ZONING BOARD OF ADJUSTMENT
MEETING MINUTES
Thursday – July 2, 2009
356 Main Street - Farmington, NH

Members Present:                Elmer W. "Butch" Barron III, Joe Pitre, Joanne Shomphe and John David Aylard

Members Excused:                Paul Parker

Town Staff Present:     Director of Planning and Community Development, Daniel Merhalski

Public Present:         Stamatia Miminas and Ann Titus

Chairman Barron called the meeting to order at 6:37pm.

Business Before the Board:
Chairman Barron seated Joanne Shomphe for Randy Orvis.

Review and approve the Meeting Minutes of 6-4-09:  
        Joe Pitre motioned to accept the minutes of 6-4-09 as presented, 2ndJoanne Shomphe  Motion carried with John David Aylard abstaining.

Continued Cases:
None.  

New Cases:
Application for Use Variance (Section 3.08) By: Mrs. Stamatia Miminas (Tax Map U05, Lot #182); Located @ 498 Main Street; to allow for fewer parking spaces than the required amount for the proposed two (2) dwelling units on the site.  The site is located within the Village Center (VC) Zoning District.

Chairman Barron informed the applicant that there are only four members presently on the Board that can hear her application though she does have the right to a five member board and can wait for this hearing until such time the Board has five members.  Mrs. Miminas agreed to waive her right to a full board and to proceed with the application tonight.

The Board reviewed the application.  Dan explained that granting the Use Variance would change the parking requirement from four spaces to two.  The lot only allows for two spaces on-site and though the applicant has received a lease for two parking spaces in a close by parking lot the lease is not forever or 99 years and therefore would not guarantee the spaces for the life of the apartment.  Dan further explained that that applicant did appeal to the Board of Selectmen to lease spaces in the Municipal Parking lot but they denied her request.

Chairman Barron questioned why the lot is not grandfathered since all the residential lots in the Village Center have the same problem.  Dan explained that the apartments have been vacant for at least the past ten years and when the building inspector recently identified the units as unoccupiable for safety reasons the grandfather status was lost.

Chairman Barron opened the hearing for public comment.  Ann Titus commented that she hoped the applicant was aware she has the right to a five member board and the Chairman said yes she does.

Joe Pitre motioned to grant the Use Variance from Section 3.08B of the Zoning Ordinance to Mrs. Stamatia Miminas (Tax Map U05, Lot #182) as requested to allow for two parking spaces on-site rather than four, 2nd Butch Barron.  Motion carried with all in favor.

John David Aylard motioned to adjourn, 2nd Joe Pitre.  Motion carried with all in favor.  

Chairman Barron adjourned the meeting at 7:03pm.
