There was a motion to accept the minutes of the May 8th meeting.  The motion was seconded.      A Commission member stated that the minutes note that Mr. Alfieri’s Agent’s Report has been appended to the minutes and the Commission members never received the full report and he did not deem it appropriate to accept the minutes at this time.  The motion was seconded and failed with a vote of 1-5-0; 1 Yes, 5 No, 0 Abstention.  

Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.

There was a motion to fund the money to subsidize the wood for the construction of the bridge for the Eagle Scout project in the Town Forest up to $500.  The motion was seconded and accepted with a vote of 6-0-0.

Discussion:  Daniels Street Water Line – Town of Franklin - CE159-954  
Mr. Bill Yadisernia, Town Engineer, appeared before the Commission to request a minor modification to the Daniels Street Water Line project, DEP File CE159-954.  The modification that Mr. Yadisernia is requesting is for a change to the outfall.  This was done under redevelopment projects and met 50% tss removal.

Mr. Yadisernia is requesting to relocate the swale and plunge pool as he has been experiencing difficulties obtaining easements at the current locations.  Mr. Yadisernia hopes to get a better tss removal from this change.  He stated that they are not changing the discharge point only relocating it and making it larger than it was previously.

A Commission member inquired as to digging up the driveway of the abutter to the site.  Mr. Yadisernia stated that this has been done under the previous Orders of Conditions and the wetlands on the site have been flagged by DPW personnel.

There was a motion to amend the Orders of Conditions to accept the plan dated May 12, 2008.  The motion was seconded and accepted with a vote of 6-0-0.


Continued - Public Hearing - Notice of Intent – Map 245, Lot 16  Pleasant Street – Thornhill - CE159-966
Mr. James Thornhill, the applicant, and Mr. Brian Gillis, Engineer of Dunn McKenzie, both appeared before the Commission for construction of single-family house, pool, deck and detached barn.  Mr. Gillis submitted revised plans to reflect the changes requested by the Commission at the recent site walk.  Mr. Alfieri’s comments have been addressed also.

Mr. Gillis informed the Commission that the erosion control detail has been revised.  The roof runoff will be recharged from both the barn and the house.  A steel storage container located in the inner riparian zone at the rear of the site and the construction materials will be removed from this area as well.   The construction sequence has been added to the plan.  A Commission member requested one change to the erosion control detail depicted on the plan.

There are 8 arborvitaes being proposed as mitigation plantings for the site along the existing woodline.  The applicant proposed that no bounds will be put in place but the plantings will be used as a boundary to depict that there will be no mowing beyond that location in the future.

The Commission Chairman informed the applicant that no refueling is allowed in the resource area.

A Commission member suggested to the applicant that he refer to the Best Management Practices Handbook for suggested plantings for the site.  Mr. Thornhill suggested replanting some of the trees on the site to be used as bounds rather than putting in concrete bounds.

Mr. Alfieri offered the applicant some suggestions as to the plantings for the site.

Another Commission member stated that no stockpiling of construction materials be made a Perpetual Condition in the Orders of Conditions.  He would like concrete bounds be put up every 100 ft. along the field side of the tree line.  He also requested that dogwire mesh be put up around a tree at the edge of the site.  Mr. Thornhill stated that this tree is not on his property.

There was a motion to close the hearing.  The motion was seconded and accepted with a vote of 5-0-1; 5 Yes, 0 No, 1 Abstention.


Continued - Public Hearing - Notice of Intent – Franklin Sports Mall – Washington Street – SE159-923
The Commission Chairman stated that a letter has been received from the applicant’s engineer requesting a continuance of the public hearing until June 12th.  

There was a motion to continue the hearing until June 12th.  The motion was seconded and accepted with a vote of 4-0-2; 4 Yes, 0 No, 2 Abstentions.

                                                                                                   
GENERAL BUSINESS
        
        Minor Buffer Zone Activity:  14 Harborwood Drive
The applicant has requested the installation of a 24 ft. round above-ground swimming pool.  The pool will be located between the inner and outer riparian zones approximately 80 ft. from the wetlands.

There was a motion to issue a Negative Determination with 4 Special Conditions.  The motion was seconded and accepted with a vote of 6-0-0.

        Minor Buffer Zone Activity:  322 Chestnut Street
The applicant has requested the installation of a reserve area of a septic system.  The current system has failed.  The work will be located just inside the buffer zone.  The work will take place on previously disturbed area.  

There was a motion to issue a Negative Determination with 5 Special Conditions.  The motion was seconded and accepted with a vote of 5-0-1; 5 Yes, 0 No, 1 Abstention.

        Certificate of Compliance:  470 Maple Street – Grillo - CE159-926
        There was a discussion among the Commission members regarding the issuance of a Certificate of Compliance for this project.  Mr. Alfieri informed Commission members that the site is in substantial compliance and recommends the issuance of a Certificate of Compliance.

There was a motion to issue a Certificate of Compliance for 470 Maple Street.  The motion was seconded and accepted with a vote of 6-0-0.
        
        Certificate of Compliance:  10 Dawn Marie Circle – Garilli - CE159-920
There was a discussion among the Commission members regarding the issuance of a Certificate of Compliance for this project.  Mr. Alfieri informed Commission members that the site is in substantial compliance and recommends the issuance of a Certificate of Compliance.

There was a motion to issue a Certificate of Compliance for 10 Dawn Marie Circle.  
The motion was seconded and accepted with a vote of 6-0-0.



        Discussion:  Planet Jeep – 505 West Central Street  
Mr. Donald Nielsen, Engineer of Guerriere & Halnon, and Mr. John Morrill, the principal of Planet Jeep, both appeared before the Commission for a discussion on the Knights of Columbus site at 505 West Central Street.

Mr. Nielsen stated that he has spoken to the Fire Chief regarding the accessibility to the rear of the building and he was satisfied with the concept of not crossing the wetlands to gain access to the building.  This would result in a reduction of replication and alteration for the site.

Mr. Nielsen also informed the Commission that Ms. Judy Schmitz, Wetlands Scientist, has visited the site and prepared a brief report regarding the wetlands and intermittent stream on the site.  There will be some mitigation proposed for some of the invasive species directly adjacent to the stream and in the buffer zone as well to provide an enhanced habitat for these species.  The invasive species would be removed from the buffer zone by hand and some herbicides would be used with the approval of the Commission.

Mr. Nielsen requested a consensus of the Commission with regard to this proposal for the site.

A Commission member inquired as to what would be done with the pipe on the site.  Mr. Nielsen stated that this pipe will be removed.

Another Commission member inquired as to what would be done with the replication area.  Mr. Nielsen stated that a test pit will be performed in that area.

Another member inquired as to the nature of the plantings on the site.  The headwall was also discussed and it will be replaced.   

A small bond was suggested by Commission members.  The recharge of stormwater on the site was also discussed and the various types that would be proposed for the site.

The filling of wetlands on the site was not looked on favorably by Commission members.
        Mr. Alfieri stated that he would recommend to the Commission that an independent consultant be hired to evaluate the wetlands and to ensure that the wetlands are functionally properly 5-10 years into the future.  Mr. Alfieri also stated that he would recommend bonding for the site.

The Commission Chairman stated that any upgrade to the stormwater management system would be looked upon as a net benefit to the site as well as an improvement to the surrounding areas.  

The Commission Chairman stated that the applicant will be required to file a variance with an alternatives analysis for this project.


Another Commission member inquired of Mr. Nielsen where the snow removed from the site will be deposited.

The applicant stated that he will make every attempt to place the snow as far as possible from the wetlands.

        Permit Decision:  Honey Dew Donuts – 365 West Central Street – CE159-965  
        There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.

There was a motion to issue State and Local Orders of Conditions with 1 Special Condition to substitute Hay Scented Fern in place of New York Fern and the other conditions that routinely apply to a commercial project of this scale.  The motion was seconded and accepted with a vote of 5-0-1; 5 Yes, 0 No, 1 Abstention.
