Board Members Present:  Paul Parker, Charlie Doke, Cindy Snowdon, Glen Demers, Dave Kestner and Jim Horgan (arrived at 6:17pm)

Selectmen’s Representative:     Charlie King
Town Staff Present:             Director of Planning and Community Development Kathy Menici and Code Enforcement Officer Dennis Roseberry
Public Present:                 Neil Johnson, Keith Frisbee, Mr. Zielfelder and David Vincent
At 6:05pm, Chairman Paul Parker opened the meeting.

BUSINESS BEFORE THE BOARD:
  • Review of Minutes
  • Charlie King motioned to table the minutes of 8-3-10, 2nd Charlie Doke.  Motion carried with all in favor.
  • Charlie Doke motioned to accept the minutes of 8-17-10 as amended, 2nd Charlie King.  Motion carried with Cindy Snowdon abstaining.
  • Paul seated Jim Horgan in the vacant seat.
  • Jim Horgan motioned to approve the minutes of 8-3-10 as presented, 2nd Cindy Snowdon.  Motion carried with Charlie King, Glen Demers, and Dave Kestner abstaining because they were absent.
  • Other Business Before the Board
  • Kathy informed the Board that Elaine put together a draft schedule for the Board’s meetings in 2011 for the Board to review.
  • Paul noted that November 2 is a primary election date and he questioned if the Board wanted to change the date of this meeting though it is not required.  Dave Kestner motioned to change the November 2, 2010 meeting to November 3, 2010, 2nd Glen Demers.  Motion carried with all in favor.
  • Paul reminded the Board members that the Office of Energy and Planning (OEP) Fall Conference is coming up next month and if anyone is interested they should contact Elaine.
At 6:19pm, Charlie King motioned for a recess until 6:30pm, 2nd Dave Kestner.  Motion carried with all in favor.

At 6:33pm, Paul reconvened the meeting and announced the Planning Board has one full time position open, as well as, two alternate positions.  Anyone who is interested should come down to the Municipal Offices and fill out an application.

CONTINUED CASES:
  • Compliance Hearing for Energy Resource Group, Inc (ERG) –
Keith Frisbee supplied the Board with a survey of the ERG property and a preliminary site storage plan.  Kathy asked if Conservation Commission were able to put the markings up and Jim Horgan replied that the Commission went up and put up the green conservation tags on the stakes that were installed.  Kathy stated that tonight’s meeting is for a compliance hearing that was continued from a previous meeting and the information tonight is an update on where ERG is on their amended site plan.  The next step is for the applicant to apply for amended site plan review and once the Board is supplied with the formal application they can schedule a site walk.  The applicants welcomed all members to the site at their convenience.

 Jim Horgan motioned to continue the compliance hearing for Energy Resource Group to November 16, 2010, 2nd Cindy Snowdon.  Motion carried with all in favor.

  • Application for Major Site Plan Approval By: Catherine Natale (Tax Map R29, Lot 12-4): To allow for a 576 sq. ft. structure to house a small scale retail store.  In the Agricultural Residential (AR) Zoning District.  Parcel is located at 576 Ten Rod Road.
Ms. Natale requested a continuation in writing.  Jim Horgan motioned to continue the application for a major site plan approval by Catherine Natale to October 19, 2010, 2nd Glen Demers.  Motion carried with all in favor.

  • Governors Road Subdivision – Review of As-Builts:
The applicant requested a continuation in order to complete the final ditch and shoulder work and will be doing core samples within the week.  Kathy informed the Board that she spoke with Kevin Gagne of FST Engineering and he stated if the Board continued this application he would have ample time to supply the Board with a complete review.  

Jim Horgan motioned to continue the Governors Road Subdivision review to October 19, 2010, 2nd Glen Demers.  Motion carried with all in favor.



NEW CASES:

  • Application for Minor Subdivision Approval By: Zielfelder Compound, LLC (Tax Map R 25, Lot 004): To create a 20-acre single family building lot from the 398 acre parcel.  In the Agricultural Residential (AR) Zoning District.  The parcel is located on Meaderboro Road.
Charlie King recused himself from the application.
David Vincent explained the application is to create a 20 acre building lot to construct a three bedroom home on the parcel otherwise known as the Conley Farm on Meaderboro Road.  The complete parcel is 398 acres and the applicant has provided a survey of the lot that is subdivided.  The conducted test pits and this data is included on the plans.  They have also submitted an approved septic plan for a three bedroom home; the plan was approved in September of 2010.  They are requesting a waiver from surveying the complete 400 acres and from supplying topography for the entire lot.  
Paul asked what the total length of the road frontage is and Mr. Vincent replied it is 1453 feet.  Paul asked Kathy how this application is considered a minor subdivision because both lots can be further subdivided.  Mr. Zielfelder, who is the owner of the 398 acres, stated that he has no plan to further subdivide the property and would prefer that the 20 acre parcel not be subdivided any further as well.  Kathy stated that a note would have to be placed on both lot plans that they cannot be further subdivided as a minor subdivision.
Dave stated that the plan needs to show the easement that goes across the property.  Also, Paul stated that the Board would want to see the topography on the entire 20 acre parcel.  The applicant will have further discussions with the larger parcel owner to ensure that they would like to move forward with a minor subdivision.  Kathy asked the Board if they are willing to accept the topography on the 20 acre parcel where the home is to be built only and Paul and Cindy both noted they would like to see some additional topography.  Dave noted that the applicant has provided topography to show the 40,000 contiguous uplands and he does not feel the application should have to provide any further topography.  Mr. Vincent stated that a wetland scientist has provided a memo stating that there are no wetlands on the 20 acre parcel.  The Board came to consensus that what was supplied would be sufficient if the application stays as a minor subdivision.
Kathy added that the applicant asked for a waiver from supplying the town with a digitized copy of the plan and she is not sure this would be a good idea.  Mr. Vincent stated that he can provide a digitized copy of the plan but what he was referring to was the GIS mapping of the lot.
Jim Horgan motioned to credit the application fee if the applicant decides to change the application to a major subdivision, 2nd Charlie Doke.  Motion carried with all in favor.
Jim Horgan motioned to continue the application for a minor subdivision by Zielfelder Compound, LLC to October 19, 2010, 2nd Glen Demers.  Motion carried with all in favor.
At 7:38pm, Dave Kestner motioned to adjourn, 2nd Glen Demers.  Motion carried.
