TOWN OF FARMINGTON
ZONING BOARD OF ADJUSTMENT
THURSDAY - MAY 3, 2007
356 Main Street - Farmington, NH

Members Present:        Chairman Elmer W. "Butch" Barron III, Barry Elliot, John David Aylard,
                        Randy Orvis and Alternate Joanne Shompe.

Public Present: Arthur Hoover and Ronald Goslin

Chairman Barron called the meeting to order at 6:04pm.

Chairman Barron calls for a motion on the previous months minutes; John David Aylard motions to approve the minutes of April 5, 2007 as presented, 2nd Barry Elliot; no further discussion; all those in favor; Randy Orvis abstained; motion passes.

Chairman Barron advises the members of the board that he does not see representation for the first item on the agenda:
Continuation of Application from 02-01-2007 for an Equitable Waiver of Dimensional Requirements: From Article 2.01; Section (B) of the Zoning Ordinance; By: Su-Ann Stickles, (Tax Map R5, Lot 9-2); Requesting a Variance for a pre-existing violation of a dimensional requirement of the Zoning Ordinance.  Property is located in the (AR) Agricultural Residential Zoning District; known as 20 Abbey Lane

Barry Elliot advises the members of the board that he believes that the applicants are having a difficult time getting the assistance they need in filling out the appropriate forms due to the lack of a full staff in the Planning Office.  Barry Elliot motions to continue the application brought forth by Su-Ann Stickles to June 7, 2007 with the conditions that the Stickles receive correspondence from the Town informing them that this will be their last extension without some type of response from them, 2nd John David Aylard; no further discussion; all those in favor; motion passes.

Application for a Use Variance:  By: A.J. Foss (Paul Cardinal) (Tax Map R19, Lot #24); Requesting a Variance to permit the excavation in size of an existing stock-pile area; filling in of a large hole (left by previous owner); "maybe" in the future to relocate main business entrance; "maybe" erection of another garage; and also the use as a sand pit.  Property is located in the (RR) Rural Residential Zoning District at 100 Cocheco Road.

Chairman Barron advises the members of the board that a letter was received from Mr. Cardinal requesting a 60-day extension in order to get all his requirements in order.  Barry Elliot motioned to continue the application by AJ Foss (Tax Map R19, Lot #24) until July 5, 2007; motion failed for lack of a second.  Discussion was held that the 5th of July is during the holiday week and a lot of people are on vacation.
Barry Elliot motioned to change the July 5, 2007 meeting date to July 12, 2007 because of the holiday, 2nd John David Aylard; no further discussion; all those in favor; motion carries.






Barry Elliot motioned to continue the application by AJ Foss (Tax Map R19, Lot #24) until July 12, 2007, 2nd Randy Orvis; no further discussion; all those in favor; motion carries.

Application for an Area Variance from Article 2.04, Section B of the Zoning Ordinance:  By Ronald and Melissa Goslin (Tax Map U02, Lot #51); Requesting a Variance from the density requirements of 10,000 square feet per residential unit; for a proposed conversion from an assisted living facility to a 3 family residential unit; Located at 31 Tappan Street, in the (UR) Urban Residential Zoning District.

Attorney Arthur Hoover attended the meeting to represent the Goslins.  He stated that he just recently received the file and was looking for some clarification on Article 2.04, Section B of the Zoning Ordinance.  He stated that it appeared there was an error in the section and that maybe the maximum requirement was actually a minimum, so that the minimum density is 1 dwelling per 10,000 square feet.  After much discussion by this Board it was decided that the document reads appropriately and the Goslins would need to request a variance.

Attorney Hoover also questioned Section C under Non-Conforming Lots on Page 7 of the Zoning Ordinance.  Chairman Barron stated that he agrees this lot is an existing non-conforming lot.  Attorney Hoover thanked him for clarifying and asked for a 30-day continuation so that he can better prepare for the Variance request.  Barry Elliot motioned to continue the application by Ronald and Melissa Goslin (Tax Map U02, Lot #51) for 30 days until June 7, 2007; 2nd John David Aylard; no further discussion; all those in favor; motion carries.

John David Aylard motioned to adjourn; 2nd Barry Elliot; no further discussion; all those in favor; motion carries.

Chairman Barron adjourns the meeting at 6:31pm.
