ZBA Meeting Minutes 01-05-2006
ZONING BOARD OF ADJUSTMENT
THURSDAY – JANUARY 5, 2006
356 MAIN STREET  -  FARMINGTON, NH

Chairman Barron calls the meeting to order at 6:06 p.m.

Review and approve meeting minutes of 12-01-2005; Chairman Barron comments that on Page 1 under
6:05 p.m. to 6:45 p.m. the Board did not go into non-public session as indicated; they conferred with the Town
of Farmington Attorney only; and had not opened the meeting prior to this, meeting minutes have been
amended to reflect this; On Page 4 – 5th typed line; reword statement by John David Aylard to read “I perform services for someone that knows Peter Alfe’ and I want to make sure that I’m not creating a conflict”, Chairman Barron motions to accept the minutes as amended, 2nd Gerald McCarthy, no further discussion, all those in favor, motion passes.

To review condition of approval established for Elm Street Farmington, LLC (David DeJager) (Tax Map U6, Lot #4): known as 17 Mechanic Street, located in the (VC) Village Center Zoning District.  Specifically the requirement for green space to replace the mobile home removed from the site.

Chairman Barron turns the floor over to Paul Esswein to being opening comments regarding this application; Paul Esswein reviews some of the meeting comments from the July ZBA meeting regarding this application where a variance was granted.  The applicant then came before the Planning Board in November 2005 and they reviewed the condition(s) of approval as directed by the ZBA.  The Planning Board Members were uncomfortable with the substitution as showing parking spaces where the mobile home was versus “green space” as previously approved.  Chairman Barron also commented that the applicant (David DeJager) has stated that the parking would be off street and enclosed and the mobile home would be completely removed and relocated to the back.  Chairman Barron and Gerald McCarthy cannot see where this plan / Mylar conforms to the ZBA decision; suggest that he apply for another variance if he wants to change it.  Chairman Barron wants a letter written to the Planning Board about the interpretation of the decision and that it should be green space and not parking; suggested Paul Esswein write the letter, no further comments.







Chairman Barron notes that we have received 2 letters of resignation;
(1)     Donna Gorney – Alternate
(2)     Neil Gosselin, Jr.
Gerald McCarthy and John David Aylard both accept those letters of resignation, Chairman Barron indicates that Paul Esswein should write a letter to the Board of Selectmen noting that the ZBA has lost 2 of their members.


Chairman Barron asks Barry Elliott if he is willing to serve as a full-time permanent member of the ZBA; Barry Elliott is in agreement. Barry Elliott must write a letter of interest and reapply to the Board of Selectmen for this position.  

Paul Esswein speaks with Chairman Barron regarding input from the ZBA that is required for the addition to the Town of Farmington annual report, it is agreed that Paul Esswein will do the write up and Chairman Barron will sign.

6:18 p.m.

John David Aylard motions to adjourn, 2nd Gerald McCarthy, no further discussion, all those in favor, motion passes.
