ZONING BOARD OF ADJUSTMENT
THURSDAY - APRIL 5, 2007
356 MAIN STREET - FARMINGTON, NH

Members Present:        Elmer W. "Butch" Barron III, Barry Elliot, John David Aylard,
Joanne Shomphe - Alternate

Absent: Randy Orvis – Without notification

Public Present:  Paul Cardinal, John Cardinal

Chairman Barron called the meeting to order at 6:16pm.

Chairman Barron seats alternate Joanne Shomphe for Randy Orvis.

Chairman Barron calls for a motion on the previous months minutes; John David Aylard motions to approve the minutes of March 1, 2007 as presented, 2nd Joanne Shomphe; no further discussion; all those in favor; motion passes.

Chairman Barron advises the members of the board that he does not see representation for the first item on the agenda:
 Continuation of Application from 02-01-2007 for an Equitable Waiver of Dimensional Requirements: From Article 2.01;Section (B) of the Zoning Ordinance; By: Su-Ann Stickles, (Tax Map R5, Lot 9-2); Requesting a Variance for a pre-existing violation of a dimensional requirement of the Zoning Ordinance.  Property is located int he (AR) Agricultural Residential Zoning District; known as 20 Abbey Lane.

Barry Elliot advises the members of the board that he believes Ms. Stickles is still resolving issues with the Planning Board.  Barry Elliot motions to continue the application brought forth by Su-Ann Stickles to May 3, 2007, 2nd Joanne Shomphe; no further discussion; all those in favor; motion passes.

Chairman Barron advises the members of the board that a new application has been brought forward;
Application for a Use Variance: By: A.J. Foss (Paul Cardinal) (Tax Map R19, Lot
#24); Requesting a Variance to permit the extension in size of an existing stock-pile area; filling in of a large hole (left by previous owner); "maybe" in the future to relocate main business entrance; "maybe" erection of another garage; and also the use as a sand pit.  Property is located in the Rural Residential Zoning District at 100 Cocheco Road.

Chairman Barron advises the members of the board that this property is zoned suburban residential but has an existing variance.  Barry Elliot interjected that this zone is limited in its commercial and industrial uses.

Chairman Barron questioned Paul Cardinal as to what type of business he has.  Paul Cardinal responded he is a manufacturer of precast concrete.  Paul Cardinal stated that he bought the two adjacent lots to his existing property in which there is a "big" hole.  At this point Paul Cardinal would like to fill in the hole and use the lots for stock piling the material he has on his property.  Paul Cardinal stated his plans do not include bringing in materials from outside sources or running a gravel pit so there would be no increase in traffic.  Paul Cardinal stated he is currently in front of the Planning Board to get a building permit to add an extension on his main building and the Planning Board instructed Paul Cardinal to apply for the variance he is today.

Barry Elliot stated he did not see anything in the Zoning Ordinances that would keep the board from issuing a variance.  Chairman Barron added that the variance would most likely fall into an accessory use to an existing business.  Barry Elliot informed Paul Cardinal that there are some setbacks for the brook adjacent to his property and that Paul Cardinal could get a copy of the Ordinances from the Planning Office.

Chairman Barron advises the members of the board that the application is missing what Paul Cardinal needs relief from; this item was left blank on the application.  Chairman Barron informed Paul Cardinal that he has the proper application but it has many deficiencies that need to be rectified before this board can review it.  Chairman Barron motioned that due to circumstances out of Paul Cardinal's control the application is incomplete and will be continued to May 3, 2007; 2nd Barry Elliot; no further discussion; all those in favor; motion passes.

Chairman Barron advises the members of the board that the election of new officers needs to take place.  Barry Elliot motioned to re-elect Chairman Barron as the Chair; 2nd Joanne Shomphe; no further discussion; all those in favor; motion passes.
Chairman Barron motioned to elect Barry Elliot as the Vice-Chairman, 2nd John David Aylard; no further discussion; all those in favor; motion passes.
Chairman Barron motioned to elect Randy Orvis as Secretary; 2nd John David Aylard; no further discussion; all those in favor; motion carries.
