ZONING BOARD OF ADJUSTMENT
THURSDAY, JANUARY 6, 2005

Members Present:        Margaret Russell, Randy Orvis, Russell Stoakes, Neil Gosselin, Jr., Donna Gorney (Alternate), John David Aylard (Alternate)
Staff Present:  Paul Esswein
Public Present: None

The meeting was called to order at 7:00 p.m.  It was determined that a quorum
was present.

Election of Vice Chairman – With the resignation of Tom Brennan from the
Board the position of Vice Chairman is vacant.  It was determined that only a
regular member of the Board could be elected to the Vice Chair position, leaving
only Randy Orvis, Neil Gosselin and Russell Stoakes as potential candidates.
Randy indicated that he could not accept the position due to potential conflicts.

Motion by Randy Orvis to elect Neil Gosselin Vice Chairman of the Zoning
Board of Adjustment, second by Russell Stoakes – motion carried.

Paul Esswein announced that WCV, Inc. has filed an appeal of the decision to
deny a rehearing with the Superior Court, and that they have requested a
rehearing before the ZBA of the variance request.

The Zoning Board minutes of December 8, 2004 were reviewed.
Motion by Russell Stoakes to accept minutes as presented, second by
Randy Orvis – motion carried.

The Zoning Board minutes of November 4, 2004 were reviewed.
Motion by Randy Orvis to accept minutes as presented, second by Russell
Stoakes – motion carried.

Motion to continue the Public Hearing in the matter of the EquiVise request for a Special Exception to Thursday, January 13, 2005 by Randy Orvis, second by Neil Gosselin, Jr. – motion carried.

Discussion of procedure for reviewing Special Use requests.  The Board without reference to any specific proposal discussed general criteria and standards for review and approval of Special Exceptions in preparation for the public hearing continued to January 13, 2005.  Paul Esswein will check with the town attorney on the scope of the review should a proposed use be found not to be consistent in character with other uses allowed within the district, specifically whether the application should be reviewed against the standards contained in Section 2.00 paragraphs (A) and (B).

Motion to adjourn by Randy Orvis, second by Russell Stoakes – motion carried.
