ZONING BOARD OF ADJUSTMENT
MEETING MINUTES
Thursday – May 7, 2009
356 Main Street - Farmington, NH

Members Present:        Elmer W. "Butch" Barron III, Joe Pitre, John David Aylard, Joanne Shomphe and Paul Parker.

Town Staff Present:     Director of Planning and Community Development, Daniel Merhalski

Public Present: Catherine Howard, Sylvia Arcouette, Ms. Carr and Ralph Russell

Chairman Barron called the meeting to order at 6:43pm.

Business Before the Board:
Chairman Barron seated Paul Parker and Joanne Shomphe.  It was noted that there are two full time vacant seats on the Board.

Election of Officers:
        a.  Joanne Shomphe nominated Butch Barron for Chairman, 2nd John Aylard.  Motion carried with Butch Barron abstaining.
        b. Joanne Shomphe nominated John Aylard for Vice-Chairman, 2nd Butch Barron.  Motion carried with John Aylard abstaining.
        c. Butch Barron nominated Joanne Shomphe for Secretary, 2nd John Aylard.  Motion carried with Joanne Shomphe abstaining.
        d.  Butch Barron motioned to have Brandy Sanger be the recording secretary and for the Planning Department to continue to take care of all the postings and paperwork, 2nd John Aylard.  Motion carried.

Review and approve the Meeting Minutes of 3-5-09:  
        Paul Parker motioned to approve the minutes of 3-5-09 as written, 2nd Butch Barron.  Motion carried with Joanne Shomphe and John Aylard abstaining.

Continued Cases:
None.  

Joe Pitre arrived at 6:55pm.

New Cases:
Application for a Special Exception (Section 2.00 and 2.05) By: Northern Strafford County Juvenile Court Diversion Program d.b.a. CHANCES (Tax Map U-6, Lot 8); To allow for use of a non-profit social services organization in the Village Center (VC) Zoning District.  Parcel is located at 9 Mechanic Street.

Paul Parker recused himself from the application because they will be before the Planning Board of which he is the Chairman.
Catherine Howard, Executive Director of CHANCES, explained that they would like to move from the present address of 359 Main Street to 9 Mechanic Street.  The Board reviewed the application.  The Chairman read Section 2.00.E that listed the standards that need to be met in order to grant a Special Exception.  Ms. Howard stated that the hours of operation would be 11am to 7pm but noted that they are typically not in the building during most of those hours.  She further noted that the participants typically walk down from the high school and in a rare instance there would be more than two vehicles; those vehicles will park in the Municipal Parking Lot.  Ms. Carr stated that she would like to make sure nobody will be parking in her mother’s parking area across the street and that the road will not be blocked.

Butch asked if the proximity to the bar would cause a risk to the minors.  Ms. Howard replied that the bar is open Friday, Saturday and Sunday and they only have open hours on Friday of those days.  She further stated that on Fridays they will have sufficient monitoring and will not plan any events at that time.

It was discussed that there is no front, side or rear yard so landscaping and screening is not necessary.  Ms. Howard stated that they are looking to remove the three garage doors and install two windows and a handi-capped access way, plus vinyl siding.

The Board discussed the Special Exception standards as applied to the current application.

Butch Barron motioned to grant CHANCES a Special Exception from Sections 2.00 and 2.05 of the Zoning Ordinance as presented with the conditions that the hours of operation be no earlier than 8am or later than 7pm and no parking on the opposite side of the road by patrons of the facility, 2nd Joe Pitre.  Motion carried with all in favor.

John Aylard motioned to adjourn, 2nd Joanne Shomphe.  Motion carried with all in favor.  Chairman Barron adjourned the meeting at 7:25pm.
