintain these roads.  The work will be conducted entirely on existing access roads.

Mr. Las informed the Commission that this work is exempt under the State Act and this filing is being done only under the Local Bylaw.

Swamp mats will be used in some locations where the existing access roads go through wetland areas.  They will only be in place for a few days.  Straw wattles will be used for erosion control purposes.

The Chairman questioned what is the exterior material of the wattles composed of?  It was also questioned if there are any brook or stream crossings with swamp mats proposed?

Mr. Alfieri informed the applicant of 3 items to be addressed in this RDA filing and these are enumerated in the Agent’s Report.

There was a motion to issue a Negative Determination subject to 6 Special Conditions; notify the Conservation Agent when the work starts, notify the Agent when the work has been completed, conduct the work according to the plan, no stream crossing, seeding shall be done with wetland mix, and the haybales shall be removed at the end of the project.  The motion was seconded and accepted with a vote of 4-0-0.
GENERAL BUSINESS

        Certificate of Compliance:  74 Oxford Drive
        Mr. Alfieri informed the Commission members that he has inspected the site and  determined that the swimming pool was installed according to the plan and is in         compliance with the Orders of Conditions.
                
        There was a motion to issue a Certificate of Compliance for 74 Oxford Drive.  The       motion was seconded and accepted with a vote of 4-0-0.

        Minor Buffer Zone Activity:  13 Haverstock Road
        Mr. Tim Connolly, the applicant, was present at tonight’s meeting to request the        construction of 16’x20’ family room addition with foundation wall.  The corner of the   foundation will be located 75 ft. from the wetlands and will be located within the inner        riparian zone to the river; i.e., Mine Brook.

        A question arose from the Commission if it satisfies the requirements of a Minor Buffer         Zone Activity.  Mr. Alfieri stated that the riverfront is not addressed in the MBZ      regulations.

        A Commission member questioned as to why the construction of an addition with a         foundation in a riparian zone has been filed under a Minor Buffer Zone filing.  There are       some issues that will not be addressed in this filing which could be done with special  conditions attached to an Orders of Conditions under a Notice of Intent filing.

The Commission Chairman opened the 7:30 p.m. Public Meeting for NSTAR Access Road Maintenance.  There was a motion to continue the public meeting until the termination of the discussion on the Minor Buffer Zone.  The motion was seconded and accepted with a vote of 4-0-0.

        The Commission informed Mr. Connolly that they need to have more details as to how      this project will be conducted added to the plan and requested that he bring this required      information back at a future meeting.

        Mr. Connolly stated to the Commission that he would like to withdraw this application   without prejudice.

        Permit Decision:  87 Grove Street – Nu-Style Building – CE159-1022
        Mr. Nick Alfieri, Conservation Agent, recused himself from this discussion.

        There was a discussion among the Commission members regarding the issuance of   Orders of Conditions for this project.

        There was a motion to issue State and Local Orders of Conditions with 56 Special        Conditions in the Chairman’s corrected list of conditions.  The motion was seconded and         accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.
