PLANNING BOARD WORKSHOP MEETING MINUTES
TUESDAY – JANUARY 17, 2006

Chairman King called the meeting to order at 6:12 p.m. review the agenda items;

Continuation of Discussion on Farmington Ridge Limited Partnership (Tax Map R47, Lot #5):
Access and Traffic Analysis Report.

Chairman King turns the floor over to Paul Esswein to begin discussion; Paul Esswein reviews some discussion from last meeting and advises the board members that this meeting was to develop questions from the members of the board that will be presented to the road engineer (Don Rhodes – Norway Plains) for his review and comments to be presented at the 02-07-2006 Planning Board Meeting when Farmington Ridge Limited Partners returns for their continued hearing.

Chairman King addresses the members of the public that are in attendance advising them the this is not a continuation of their application, it is a continuation of review for the members of the board and that no public input / comment will be taken as the applicant is not here for rebuttal.

Paul Esswein reviews the traffic study and he believes that it reflects what the applicant has addressed in the previous meeting; he further advises the board that he took it upon himself to contact S. R. P. C. regarding their traffic studies for the same area(s) and for the same/similar times.

Chairman King asks Paul Esswein if he found that S. R. P. C. is consistent with the findings of Norway Plains Engineers’ traffic studies? Paul Esswein – Yes.

Paul Esswein and Chairman King have discussion regarding the peak hours as documented in the traffic study.  Jim Horgan makes an inquiry about the contents of the traffic study on Page 6.  He also questions Page 1 where he states looks like 5 trips per household are referenced.  Chairman King relies; actually they used 4.0; and refer to page 9 for details on the trip generations for Mobile Home Parks, which equals ½ of what it is for single-family homes.  Jim Horgan comments there are 60 single family homes that run between Elm Street and Farmington Ridge.

Chairman King mentions that Don Rhodes – Engineer for Norway Plains had indicated sewer and water usage is calculated for double wide, 3-bedrooms homes.

Jim Horgan refers to Page 1 at the bottom, where traffic count as trips, but on Page 12 in the 1st paragraph refers to vehicle count; questions trip and vehicles count similar; Paul Esswein replies same as trips.

Chairman King brings up Sky View Drive having full-time access to Dick Dame Lane, and will now have more than the 750-trip count as indicated in the traffic analysis and that will put Dick Dame Lane over the limit.

Chairman King refers to Page 11 – site conditions mentioned and to Page 13 – recommendation to Dick Dame Lane.

Chairman King asks Paul Esswein if he has any thoughts; Paul Esswein – I have a couple of questions which he has just developed from listening to this discussion which he will pose those questions to Don Rhodes – Norway Plains Road Engineer. He will ask the engineer to utilize the S. R. P. C. study to validate the peak hours and expected daily times against their (Norway Plains) traffic study.  Jim Horgan asks if there is a cost associated with the research, Paul Esswein – yes and the applicant will bear the costs.

Jim Horgan brings up Bunker Street, Winter Street and Sky View Drive accesses; if Dick Dame Lane is used as access to the Mobile Home Park and volume is increased he feels that safety will be a real issue with such a volume increase.

Chairman King states that he drove the roads in and around the Mobile Home Park this evening and has reviewed his findings with Paul Esswein and shares those with the members of the board, primarily indicating that the additional traffic will be an overburden to Dick Dame Lane and would like the applicant to consider Bunker Street or Sycamore Blvd., for traffic flow when the Mobile Home Park expansion is complete.

Paul Parker questions if one subdivision can empty out onto another subdivision to empty out onto a public road.  Discussion continues about this and ideas discussed if this would be a viable solution.

Chairman King asks Paul Esswein if Sky View Drive would be a viable solution; Paul Esswein replies that he has developed some questions that he will present to Norway Plains Road Engineer – Don Rhodes; (1) can Sky View Drive safely handle excess traffic; (2) is it even logical or reasonable to consider; (3) would Bunker Street be an alternative; (4) if Sky View Drive not avail, Dick Dame Lane will then become over-burdened; (4) how do the existing conditions of the road (Dick Dame Lane) handled, not addressed in their study.

Paul Esswein and Chairman King entertain discussion about potential improvements that might be made.  Paul Esswein feels this is premature at this time and until he knows where this traffic will be exiting he cannot respond, he further advises that the Town of Farmington now has a Public Works Director (Joel Moulton) whom he will be meeting with on this subject.

Chairman King asks – based on 35 units as proposed, is there currently the potential in the future to build an expansion in relation to the additional parcel; Paul Esswein notes that it could only be single family dwellings, due to the proposed Zoning Ordinance change that is going before the Town of Farmington Meeting, “No further expansion of Mobile Home Parks” allowed.

Hiram Watson questions the amount of acres that are left? Chairman King turns to Paul Esswein for answer; there are 30 acres available in a 1-acre zone; Chairman King comments that there are also a lot of wetlands in that area.

Paul Parker makes a comment that he has heard about a 5-lot subdivision going on in Milton that abuts a corner of land in the Town of Farmington and the potential of this being a Regional Impact as this subdivision is also being developed by the same group of partners that are developing the Mobile Home Park.  Paul Esswein clarifies what a Regional Impact is.

Chairman King asks Paul Esswein if we have the ability to ask for off-site improvements; response is yes we do.

Chairman King states that he would like to see the list of questions being developed by Paul Esswein prior to him sending out to the Engineering Firm of L C Engineering, c/o of Lou Caron.

Jim Horgan motions to authorize Paul Esswein to generate a list of questions and to send these questions to L C Engineering for review and comment, 2nd Chairman King, no further discussion, all those in favor, motion passes.

7:06 p.m.

Chairman King seats Jason Lauze for absent Don MacVane.

Chairman King thanks the public for their attendance and is sure that he will see them back here at the next Planning Board Meeting of 02-07-2006.

7:08 p.m.

Chairman King calls for a 5-minute recess, 2nd Jason Lauze, no further discussion, all those in favor, motion passes.

7:26 p.m.

Chairman King reconvenes the meeting and opens the discussion to the proposed changes to the Zoning Ordinance that the board would like to put in front of the voters for the March 2006 Town Meeting.

Chairman King asks Paul Esswein if this has been noticed properly, Paul Esswein advises that it has been noticed for a public hearing on 01-24-2006 and 02-07-2006.  Paul Esswein clarifies that this is a continuation of our review from the last meeting.  Chairman King reviews dates of posting requirements and that any applications that come before the Planning Board after that might not be available, more or less the applicant would be applying at their own risk.

Paul Esswein does have a items for discussion:  Section 3.10 of the proposed standards listed on page 46 to add verbiage “Road and Driveway Regulation, Design and Construction Standards” after text “set forth in the Farmington Subdivision Regulations”.  

Chairman King motions to add this verbiage, 2nd Jim Horgan, no further comments, all those in favor, motion passes.

Paul Esswein continues; On page 58 (B) Applicability – since I am the interpreter of this ordinance, I would like some discussion on this; I would like and suggest renaming the reference “steep slope area” to “additional development standards” or to limit the language to only include steep slopes; no all encompasses as this paragraph defines.

Chairman King asks Paul Esswein what his interpretation is; Paul Esswein basically dealing with steep slopes.

Paul Parker suggests renaming and change to “additional development standards”.

Chairman King suggests renaming and change to “sensitive development area”. Paul Parker does not have a problem with the suggested change by Chairman King, but thinks “additional” is a better term.  Jim Horgan makes a suggestion to use the word “unique”.

Chairman King motions to change 3.12 (B) Applicability – to “sensitive area development standard”, 2nd Jason Lauze, no further discussion, all those in favor, motion passes.

Paul Esswein continues; on page 59; paragraph (4) change the word “provisional” to “waiver of municipal responsibility”.

Paul Parker motions to accept the suggested change, 2nd Jim Horgan, no further discussion, all those in favor, motion passes.

Paul Esswein continues; still on page 59; paragraph 6; reference number (3) should be changed to (4).

Paul Esswein continues; Page 64 (B) Definitions (1); Only makes reference to the IBC 2000 when in fact we also use the IRC 2000; The IBC covers 3 or more structures including commercial and the IBC covers 2 or less residential homes, would like the IRC 2000 added.

Chairman King motions to accept the addition of the IRC 2000, 2nd Paul Parker, discussion; suggestion is made to all add “as may be amended or superceded”; Chairman King accepts friendly amendment, 2nd Paul Parker, no further discussion, all those in favor, motion passes.

Paul Esswein – also under the same Definitions, paragraph (4) to include the same wording structure as described above.

Chairman King motions to make the similar change to paragraph (4), 2nd Paul Parker, no further discussion, all those in favor, motion passes.

Paul Esswein continues; Page 91, paragraph (F) Administration and Enforcement – the wording “conditional cases” these words appear nowhere else in the Zoning Ordinance and asks the members of the board if this wording is prevalent. Chairman King and Paul Esswein both concur that S.E. should be used; Paul Esswein has re-written this first sentence and reads this to the members of the board.

Jim Horgan motions to accept the re-written content of this paragraph, 2nd Jason Lauze, no further discussion, all those in favor, motion passes.

Paul Esswein advises that he has various references that need correction;

Page 94; Paragraph (B) Section 1.01 should be 1.14
Page 95; Paragraph (E) 1. Section 4.03(J) should also be referenced in paragraph 2. and 3. below
Page 96; Paragraph (G) 2. should be 4.03 (H)3 and delete 4.03(J) and 4.03(K)
Page 97; Paragraph (I) 1.6.1.h delete and replace with the word “below”
Page 98; Paragraph (J) 4th bullet should be 4.03(I)
Page 98; Paragraph (J) 5th bullet 4.03(K) should be 4.03(M)
Page 100; Paragraph 3. (b) the word full should be “fully”

Paul Esswein also advises that all the bulleted areas he would like to have numbered.

Chairman King motions to approve previous pages 91 – 100 as listed / identified by Paul Esswein encompassed changes, 2nd Jim Horgan, no further discussion, all those in favor, motion passes.

Paul Esswein continues with his suggested changes;

Page 96; Paragraph (F) 1. Would like the whole paragraph changed as RSA 482-A has been amended, no longer classified as prime wetlands.

The members of the board have a detailed discussion about Class I wetlands.

Page 96; Paragraph (F) 2. 4.03(E)(3) change to 4.03(E)(2)

Chairman King asks Jim Horgan as Conservation Commission Member his thoughts, Jim Horgan agrees with Paul Esswein.

Jim Horgan motions to make the changes as presented, 2nd Jason Lauze, discussion; Paul Parker questions K and E 2; Paul Esswein keeping K in there would be okay, Paul Parker makes a friendly amendment, 2nd Jason Lauze.

Page 96; Paragraph beginning “Each Class Two Wetland” to add the word “determined” after “until otherwise”;

Page 97; Paragraph 4. Paul Esswein suggests the deletion of reference to RSA 482-A; does not refer to prime wetlands.

Page 103; Paragraph 2 Special Use Permit reference should be 4.04(C)(3)

Hiram Watson interjects about the bulleted items being renumbered; he was advised that all bullets within the Zoning Ordinance Document would be renumbered.

Page 103; Paragraph (a) change to 4.04(c)(1) and Paragraph (b) change to 4.04(c)(4)

Chairman King motions to make 2 changes as noted by Paul Esswein, and to make 3 changes as noted by Paul Esswein on page 103; 2nd Jim Horgan, no further discussion, all those in favor, motion passes.

Page 102; Paragraph (B) 2. S. U. P. reference should reference 4.04(C)(2) and 4.04(C)(3).

Paul Esswein asks the members of the board if they would like to go through each page to insure that he has captured all the changes; comment(s) Yes.

Chairman King motions to renumber and re-bullet all the suggested changes throughout the document, 2nd Hiram Watson, no further discussion, all those in favor, motion passes.

Paul Esswein reviews items / definitions that were deleted from previous meeting; Paul Parker questions the deletions of the definitions as does Chairman King, Paul Parker would like to see those deleted items entered back into the Zoning Ordinance.

Paul Parker motions to add back in all of the previously deleted definitions, 2nd Chairman King, no further discussion, all those in favor, motion passes.

Chairman King motions to remove the word “then” from page 21 (1) (a); 2nd Jim Horgan, no further discussion, all those in favor, motion passes.

Jim Horgan motions to change back to PR on Page 23, under I Agricultural 2nd bullet; 2nd Jason Lauze, discussion, the members of the board have a lengthy discussion about this particular item, Chairman King motions to revert back to “P”, 2nd Jason Lauze, no further discussion, all those in favor, Jim Horgan opposed.

Chairman King motions to re-word section 3.01 (A) on Page 40 as suggested by Paul Esswein, 2nd Jason Lauze, no further discussion, all those in favor motion passes.

Paul Esswein discusses his plans to presents to the Zoning Ordinance for Warrant Article in various sections for ease of clarification of changes; i.e. grammatical, rear lot subdivision, T. O. P. U. and substantial changes.

Chairman King would like to present these changes and the Zoning Ordinance to the Selectman prior to the Town of Farmington Meeting; Paul Parker comments that he can guarantee two items of discussion from the Selectman, (1) re-discussion of density issue and (2) fencing.

Chairman King advises that he is willing to write a letter to the Selectman advising them of the upcoming Public Hearing on the suggested changes to the Zoning Ordinance and invite them to come to meeting for discussion purposes.
