There was a motion to accept the minutes of the November 15th meeting. The motion was seconded and accepted with a vote of 5-0-2; 5 Yes, 0 No, 2 Abstentions.
Mr. Nick Alfieri’s Agent’s Report has been appended to the minutes.
Enforcement – 3 Mount Street
Mr. Alfieri stated that the Commission had previously requested that the Court date be continued until April 17, 2008 to give the applicant an opportunity to complete the work which was required in the Orders of Conditions.
Mr. Alfieri also informed the Commission that Attorney Neil Roche, attorney for the applicant, Mr. Stanley Adelstein, visited the Conservation Department and requested that the Commission close out the Enforcement Order with Wrentham District Court so that he would be able to close the file on this matter. Mr. Alfieri requested of the Commission how they wished to proceed on this case. He also informed the Commission that no restoration work has yet begun on the site within the buffer zone.
There was a motion to continue the Enforcement for 3 Mount Street and comply with the Enforcement matter and appear in Court to compel compliance with this Enforcement Order matter. The motion was seconded and accepted with a vote of 7-0-0.
Public Hearing – Notice of Intent – Lot 1 Marine Way – Boudreau – CE159-956
Mr. Stephen Poole of Inland Survey, and Mr. Scott Morrison of Ecotec, the botanist for the project, both appeared before the Commission for the construction of a single-family house.
Mr. Poole informed the Commission that an ORAD was issued for this site in October 2003.
Mr. Poole stated that on Lot 1, the wetlands are depicted on the plan. Erosion and silt fence are also depicted on the plan. Mr. Poole also stated that the grading and work will be kept outside of the 25 ft. buffer zone per the Town of Franklin regulations. There is a small amount of grading around the house within the 50 ft. buffer zone but no structures. There is a graveled common driveway which would service all three houses, which will be called Marine Way.
Mr. Alfieri informed the applicant that he has 12 items to be addressed in this Notice of Intent filing and submitted a copy his Agent’s Report, which has these items enumerated, to Mr. Poole.
Mr. Morrison stated that these 3 houses will be served by Town water. He also stated that he has reviewed the wetland flags in the summer of 2007 and they have not changed in the past three years since the ORAD was issued. A Commission member asked when the site was last flagged. The response was August 16th, 2007. There is no roof recharge proposed for this house.
The Commission Chairman noted that there was no one present in the audience who had any issues regarding this project.
There was a motion to continue the hearing until December 20th so that the Commission may conduct a site walk. The motion was seconded and accepted with a vote of 7-0-0. The Commission will walk the site on Sunday, December 9th at 10 a.m.
Public Hearing – Notice of Intent – Lot 2 Marine Way – Boudreau – CE159-957
Mr. Stephen Poole of Inland Survey, and Mr. Scott Morrison of Ecotec, the botanist for the project, both appeared before the Commission for the construction of a single-family house.
Mr. Poole stated that this house has a common driveway and also a septic system. The 25 ft.
and 50 ft. buffer zones are depicted on the plan. Erosion control and silt fence are depicted on the plan as well.
There will be no work conducted in the 25 ft. no disturb zone. There will be minimal grading in the 25-50 ft. buffer zone. The grading will be minimized in the 50 ft. buffer zone.
The Commission Chairman requested that some roof recharge be provided.
Mr. Alfieri informed the applicant that he has 14 items to be addressed in this Notice of Intent filing and submitted a copy his Agent’s Report, which has these items enumerated, to Mr. Poole.
Mr. Michael Wedge, an abutter of 862 Washington Street, expressed concerns about the access road for the project and the possible impacts to his property line. The Chairman informed Mr. Wedge that this is an issue for the Planning Board rather than Conservation.
A Commission member asked if there was a stockpile area depicted on the plan. The response was that the material will be brought off site. This Commission member also asked if there was a planting schedule depicted on the plan. The response from Mr. Poole was that there was not but that he would add it to the plan before the next meeting.
The Commission Chairman requested that 6” bounds be added to plan depicting where the edge of the clearing would be so there would be no future encroachment into the wetlands.
There was a motion to continue the hearing until December 20th so that the Commission may conduct a site walk. The motion was seconded and accepted with a vote of 7-0-0. The Commission will walk the site on Sunday, December 9th at 10 a.m.
Public Hearing – Notice of Intent – Lot 3 Marine Way – Boudreau – CE159-958
Mr. Stephen Poole of Inland Survey, and Mr. Scott Morrison of Ecotec, the botanist for the project, both appeared before the Commission for the construction of a single-family house.
Mr. Poole stated that on Lot 3, the area will be regraded with the new house, septic system and Town water.
The area inside the 25 ft. buffer will be undisturbed. There will be grading in the 50 ft. buffer only. There will also be a retaining wall in the 50 ft. buffer zone. A Commission member questioned as to the nature of the stream on the site. Mr. Poole stated that the stream is classified as perennial on the USGS map. There is a large riverfront area which flows along the rear of the site. Mr. Poole also informed the Commission that there is 137,000 sq. ft. of riverfront area which flows through this site. There is approximately 6,600 sq. ft. of area within the riverfront, a portion on which is existing lawn.
Mr. Alfieri informed the applicant that he has 16 items to be addressed in this Notice of Intent filing and submitted a copy of his Agent’s Report, which has these items enumerated, to Mr. Poole.
A Commission member questioned as to the location of the 100 ft. buffer zone. This Commission member also requested that the location of the stockpiled material, the planting schedule and the placement of the bounds all be depicted on the plans.
There was a motion to continue the hearing until December 20th so that the Commission may conduct a site walk. The motion was seconded and accepted with a vote of 7-0-0. The Commission will walk the site on Sunday, December 9th at 10 a.m.
Continued - Public Hearing – Notice of Intent – 104 Populatic Street – LeBlanc –
CE159-953
Mr. William Halsing, Engineer of Land Planning, appeared before the Commission for the construction of addition to existing single-family house. Mr. Halsing presented the Commission with revised plans addressing the requests made by the Commission at the recent site walk. The field data sheets were submitted adding plantings to the plan, the species of which were requested by the Commission.
Mr. Halsing also stated that an item regarding the siltation barrier has been added to the construction sequence. A stone entrance area has also been added to the plan to control runoff from the site.
Mr. Alfieri stated that he has no additional comments regarding this Notice of Intent filing and is satisfied with the revised plan.
The Commission Chairman noted that there was no one present in the audience who had any issues regarding this project.
There was a motion to close the hearing. The motion was seconded and accepted with a vote of 7-0-0.
Continued - Public Hearing – Notice of Intent – Daniels Street Water Line/Storm Drain – Town of Franklin - CE159-954
Mr. William Yadisernia, Town Engineer, representing the DPW, appeared before the Commission for the installation of 3,800 linear feet of water main, house services and storm drain improvements on Daniels Street. Mr. Yadisernia informed the Commission that the work takes place from the intersection of Brook Street to just past Addison Avenue. There are two sections which lie within the buffer zone; one near Longwalk Road and one near Addison Avenue.
The street will not be widened as part of the work and it will be repaved after completion of the work. Some stormwater improvements will be added for drainage purposes.
Mr. Yadisernia also informed the Commission that he recently conducted a site walk of the site with Mr. Alfieri. The total TSS removal will be 50%. There is a section of wetlands along an area of Longwalk Road which is 200-300 ft. in length with a natural berm. There are no haybales proposed in this area as there is no practical location to install them.
Mr. Yadisernia stated that he has addressed the comments from the Agent as well as the Commission. Mr. Yadisernia requested that he be given an opportunity to review the proposed Special Conditions to the Orders of Conditions before it is issued to address any concerns or comments. The Commission requested that Mr. Yadisernia meet with Mr. Alfieri and Mark
Cerel, Town Attorney, to review the standard Orders of Conditions to agree upon the proposed special conditions and bring them back to the next Conservation Commission meeting. These
special conditions could be used as model standard conditions for this project and for future Town projects of the same type.
There was a motion to continue the hearing until December 20th. The motion was seconded and accepted with a vote of 7-0-0.
Continued - Public Hearing – Notice of Intent – 22 Riverside Drive – O’Brien – CE159-955
The Commission Chairman opened the hearing for the construction of an in-ground swimming pool and shed. The Commission Chairman stated that the revised plans dated November 16, 2007 were recently submitted to the Conservation Department by Carlson Survey for Mr. Alfieri’s review.
Mr. Alfieri informed the Commission that he has reviewed the plans that were submitted and found them to be adequate and recommended closing the hearing and the issuance of a Standard Orders of Conditions with standard pool conditions.
The Commission Chairman noted that there was no one present in the audience who had any issues regarding this project.
There was a motion to close the hearing. The motion was seconded and accepted with a vote
of 7-0-0.
There was a motion to issue Standard Orders of Conditions for an in-ground swimming pool. The motion was seconded and accepted with a vote of 7-0-0.
Continued - Public Hearing – Notice of Intent – Franklin Sports Mall – Washington Street – SE159-923
Mr. Jim Susi, a representative of United Consultants, appeared before the Commission for the construction of a 61,200 sq. ft. sports facility. Mr. Susi submitted a handout of a previous Agent’s Report and stated that he is here to discuss Item #3 with the Commission.
Mr. Susi stated that Mr. Richard Goodreau, Engineer of United Consultants and also the engineer for the project, is requesting to conduct a site walk of the site with Mr. Alfieri to identify the trees mentioned in Item 3 and draw up a plan to remediate any trees that have to be taken down. He is suggesting for every tree that needs to come down, a new 2” caliber tree be replanted.
Mr. Susi requested a continuance of the hearing until January 17th, 2008. The Commission Chairman asked what type of tree would be proposed to be taken down. Mr. Alfieri informed the Commission that some of the trees are within the buffer zone and the other trees elsewhere on the lot outside of the buffer zone would be under the jurisdiction of the Planning Board. Mr. Alfieri suggested that the Town Planner also visit the site to inspect the trees. A Commission member questioned as to the type of the trees in question.
The Commission members requested that Mr. Alfieri accompany Mr. Goodreau to the site to inspect the trees in question.
There was a motion to continue the hearing until January 17th, 2008. The motion was seconded and accepted with a vote of 7-0-0.
Continued - Public Hearing – Notice of Intent – Map 292, Parcel 2 Spring Street – Maggiore - CE159-951
Mr. Alfieri informed the Commission members that a site walk conducted by LEC and the applicant’s team has been scheduled for December 11th, 2007 at 10 a.m. at the east entrance to Spring Street. The kickoff meeting is scheduled with LEC and the applicant’s team on the same day at 2 p.m. at the Municipal Building. Mr. Alfieri invited any interested Commission members to attend either or both of these meetings.
The Commission Chairman stated that a letter dated December 3rd has been received from the applicant’s engineer requesting a continuance of the hearing until December 20th.
There was a motion to continue the hearing until December 20th. The motion was seconded and accepted with a vote of 7-0-0.
Continued - Public Hearing – Amendment Request – 438 West Central Street – Ayoub Engineering - SE159-862
The Commission Chairman stated that a letter from the applicant’s engineer dated December 3rd has been received from the applicant’s engineer requesting a continuance of the hearing until February 21st, 2008.
There was a motion to continue the hearing until February 21st, 2008. The motion was seconded and accepted with a vote of 7-0-0.
GENERAL BUSINESS
Certificate of Compliance: 5&7 Forge Parkway - SE159-915
Mr. Alfieri informed the Commission that the site is in substantial compliance.
There was a motion to issue a Certificate of Compliance for 5&7 Forge Parkway.
The motion was seconded and accepted with a vote of 7-0-0.
Certificate of Compliance: 18 Woodhaven Drive - SE159-916
Mr. Alfieri informed the Commission that the site was inspected by the previous Conservation Agent and was found to be in substantial compliance with the exception of the grass growing sufficiently. Mr. Alfieri conducted a recent site walk and informed the Commission that the site is presently stable and recommends that a Certificate of Compliance be issued.
There was a motion to issue a Certificate of Compliance for 18 Woodhaven Drive.
The motion was seconded and accepted with a vote of 7-0-0.
