Minutes of Meeting
January 25, 2007

There was a motion to accept the minutes of the meeting of January 4th with one correction. The motion was seconded and accepted with a vote of 3-0-1; 3 Yes, 0 No, 1 Abstention.
Mr. Richard Vacca’s Agent Report has been appended to the minutes.
There was a motion to grant the Manomet Center for Conservation Science permission to study the vernal pools on 4 Town-owned parcels.
There was a motion to allow the Manomet Center for Conservation Science permission to study the vernal pool at Lot 10 Cottontail Lane in the Sandy Knoll Subdivision. The motion was seconded and accepted with a vote of 5-0-0.
Enforcement
Ms. Hanh Le, homeowner of 367 Summer Street, and Mr. Donald Nielsen, Engineer of Guerriere & Halnon, both appeared before the Commission on an Enforcement matter for unauthorized filling in the resource area at 367 Summer Street.
Mr. Nielsen informed the Commission members that the wetlands on the property have been flagged so that the limits are located. On the upgradient side, in the location of the earthern berm, there will be a depression to allow the water to flow under the driveway and discharge to the opposite side of the lawn. There will be no alteration of the flow of water.
Mr. Nielsen informed the Commission that at the next Conservation meeting, he will submit a plan for this restoration work.
Mr. Dan Gosch, an abutter of 369 Summer Street, stated that the natural stream overflows onto the driveway of 367 Summer Street and backs up onto his property. He had concerns regarding the dam causing a backup of water onto his property and creating an icing problem at the base of his driveway.
The Conservation Chairman stated that this restoration work will be done as quickly as possible considering there is a financial hardship on the part of the homeowner.
Mr. Nielsen and Ms. Le will appear at the next Conservation meeting on February 8th with the plans for this work and an update on the progress.
Continued - Public Hearing – Amendment Request to Orders of Conditions – 438 West Central Street – SE159-862
Mr. Alan Micale, Engineer of Ayoub Engineering, appeared before the Commission for minor modifications to an existing building and site. Mr. Micale presented revised plans for the Commission’s review. The Shell Station is seeking to build a convenience store with a drive through. The applicant would like to remove a portion of the back of the building and build a new wall to accommodate the drive through.
The work will take place along the existing edge of pavement; there will be no further encroachment into the wetlands at the rear of the site from the original plans.
Mr. Micale stated that a reconfiguration of the building only will be done and a slight increase in the runoff.
Mr. Vacca asked Mr. Micale to install raingardens to control runoff rather than curbing for the site. Mr. Vacca also requested that the applicant keep as much activity as possible in the previously disturbed area. There will be no snow storage on the property; it will be trucked off the site.
There was a motion to continue the hearing until February 8th. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent - 31 Opal Circle – South Hill Estates - 159-929
Mr. Richard Goodreau, Engineer of United Consultants, appeared before the Commission for the construction of an in-ground swimming pool, pool house, shed and sports court. Mr. Goodreau informed the Commission that the wetlands on the site were delineated as part of the South Hill Estates subdivision process in May 2003.
The wetland boundary at the rear of the property has been redelineated by Mr. Douglas Sparrow of Sparrow Environmental. Mr. Goodreau would like to present a revised plan to the Commission with respect to the new delineation.
Mr. Goodreau requested that the Commission members walk the new wetland boundary to determine if they agree with its accuracy or if they would prefer to accept Mr. Sparrow’s plan and the recommendations of Mr. Vacca.
Mr. Vacca stated that, in his opinion, the new wetland line is accurate and Mr. Goodreau should proceed with a revised plan with respect to the new delineation.
There was a motion to continue the hearing until February 8th so that Mr. Goodreau may have an opportunity to submit the revised plans. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – 3 Peppermill Lane – Todesca - 159-932
Mr. Bill Halsing, Engineer of Land Planning, Mr. Joseph Todesca, the applicant, and Mr. Roland Guilmette, the contractor for the project, all appeared before the Commission for the construction of an addition to existing single-family house.
Mr. Vacca stated that all of his comments with respect to the revised plans have been addressed and recommends that the Commission close the public hearing and issue an Orders of Conditions at the next meeting.
There was a motion to close the hearing. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – Franklin Sports Mall – Washington Street - 159-923
The Commission Chairman stated that a letter has been received from the applicant’s representative dated January 25th requesting a continuance of the public hearing until March 22nd.
There was a motion to continue the hearing until March 22nd. The motion was seconded and accepted with a vote of 5-0-0.
Continued - Public Hearing – Notice of Intent – 3 Peters Lane – Dolan - 159-931
The Commission Chairman stated that a letter has been received from the applicant dated January 17th requesting a continuance of the public hearing until February 8th.
There was a motion to continue the hearing until February 8th. The motion was seconded and accepted with a vote of 5-0-0.
GENERAL BUSINESS
Permit Decision: Pleasant Street Culvert Replacement – 159-933
There was a discussion among Commission members regarding the issuance of Orders of Conditions for this project.
There was a motion to issue State and Local Orders of Conditions with 1 Special Condition and a letter sent to the DPW Director. The motion was seconded and accepted with a vote of 4-0-1;
4 Yes, 0 No, 1 Abstention.
