ZONING BOARD OF ADJUSTMENT
MEETING
THURSDAY, FEBRUARY 5, 2004

Members Present:  Charlie King, Gordon Grant, Randy Orvis, Paul Parker.  Russell
                                  Stoakes called to be absent and Margaret Russell on vacation.  
Staff Present:           Fran Osborne
Public Present:         Jean & John Aylard, Beth & Don Littlefield, Elizabeth Fischer, and
                                   Rocky Newton

·       Chairman Parker called the meeting to order at 7:00 p m.  The minutes of December 4, 2003 were reviewed.  Charlie King made a motion to accept the minutes as written, Randy Orvis 2nd, no discussion, Randy Orvis abstained from vote, motion carried.

·       Charlie King – discussion on OSP web page.  ZBA is not required to make ruling the night of an applicant’s hearing, they can continue to get an opinion on rendering a decision.  Discussion on postponing a meeting.

·       Chairman Parker read a letter of invitation to a meeting from Moose Mountain Greenways on February 16, 2004 in Middleton Town Hall.

·       ZAMPS will meet on February 11, 2004 for a regular meeting and with Applied Economic Research on February 12, 2004.  

·       Charlie King made a motion to recess at 7:15, Gordon 2nd, motion carried.  Meeting reconvened at 7:30 p. m.

Public Hearing 7:30 p. m.

·       Application for Special Exception by Elizabeth Fischer as provided in Section 1.04 (B( (2) of the Zoning Ordinance for 43 South Main Street (Tax Map U6, Lot 104), to expand unit #4.  Chairman Parker seated Gordon Grant for Margaret Russell.  Chairman explained there are only 4 members to hear her case and does she want to go forward.  
Charlie King – I would be receptive to adding a meeting to deal with this.  Discussion on continuing this hearing to February 19, 2004.  Elizabeth Fischer asked for legal counsel interpretation.  Discussion.  Mrs. Fischer asked if she could obtain a copy of  legal counsel’s letter.  Fran will ask E. Creveling, Town Administrator and let Mrs. Fischer know.  Motion by Randy Orvis and 2nd by Gordon Grant to recess for 10 minutes, motion carried.  Meeting reconvened at 7:40 p.m.  Motion was made by Randy Orvis and 2nd by Charlie King to continue this hearing to February 19, 2004 at 7:00 p. m.

·       Application for Appeal of an Administrative Decision in relationship to Section 2.01 (B) of the Zoning Ordinance – no reason for the denial made by the ZBA on December 4, 2003 regarding Application for Variance in relation to frontage requirement (Tax Map R59, Lot 31).  Chairman Parker explained procedure of appeal.  Rocky Newton asked to be heard by a full board as only 4 are present this evening.  Motion by Gordon Grant, 2nd by Charlie King to continue this hearing to February 19, 2004.  No discussion, all in favor of motion, motion carried.

·       Discussion of Zoning  Board duties for a member of the public, John Aylard.  He may consider becoming a member of the board.  Fran gave him an application.  

·       Randy Orvis made a motion to adjourn and Gordon 2nd at 7:55 p. m., all in favor, motion carried.
