The property owner of 31 Harding Avenue has requested a right of way (ROW) boundary line adjustment to correct a setback and frontage compliance issue. This request is similar to an order approved by the Town Council regarding property located at 30 Harding Avenue in March.
A recent survey has revealed that there are lot frontage and front setback issues related to the Town's lay out of the extension of Harding Avenue in 1968. Staff have met with the property owner and agree that the Town had a role in the creation of a lot with inadequate lot frontage and front setback. Staff recommend that the Council consider a ROW adjustment with the property to resolve the dimensional issues and reconfigure the Town right of way, with the Town reserving rights for access and maintenance. The conveyance would be for 404 square feet to the property owner and will resolve the frontage and front setback noncompliance.
