Public Hearing on an amendment to the Coastal Waters Ordinance, Chapter 9 Article IV Section 9-94.c.3.

ACTION: No Council action is anticipated.
Summary:
This amendment will prohibit dinghies, canoes, kayaks and other small craft from being considered for a permanent mooring assignment. This is a navigational hazard.  

A letter of introduction and the initial ordinance amendment language are the first two documents attached. The Town Council, at its February 22, 2010 meeting, requested staff to work with the Town Attorney to develop language that would clarify some of the intent. The additional language will make it clear that persons with moorings in the anchorage may temporarily tie up their dinghy, kayak, canoe or other low profile vessel to their mooring so long as this vessel is not considered the primary vessel permitted to use the mooring, the primary vessel is off the mooring at the time, and the low profile vessel does not remain for longer than 7 consecutive days.  Tie up for longer periods would be allowed only with prior permission of the Harbormaster.

This new language may be offered as an amendment to the proposed ordinance language change and is attached as a separate document (CWOrdSmallVessels_031110REVISION.pdf).
