ZONING BOARD OF ADJUSTMENT
MEETING MINUTES
Thursday – September 3, 2009
356 Main Street - Farmington, NH

Members Present:        Elmer W. "Butch" Barron III, Joe Pitre, Joanne Shomphe, John David Aylard and Paul Parker.

Public Present: Ryan Corbett, Mrs. Corbett

Chairman Barron called the meeting to order at 6:37pm.

Business Before the Board:
Chairman Barron seated Joanne Shomphe in the vacant seat.  

Review and approve the Meeting Minutes of 7-2-09:  
        Joe Pitre motioned to accept the minutes of 7-2-09 as presented, 2nd John David Aylard.  Motion carried.

Continued Cases:
None.  

New Cases:
Application for a Use Variance Approval By: Ryan Corbett (Tax map R04, Lot 004):To allow for Pre-existing garage and driveway to be used as commercial business by home owner for automotive service and repair, in the Agricultural Residential (AR) Zoning District.  Parcel is located at 77 Ten Road Road.

The Chairman informed the applicant of his right to a full board and Mr. Corbett decided to move forward with the application.  Paul Parker recused himself from the application noting a possible conflict with the Planning Board.

The Board reviewed the application.  The property contains an unattached garage structure that will more than accommodate the applicant’s needs.  The closest neighbor is 300 feet away and the applicant stated he visited each abutter to explain his proposal with no negative feedback from them.  The hours of operation are proposed at Monday through Friday 8am – 5pm and the applicant is proposing a sign at the front of his property.  John asked if the applicant will be doing any painting on the premises and he replied no, he will not be doing any bodywork at all.

Butch read the definition of a home business in the Zoning Regulations and stated that he feels the applicant does not need a Use Variance because he meets the requirements of a home business that is permitted with review from the Planning Board.  Butch informed the applicant that he believes he was sent to the ZBA in error due to the fact the Town as an interim Town Planner, apologized and told him to forward an application to the Planning Board.

Butch Barron motioned to continue the application for a Use Variance by Ryan Corbett (Tax Map R04, Lot 004) to October 1, 2009 and if there is no ZBA meeting that month the application will be rolled over to the next regular meeting, 2nd Joe Pitre.  Motion carried.

Joe Pitre motioned to adjourn, 2nd John David Aylard.  Motion carried with all in favor.  

Chairman Barron adjourned the meeting at 7:17pm.
