ZONING BOARD OF ADJUSTMENT
MEETING MINUTES
Thursday – January 6, 2011
356 Main Street - Farmington, NH

Members Present:                Elmer W. "Butch" Barron III, John David Aylard, Joe Pitre and Paul Parker.

Members Excused:                Joanne Shompe (excused)

Town Staff Present:     Town Planner Kathy Menici

Public Present:         Albert Cameron

Chairman Barron called the meeting to order at 7:04pm.  

Business Before the Board:

Review and approve the Meeting Minutes of 12-2-10:  
         Paul Parker motioned to accept the minutes of 12-2-10 as written, 2nd Joe Pitre.  Motion carried with all in favor.

CONTINUED CASES:
  • Application for Variance Approval By: Elaine Blaney (Tax Map R20, Lot 010):  To allow for mixed Commercial & Residential use in the Commercial Business (CB) Zoning District.  Parcel is located at 359 NH Route 11.
The applicant sent a letter to the Board requesting a continuance.  Joe Pitre motioned to continue the application by Elaine Blaney (Tax Map R20, Lot 010) to February 3, 2011, 2nd John Aylard.  Motion carried with all in favor.

NEW CASES:
Application for Special Exception Approval By: Albert J. Cameron Jr. (Tax Map U03, Lots 16 & 17): To allow proposed single family homes to be built on each lot, in the Commercial Business (CB) Zoning District.  Parcel is located at Trotting Park Road.

Chairman Barron recused himself from the application noting he has done business with the Camerons for years.  He then informed the applicant of his right to a full Board and he  agreed to proceed tonight with the three members present.  The applicant would like to develop the two remaining lots that were held out years ago when the development was first constructed.  Paul asked the subdivision was first approved and Mr. Cameron replied it was originally subdivided in the 1970s.  Kathy explained the issue for the Board to address tonight is the Special Exception to allow a residential use in the Commercial Business Zoning District and both lots are existing non-conforming lots.

Joe Pitre motioned to grant the Special Exception by Albert Cameron (Tax Map U03, Lot 16) to allow a residential home to be constructed in the Commercial Business Zoning District, 2nd Paul Parker.  Discussion followed where John asked if they would be able to meet the setbacks and Mr. Cameron replied yes.  John opened the public hearing and because there were no comments he closed it.  Motion carried with all in favor.

John opened the public hearing for the special exception for Tax Map U03, Lot 17 and hearing no comments closed the public hearing.

Joe Pitre motioned to grant the Special Exception by Albert Cameron (Tax Map U03, Lot 17) to allow a residential home to be constructed in the Commercial Business Zoning District, 2nd John David Aylard.  Motion carried with all in favor.

  • Per RSA 674:32-c.II, Waiver Request By: Mark V. Pearson (Tax Map R35, Lot 1) to allow the expansion of an existing greenhouse in the front setback, for property located at 695 NH Route 11 in the Commercial Business (CB) Zoning District.
John Aylard motioned to continue the application by Mark Pearson (Tax Map R35, Lot 1) to February 3, 2011, 2nd Joe Pitre.  Motion carried with all in favor.

OTHER BUSINESS TO COME BEFORE THE BOARD:
  • Kathy informed the Board that she spoke with Town Counsel about “the right to a full board” and their opinion is that there is no law that states an applicant has the right to a full board.  It would be considerate to explain to the applicant that they will need three votes in favor to get approval of their application but the Board does not need to provide a full board.
Joe Pitre motioned to adjourn, 2nd John David Aylard.  Motion carried with all in favor at 7:31pm.

Chairman Barron adjourned the meeting.
