There was a motion to accept the minutes of the May 7th meeting with one correction.  The motion was seconded and it was requested that the Conservation Secretary check the tape on a matter of whether a vote had taken place.

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.


Public Hearing - Notice of Intent – 27 Forge Parkway - CE159-983
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for the construction of additional parking spaces and drainage.

Mr. Nielsen informed the Commission members that he did not notify the abutters and requested that the Commission continue the public hearing without any further discussion.

The Commission members made note that this hearing would not be continued as it is not opened.  It would be rescheduled until June 18th.  Mr. Nielsen stated that he is in agreement with

this date for the hearing to be opened and he will have the green abutter notification cards at that time.  Mr. Nielsen subsequently requested to have a discussion with the Commission regarding this site.

Discussion – 27 Forge Parkway – Guerriere & Halnon
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for a discussion regarding this site.  Mr. Nielsen informed the Commission members that the Planning Board requested that the plans be revised in Phase II to bury a detention basin in the parking lot.  This change would result in creating more vegetated area on the site.  There have been some revisions made to the Phase I plan to create 80 parking spaces to be constructed.  There is a major detention pond in this area.

Mr. Nielsen stated that pretreatment will be provided for the existing pavement.  This will be done with a bioretention cell in that location in order to have the water pond before it runs into the retention basin.  Some other improvements will be made to the stormwater management on the site by means of a storm septer.

The pavement within the 25 ft. no disturb is proposed to be moved back and create a new parking lot line moved further back from the wetland line.

Mr. Nielsen stated that there is a previous ANRAD for this site in which the Commission has approved the location of the wetland line.  Mr. Nielsen also informed the Commission that there are 480 proposed parking spaces for the site.

Mr. Nielsen stated that the Town Engineer requested that a bioretention cell be located in the parking lot.

The Commission Chairman suggested that Mr. Nielsen prepare an alternatives analysis for the proposed work in the 25 ft. area.

Another Commission member stated that between flags C50 and C51, all the snow was plowed into the wetland and suggested a solution as to where the snow could be dumped other than directly into the wetlands.

The Commission will walk the site on Tuesday, June 16th at 7 p.m.


Continued - Public Hearing – Notice of Intent – 53 Dover Circle – Patel - CE159-982
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, appeared before the Commission for the grading of a low point at the rear of the house.  Mr. Nielsen stated that he has added some plantings to the plan at the southeast portion of the grading on the site to provide some additional habitat.  There will be approximately 15 yds. of earth removal with loam and seed in the proposed  play area.

A Commission member informed Mr. Nielsen he will have to wait until late in the season to plant grass seed due to the water conservation measures being undertaken by the Town of Franklin.  It was suggested by the Commission to add this as a special condition to the Orders of Conditions.    

Another Commission member stated that while on the site, he observed that there is a lot of poison ivy along the top of the detention basin to act as a natural barrier and if this will be a play area, there should be no herbicides applied to this area.  This Commission member stated that the plantings on the plan for this area were not a good choice for this particular area.  

Another Commission member gave some suggestions to Mr. Nielsen for plantings in this area that would have good survival rates and enhance this sensitive area.

Special conditions discussed were the application of sod during the water conservation season prior to Labor Day and to seed after Labor Day.  The plant species included shall be fragrant sumac and eastern red cedar.  A perpetual condition that no herbicides shall be used in any uncultivated area, including areas with poison ivy.  There shall be two growing seasons for the planted species.  The plantings shall be moved to the top of the retention basins.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 4-0-1; 4 Yes, 0 No, 1 Abstention.


Continued – Public Hearing - Notice of Intent – Lot 1, 1084 Pond Street – Schultz – CE159-976
The Commission Chairman opened the public hearing and stated that a letter dated June 4th has been received from the applicant’s representative requesting the public hearing be continued until the next Conservation meeting on June 18th, 2009.  

There was a motion to continue the hearing until June 18th, 2009.  The motion was seconded and accepted with a vote of 5-0-0.


Continued - Public Hearing – Notice of Intent – Lot 2, 1086 Pond Street – Schultz – CE159-977
The Commission Chairman opened the public hearing and stated that a letter dated June 4th has been received from the applicant’s representative requesting the public hearing be continued until the next Conservation meeting on June 18th, 2009.  

There was a motion to continue the hearing until June 18th, 2009.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.


GENERAL BUSINESS

Minor Buffer Zone Activity:  21 Echo Bridge Road
The applicant has requested to trim some branches on trees on his property.  The trees are not all on Conservation jurisdiction.  The trees within jurisdiction are all outside of the 25 ft. no disturb area.

There was a motion to issue a Negative Determination with 3 Special Conditions.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.


Minor Buffer Zone Activity:  136 Conlyn Avenue
The applicant has requested to replace the deck with a smaller deck with 3 new sono tubes.  The distance is approximately 75 ft. from the wetlands to the edge of the deck.

There was a motion to issue a Negative Determination with 3 Special Conditions.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.

Minor Buffer Zone Activity:  17 Echo Bridge Road
        The applicant has requested an after-the-fact permit to cut down a tree.  Also, the     homeowner has requested permission to move some dirt on his property.

        There was a motion to issue a Negative Determination.  The motion was seconded and      accepted with a vote of 5-0-0.

Minor Buffer Zone Activity:  51 Charles River Drive
The applicant has requested the construction of a 14’x5’ deck on the second floor of his residence.  The proposed deck will be located approximately 30 ft. from the wetlands.  This deck will be constructed on 8 sono tubes.  The proposed work will take place approximately 30 ft. from the edge of the wetlands.

There was a motion to issue a Negative Determination with 6 Special Conditions.  The motion was seconded and accepted with a vote of 4-1-0; 4 Yes, 1 No, 0 Abstentions.  

Certificate of Compliance:  13 Bubbling Brook Drive – CE159-960
Mr. Alfieri informed the Commission that at the last meeting, the Commission signed this Certificate of Compliance and an error was subsequently found.  The applicant filled out the Request for Certificate of Compliance form inaccurately and put the incorrect Registry of Deeds Book & Page number.  The applicant’s attorney called the Conservation Office and requested a corrected copy.  

The Commission members signed the corrected Certificate of Compliance for this property.
