BOARD OF SELECTMEN
MEETING MINUTES
JULY 31, 2006



Present: Chairman Paula Proulx, Vice Chairman Paul Parker, Selectmen George Meyer, Marty Gilman, Gerry McCarthy and Town Administrator Paul Weston.

Minutes of 7/10 (non – public). Upon Motion by Mr. Parker and seconded by Mr. Gilman, the July 10th non-public minutes were approved as amended by a 5 to 0 vote in favor, and sealed for sixty days.

Minutes of 7/24 (public).  Upon Motion by Mr. Parker and seconded by Mr. McCarthy, the July 24 meeting minutes (public) were approved as amended by a 4 – 0 – 1 vote in favor, with four in favor and one abstention (Mr. Gilman who was in attendance).

Minutes of 7/24 (non-public) Upon Motion by Mr. McCarthy and seconded by Mr. Parker, the July 24 non-public minutes were approved as written by a 4 – 0 –1 vote in favor, with four in favor and one abstention (Mr. Gilman).

PUBLIC INPUT Mr. Joe Cardin appeared before the Board to ask that the sign on South Main Street warning that pedestrians have the right of way in crosswalks be put back up.  Mr. Cardin discussed at length with the Selectmen has grievance that the Farmington Police Department and the District prosecutor have failed to properly charge the driver who struck him while walking along Main Street.  Mr. Cardin stated the Attorney General has the case before him now.  He stated his allowing a dog to run at large was prosecuted more aggressively than the pedestrian-vehicle accident.  He stated he has the right to voice his opinion when at 12:43 PM in broad daylight he was struck, and now the Police are trying to drive him out of Town.  Chairman Proulx responded we could make no comment at this time because it has been presented to the Attorney General and Mr. Parker assured Mr. Cardin we would keep in touch as to how this goes.

DEJAGER ENCROACHMENT:  Chairman Proulx asked the Town Administrator to contact Mr. DeJaeger and inquire what the timeline will be on his response.

FUEL BIDS:  The Town Administrator was asked to obtain the proposed contracts for fuel from the four bidders as soon as possible – the Selectmen may have to meet in special session if there is a deadline on award.

BUILDING PERMITS:       Mr. Gilman requested the need for a building permit for roofs, siding, doors, and windows be brought to the next agenda.  There is strong sentiment this is not necessary.  The Town Administrator will contact the Codes office and the Assessor.

NON-PUBLIC SESSION:  At 6:55 PM upon a roll call vote on motion of Mr. Parker, Seconded by Mr. McCarthy,  (Ms. Proulx, Mr. Parker, Mr. Gilman, Mr. McCarthy, and Mr. Meyer in favor), the Board went into non-public session per RSA 91-A: 3, a & e to discuss the Collins and Aikman abatement request, a Contempt of Court filing in Stratford District Court from James Spaulding, and the Town Administrator’s performance evaluation.

Paul Parker motioned to come out of Non Public Session seconded by Marty Gilman. A roll call vote was taken: Paula Proulx – yes, Paul Parker – yes, George Meyer – yes, Gerry McCarthy – yes and Marty Gilman – yes.

Paul Parker motioned to seal the Non Public Minutes of July 31, 2006 for 90 days. Marty Gilman seconded the motion. 5 in favor.

Notice of motion by Paul Parker, seconded by Gerry McCarthy involving the performance review of Paul Weston. 3 in favor, 2 opposed. Motion passes.

MINUTES OF JUNE 6 (NON-PUBLIC) Upon motion of Mr. Parker, seconded by Mr. Gilman, the non-public minutes of June 5 were approved as amended, with four in favor, no opposed, and Mr. McCarthy abstaining.

PETITION – SUPERIOR COURT – JAMES SPAULDING Upon motion of Mr. Gilman, seconded by Mr. Meyer, a motion was made and passed unanimously to request Town Attorney Tim Bates represent the Town in court on September 26 to respond to a petition (attached) received from James Spaulding.  Mr. Bates will be asked to minimize the Town expense, and allow the attorney representing Farmington Ridge to take the lead in this matter.

Motion to adjourn by Paul Parker and seconded by Gerry McCarthy. All in favor, meeting adjourned at 10:30 pm.
