There was a motion to accept the minutes of the January 13th, 2011 meeting.  The motion  
was seconded and accepted with a vote of 6-0-1; 6 Yes, 0 No, 1 Abstention.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

Mr. Alfieri informed the Commission that Certificate of Compliance inspections are not possible until the ground is no longer covered in snow.

There was a motion to suspend Certificate of Compliance inspections until such time as conditions enable reasonable visual inspection.  The motion was seconded and accepted with a vote of 6-0-1; 6 Yes, 0 No, 1 Abstention.


Continued - Public Hearing – Revision of Conservation Commission Rules & Regulations
Mr. Alfieri informed the Commission members that he has made all of the corrections to the Rules & Regulations requested by the Commission members at the last meeting.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 7-0-0.

There was a motion to approve the changes to the Rules & Regulations with the 3 additional changes that were discussed at tonight’s meeting.  The motion was seconded and accepted with a vote of 7-0-0.


Public Hearing – Notice of Intent – Lockewood Drive – Town of Franklin DPW – CE159-1011
Mr. Ray Willis, Commission member, recused himself from this public hearing.

Mr. William Yadisernia, Town Engineer, appeared before the Commission for improvements to an existing stormwater detention pond.  Mr. Yadisernia presented the plans for this project and informed the Commission that this is the second of three stormwater improvements obtained under DEP and EPA grants.

Mr. Yadisernia gave the Commission an overview of the plans for this proposed work on the detention pond.

Mr. Alfieri informed Mr. Yadisernia of 5 items to be addressed in this Notice of Intent filing.  He also recommended continuing the public hearing for two months when the snow has melted and a site walk can be conducted.

There was a motion to waive the State and Local fees.  The motion was seconded and accepted with a vote of 6-0-0.

Mr. Yadisernia requested that the Commission continue the public hearing until the March 10th meeting.

There was a motion to continue the hearing until the March 10th meeting.  The motion was seconded and accepted with a vote of 6-0-0.


Continued - Public Hearing - Abbreviated Notice of Resource Area Delineation – 3 Forge Parkway – National Development – CE159-1010
Mr. John Nenart, Engineer of Guerriere & Halnon, and Ms. Sherry Clancy, a representative of National Development of New England, both appeared before the Commission for a resource area delineation at 3 Forge Parkway, located in Forge Park.

Mr. Alfieri informed the Commission that a consultant has performed a peer review and visited the site.  The conditions were reviewed and two areas of concern were identified.  Mr. Alfieri informed the Commission that one area is insignificant and the other area would cause a change in the buffer zone.  He recommends the Commission either accept the consultant’s delineation or the Commission can review it themselves.  The consultant has provided a letter regarding these issues on the site and this is attached to the Agent’s Report.

Mr. Nenart informed the Commission that he has reviewed the consultant’s report and provided the Commission with his comments.  Mr. Nenart stated that he has accepted the fact from the consultant’s report that there is an isolated wetland located on this site.

Mr. Alfieri stated that there would be a 100 ft. buffer around it; that would confirm the wetland line.  The Chairman informed Mr. Nenart that an updated plan with this buffer would be required by the Commission.  Mr. Alfieri informed the Commission that a buffer zone is a resource area under the Local Bylaw.

Mr. Nenart will submit revised plans with the isolated wetland with the adjusted 100 ft. buffer zone around it.

Ms. Clancy informed the Commission that the client who will be occupying this site would like to have some passive recreational use; i.e., walking trails outside the 25 ft. no disturb zone but inside the 100 ft. buffer zone.  The Commission Chairman informed Ms. Clancy that any future work to be performed on the site within Conservation jurisdiction must have a new filing and advised her to work with Mr. Alfieri during this process.

There was a motion to close the public hearing.  The motion was seconded and accepted with a vote of 7-0-0.

There was a motion to issue the ORAD with the approved plan dated January 27th plus the resource area with the noted isolated wetland and its associated 100 ft. buffer zone.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing - Notice of Intent – 23 Beech Street – Needham Land Properties – CE159-1008
Mr. Paul DeSimone, Engineer of Colonial Engineering, appeared before the Commission for the construction of an infiltration basin and drainage piping for Mine Brook Place.  

Mr. DeSimone provided the Commission with an progress report of the project along with a project narrative.  The letter from Mr. & Mrs. O’Connor, abutters to the site, has been addressed in a letter provided by Merrikin Engineering.  Mr. Alfieri stated that Mr. Peter Williams, Engineer of Vine Associates and consultant to the Planning Board, had no concerns regarding water from the detention basin affecting the O’Connor’s property.  

Mr. Alfieri had no comments regarding these revised plans and stated that all of his issues have been addressed by the applicant’s representatives.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 7-0-0.

There was a motion to issue State and Local Orders of Conditions for 23 Beech Street.  The motion was seconded and accepted with a vote of 7-0-0.


Continued - Public Hearing – Notice of Intent – 505 West Central St. – James Daddario – CE159-1009
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, Mr. James Daddario & Mr. Jack Daddario, the applicants, all appeared before the Commission for the construction of a building for Taco Bell & Wendy’s with an unknown medical or retail use.

Mr. Nielsen gave the Commission a brief update of the progress made on the site since the last meeting.  He has been working with the Town Engineer on some details regarding drainage.

Mr. Alfieri stated that he is waiting for submittal of the revised plans.

Mr. Nielsen requested that the hearing be continued until the February 24th meeting.  

There was a motion to continue the public hearing until the February 24th meeting.  The motion was seconded and accepted with a vote of 7-0-0.
