Board Members Present: Paul Parker, Dave Kestner, Cindy Snowdon, Charlie Doke, Jim Horgan (arrived at 6:15pm) and Glen Demers
Selectmen’s Representative: Charlie King (absent)
Town Staff Present: Director of Planning and Community Development Kathy Menici
Public Present: Neil Johnson and George Szirbik
At 6:08pm, Chairman Paul Parker opened the meeting.
BUSINESS BEFORE THE BOARD:
- Any Other Business to Come Before the Board:
- Kathy questioned if the Board would like to schedule the second public hearing for the Zoning Ordinances. Jim Horgan joined the meeting and Paul seated him in the vacant seat. Jim Horgan motioned to schedule a public hearing on January 27, 2011 at 6pm, 2nd Glen Demers. Motion carried with all in favor.
- Kathy reminded the Board that the Subdivision Regulations need a public hearing scheduled in order to have a final review for acceptance. Jim Horgan motioned to schedule the public hearing for the Subdivision Regulations for February 1, 2011, 2nd Charlie Doke. Motion carried with all in favor.
- Kathy informed the Board that a memo from Dennis Roseberry, Code Enforcement Officer, was forwarded to the Board in regards to the petition regarding 300 Main Street. The Board discussed that maybe it is time to forward this petition to Superior Court take future action. Dave stated that the tenants were not evicted from the building until November 15, 2010 and therefore he believes the 30 day timeline started when the eviction took place. Jim Horgan motioned to task the Code Enforcement Officer to provide the Planning Board with a lettering informing them of how Mr. Duchano is in violation of issues identified in the petition regarding 300 Main Street for the next Planning Board meeting and schedule the public hearing to address the petition for February 1,
2011, 2nd Charlie Doke. Discussion followed where Jim stated he would also expect a copy of the letter be sent to Mr. Duchano. Cindy stated she would also like Dennis Roseberry to attend the February 1, 2011 meeting. Motion carried with all in favor.
PUBLIC HEARING 6:41PM
CONTINUED CASES:
- Governors Road (Labrador Road) – Road Acceptance:
Mr. Szirbik explained that he has petitioned for road acceptance of Labrador Road and is working to present it at Town Meeting. Paul noted that the Board and FST Engineering have both stated the road construction was satisfactorily completed. Dave Kestner motioned to forward the Planning Board’s recommendation of acceptance for Labrador Road, 2nd Jim Horgan. Motion carried with all in favor.
Mr. Szirbik asked how long he would have to have the bond in place if the road is accepted by the town. Kathy explained that she posed this question to town counsel and Laura Spector’s response was that the bond would be in place for five years after the final acceptance of the road which would have been in November of 2010 for this road.
At 6:55pm, Jim Horgan motioned to adjourn, 2nd Glen Demers. Motion carried.
