ZONING BOARD OF ADJUSTMENT
THURSDAY - AUGUST 2, 2007
356 MAIN STREET - FARMINGTON, NH

Members Present:        Elmer W. "Butch" Barron III, Barry Elliot, John David Aylard and                                Randy Orvis

Members Absent: Joanne Shompe – Alternate – without notification

Public Present:         Randy Talon, Dan Woodman, Jean Marie Huppe, and Edward Bernier

Chairman Barron called the meeting to order at 6:30pm.

Chairman Barron calls for a motion on the previous months minutes; Barry Elliot motions to approve the minutes of July 12, 2007 as amended with verification of who the memo was from during July meeting in regards to Ms. Stickles application, 2nd Randy Orvis; no further discussion; all those in favor; motion passes.

New Business

Application for an Area Variance: By: Farmington 500 Boys and Girls Club (Randy Talon) (Tax Map U6, Lot #118); Requesting a Variance from the setback requirements as detailed in Article 2.04, Section B of the Farmington Zoning Ordinance; to allow construction of a building addition without the required setbacks; Property located at 12 Summer Street; in the (UR) Urban Residential Zoning District.

Randy Talon informed the Board that the Farmington 500 Boys and Girls Club are proposing to build a 24' X 70' batting cage with a roof on it and an addition to the present storage shed.  Barry Elliot questioned if the Club is clear where their boundary lines are and Mr. Talon responded that a licensed surveyor marked the property for them and that the chain link fence is six feet into their property.  

Barry Elliot motioned to grant the Area Variance as requested by the Farmington 500 Boys and Girls Club (Tax Map U6, Lot #118), 2nd Randy Orvis.  No further discussion, motion carried.

Application for an Area Variance: By: Jean Marie Huppe (Tax Map R24, Lot #012); Requesting a Variance from the setback requirements as detailed in Article 2.01, Section B of the Farmington Zoning Ordinance; to allow the construction of a Farmers Porch without the required setbacks; Property located at 313 Poor Farm Road; in the (AR) Agricultural Residential Zoning District.

Chairman Barron informed the Board that he received a letter from Leslie Barden, an abutter to the applicant and read it into the record.  The letter stated that Ms. Barden was in favor of granting the area variance because it would only enrich the value of the property and surroundings.

Randy Orvis stated that the ordinance does allow for a six-foot porch or canopy but does not state both, which is why Ms. Huppe is seeking the variance.  The proposed farmers porch would infringe on the setback by four feet.

Barry Elliot motioned to grant the area variance as presented by Jean Marie Huppe (Tax Map R24, Lot #012) provided that the farmers’ porch does not infringe on the setback by more than four feet, 2nd Randy Orvis.  No further discussion, motion carried.

Application for an Area Variance: By Amanda and Edward Bernier (Tax Map U10, Lot #118); Requesting a Variance from the setback requirements as detailed in Article 2.04, Section B of the Farmington Zoning Ordinance; to allow the construction of a 12' x 17' deck on the side of an existing pool without the required setbacks; Property located at 57 Glen Street; in the (UR) Urban Residential Zoning District.

Mr. Bernier informed the board that this deck would not be seen by his neighbor because they have a barn adjacent to the proposed deck that would block the view.  The proposed deck would be 42" high with railings and 12' wide at the narrowest section with the widest being 18' to 20'.  

Randy Orvis stated that he is concerned with the proximity of the neighbors barn and this proposed deck and would like the opinion of the Fire Chief if this is a fire hazard and/or acceptable.

Chairman Barron motioned to continue the discussion of the application for an area variance by Edward Bernier (Tax Map U10, Lot #118) to give the applicant time to question the Fire Chief to see if he is comfortable with the proposal, 2nd Randy Orvis.  Discussion followed that Mr. Edwards should provide a written statement from the Fire Chief and/or the Building Inspector regarding any concerns they may have with the proposal as well as more concrete measurements of the proposed deck.  Motion carried.








Randy Orvis motions to adjourn; 2nd John David Aylard; no further discussion; all those in favor; motion carries.

Meeting adjourned at 7:25pm.
