There was a motion to accept the minutes of the June 2nd meeting with a few corrections.  The   motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

        Minor Buffer Zone Activity:  17 Evergreen Drive
        Mr. Neal Fitzgerald, the applicant, has requested the construction of a 16’x12’ deck on         3 footings at the rear of his house.  The proposed deck would be located 51 ft. from the        wetland at the closest point.

        The Commission requested crushed stone be placed underneath the deck.  The soil from    the footings will be used to replant some grass on the site.

        There was a motion to issue a Negative Determination for 17 Evergreen Drive with the 3  standard conditions; to notify the Agent before work starts, do the work according to the       plan with the crushed stone underneath the deck, notify the Conservation Agent when the         work has been completed.  The motion was seconded and accepted with a vote of 5-0-0.

        
        Permit Decision:  Lot 32 Garnet Drive – CE159-1014
        There was a discussion among the Commission members regarding the issuance of   Orders  of Conditions for this project.  Mr. Alfieri has included some special conditions to    the Agent’s Report for Commission review.    
        
        There was a motion to issue State and Local Orders of Conditions for Lot 32 Garnet      Drive subject to the 35 special conditions including the amended special condition      enumerated 34 which would indicate that the post and beam fence will be constructed of  metal or plastic and that it shall delineate the limit of disturbance in perpetuity.  The       motion was seconded and accepted with a vote of 5-0-0.

        Permit Decision:  16 Evergreen Drive - CE159-1016
        There was a discussion among the Commission members regarding the issuance of   Orders  of Conditions for this project.  Mr. Alfieri has included some special conditions to    the Agent’s Report for Commission review; 33 proposed conditions and 1 perpetual        condition to limit the storage of gas or poisons in the shed to no more than 5 gallons of       gasoline and no toxic materials.  
        
        There was a motion to issue State and Local Orders of Conditions for 16 Evergreen Drive         with the 34 special conditions.  The motion was seconded and accepted with a vote
        of 4-0-1; 4 Yes, 0 No, 1 Abstention.

        Permit Decision:  Lockewood Drive Detention Pond - CE159-1011
        There was a discussion among the Commission members regarding the issuance of   Orders  of Conditions for this project.  Mr. Alfieri has included some special conditions to    the Agent’s Report for Commission review.

        There was a motion to issue Local Orders of Conditions for Lockewood Drive Detention    Pond subject to 53 conditions.  The motion was seconded and accepted with a vote of
        4-0-1; 4 Yes, 0 No, 1 Abstention.

        
Public Hearing – Notice of Intent – 3 Forge Parkway – Stantec - CE159-
Mr. Steve Senna, representative of National Development, and Mr. Frank Holmes, representative of Stantec, both appeared before the Commission for the construction of 37,600 sq. ft. building with parking area in Forge Park.

Mr. Senna gave the Commission members an overview of the history of the site and stated that it will be purchased and occupied by Hamilton Storage Company, which will be a light manufacturing facility.

Mr. Senna provided the Commission with an overview of the site plans for the project.  

Mr. Holmes described the buffer zone impacts in proximity to the wetlands to the Commission as well as the stormwater design and how stormwater management standards will be utilized for the site.  Most of the impact from the site will be located in the 50-100 ft. buffer zone.

The Commission Chairman opened the public hearing for Amendment Request for Orders of Conditions for Lot 24 Spring Street.  There was a motion to continue the public hearing until the completion of this discussion.  The motion was seconded and accepted with a vote
of 5-0-0.

Mr. Alfieri stated that he has previously met with the applicants and have discussed stormwater design and the impervious road for fire protection issues.  

Mr. Alfieri also informed the applicant of 9 items to be addressed in this Notice of Intent filing.

The Commission Chairman questioned the applicant as to the location of the isolated land subject to flooding on the plan.  The Chairman also requested that the Tree-of-Heaven invasive plantings located in close proximity to the site be eradicated.

The Commission will conduct a site walk of the property on Monday, June 27th at 6:30 p.m.  

A Commission member questioned the snow storage area and where will the snow be going and will it be removed from the site.  Also questioned how many rain gardens will be on the site?  There will 1 rain garden constructed on the site.  Also questioned was the watering plan for the site.

The Chairman informed the applicant that a perpetual condition is anticipated to be imposed in the Orders of Conditions prohibiting the use of phosphorous as a fertilizer on the site.

There was a motion to continue the public hearing for 3 Forge Parkway until June 30th.  The motion was seconded and accepted with a vote of 5-0-0.


Public Hearing – Amendment Request to Orders of Conditions – Lot 24 Spring Street – Trahan – CE159-1013
Mr. Stephen Trahan, the applicant, and Mr. Patrick Doherty, Engineer of Midpoint Engineering & Consulting, both appeared before the Commission for an Amended Order of Conditions to change the footprint of house to 36’x30’ foundation with attached 24’x24’ garage.

Mr. Doherty presented plans for the Commission’s review and stated that they have rotated the the house and gave the Commission an overview of these plans.  Mr. Doherty stated that the applicant is requesting to construct a 32’x37’ house with attached garage.  The new footprint of the house would remain inside the disturbed area that was previously outlined.  

Mr. Doherty explained the differences between the previous plan and the plan being presented at tonight’s hearing.

Mr. Alfieri informed the applicant of 6 items to be addressed in this Amendment Request application.

Mr. Doherty stated that the impact to the buffer zone is the imperious coverage and is approximately 1,000 sq. ft. in total.

Mr. Alfieri recommended that the erosion control line be extended to the south by the drive and to relocate the stockpile next to the driveway.

A Commission member stated that she would like to see some mitigation in the expanded site with the remaining trees being left for habitat purposes around foundation of deck and porch.

A gravel surface will be put in underneath the deck.  The walk should have permeable pavers and possibly more trees along the edge toward the street.  

A special condition that 2 street trees be planted along the frontage of the property and some foundation plantings on the west and south sides of the house were discussed with the applicant.

Mr. Doherty stated that LP gas would be used for the house for heating and the equipment would be placed underground and put in during construction.

Special conditions discussed with the applicant were:

  • 2 street trees; one ornamental in the front
  • foundation plantings front and back of the house
  • move the stockpile to the south of the proposed driveway
  • stone under the deck and porch
  • no pressure-treated decking
  • change the drawing of the compost socks; put stakes outside of them
  • option for LP gas if the applicant chooses to use it
        o       if a shed or swingset is installed, it must be inside the bounds

There was a motion to close the public hearing for Lot 24 Spring Street.  The motion was seconded and accepted with a vote of 5-0-0.

GENERAL BUSINESS
        
        Discussion:  Chestnut Senior Village
        Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. Donald Ranieri, Jr., the    applicant, both appeared before the Commission to discuss a minor correction to the site        plans for Chestnut Senior Village.

        Mr. Nielsen informed the Commission that there has been an appeal to the Planning       Board’s decision permit for this site.  It has been remanded back to the Planning Board         with 2 conditions requested by an abutter to the site.  The changes made were the rotation      of the parking lot at the westerly side of the site.  There are 6-8 screening shrubs    requested by the abutter as well.  There will be less impervious pavement and more      plantings proposed for the site.  To the north of the parking lot, there will be a lighting     fixture moved.  The dumpster area is in the same location; there is an alternative location    on the west side of the building.      

        Mr. Nielsen requested that the Commission approve these changes as a minor      modification to the original plans.  He would also like a recommendation to the Planning        Board.
                                                                                                                                                                                                                                   
        The consensus of the Commission members was that these changes to the plan would be     an improvement for the site and deemed as a minor modification.

        Mr. Nielsen requested a document from the Commission that can be recorded at the        Registry of Deeds.

        There was a motion to accept the changes to the plan of the Chestnut Senior Village as  a minor modification plan revision dated June 15, 2011.  The motion was seconded and    accepted with a vote of 5-0-0.  

        Mr. Alfieri will send the applicant a signed document noting that the plan was approved         as a minor correction and the Conservation Commission deems this an improvement over    the previous plan.  The letter will be for forwarding to the Registry of Deeds and also for     the Planning Board.
