Subject:
Order to authorize the Town Manager to execute and accept deeds on behalf of the Town Council relating to property at 30 Harding Avenue.

ACTION: Council action is anticipated.
Summary:
Staff were approached by representatives of the property owner of 30 Harding Avenue when they discovered that the Town owned the right of way in front of the house.  A closer review revealed that there may also be issues with setbacks.  The owner had a survey done which revealed that there were frontage and front setback issues related to the Town's lay out of the extension of Harding Avenue in 1968.  Staff have met with the property owner's representatives several times and agree that the Town had a role in the creation of a lot with inadequate frontage and front setback.  Staff recommend that the Council consider a land swap with the property to resolve the dimensional issues and reconfigure the Town right of way to be more in keeping with current policy.

Attached is a plot plan detailing the proposed land swap and a memo from Town staff.
