Minutes of Meeting
June 7, 2007

There was a motion to accept the minutes of the May 3rd meeting. The motion was seconded and accepted with a vote of 6-0-0.
There was a motion to accept the minutes of the May 17th meeting with 2 corrections. The motion was seconded and accepted with a vote of 7-0-0.
Mr. Richard Vacca’s Agent Report has been appended to the minutes.
There was a motion to accept Ms. Monique Allen as an Associate Member of the Conservation
Commission. The motion was seconded and accepted with a vote of 7-0-0.
There was a motion to authorize the homeowner of 1 Miller to amend the Negative Determination for a 3-season sunroom as per the plan with the additional erosion controls. The motion was seconded and accepted with a vote of 4-3-0; 4 Yes, 3 No, 0 Abstentions.
There was a motion to endorse the MACC in support of the Public Lands Preservation Act as requested. The motion was seconded and accepted with a vote of 7-0-0.
There was a motion to authorize the Conservation Chairman to send a letter to both Representative Vallee and our 2 State Senators. The motion was seconded and accepted with a vote of 7-0-0.
The Conservation Agent will draft the above-mentioned letters have them ready for the Chairman’s signature at the next Conservation meeting on June 21st.
Public Hearing – Abbreviated Notice of Resource Area Delineation – Lot 6A Miller Street – Edward Kaiser – CE159-943
Mr. Richard Goodreau, Engineer of United Consultants, and Attorney William Sack, representing the applicant, both appeared before the Commission for the delineation of a resource area on Miller Street. Attorney Sack requested that if there were any abutters to the project, that they recuse themselves from the public hearing. The Chairman informed Attorney Sack that Ms. Monique Allen, Associate Member, is an abutter to the project but is not required to recuse herself as she is a non-voting member.
Mr. Goodreau stated that the purpose of this hearing is to have the Conservation Commission confirm the wetland boundaries on the site. The wetland boundaries have been delineated and checked by two different wetland environmental firms.
Mr. Goodreau stated that the wetland lines are highlighted on the plan and he requested that the Commission approve the bordering vegetated wetland boundaries between the 2 flags depicted on the plan.
The Chairman inquired of Mr. Goodeau as to whether or not there is a stream that runs through the site and questioned whether the riverfront areas have been depicted on the plans.
A Commission member requested that Mr. Goodreau provide the Commission with the stream stats model to determine whether the river is perennial.
Mr. Goodreau requested that the Commission visit the site and verify the wetland delineation and either agree or disagree with the location of the wetland flags.
A Commission member informed the Commission that once the wetland boundaries have been approved by the Commission and an ANRAD has been issued, this locks in the wetland boundaries for three years. The Commission members stated that they would like to conduct a site walk of the property before issuing an ANRAD.
There was a motion to continue the hearing until June 21st so that the Commission may conduct a site walk. The motion was seconded and accepted with a vote of 7-0-0. The Commission will walk the site on Tuesday, June 12th at 7 p.m.
Continued - Public Hearing – Notice of Intent – Eaton Place – Off Panther Way – Community Builders – CE159-942
The Commission Chairman stated that a letter dated June 5th has been received from the applicant’s representative requesting a continuance of the public hearing until June 21st. There was a motion to continue the hearing until June 21st. The motion was seconded and accepted with a vote of 7-0-0.
GENERAL BUSINESS
Minor Buffer Zone Activity: 15 Cobblestone Drive
The proposed work is for the installation of a 24 ft. diameter above-ground pool. The pool would be located in the backyard with a cartridge filter to be used.
There was a motion to issue a Negative Determination with the 3 special conditions as stated by the Agent. The motion was seconded and accepted with a vote of 7-0-0.
Minor Buffer Zone Activity: 64 Southgate Road
The proposed work is for the installation of a 24 ft. diameter above-ground pool. The work would take place on previously disturbed area. A non-backwashing filter with no chlorine must be used in the pool.
There was a motion to issue a Negative Determination with the 3 special conditions as stated by the Agent. The motion was seconded and accepted with a vote of 7-0-0

There was a motion to adjourn. The motion was seconded and accepted with a vote of 7-0-0. The meeting adjourned at 8:35 p.m.
