Pursuant to the agreement with Falmouth on the Green (FOG) homeowners, approved by the Council in August, an easement and bill of sale documents have been prepared and reviewed by the Town's attorney as a condition of the agreement. This action, if acceptable, conveys the private sewer system within FOG as well as the Winn Road sewer constructed by FOG to the Town. Several supporting documents are attached.
The Town attorney, Mr. Plouffe, has proposed the following Order for consideration.
"Be it ordered by the Town Council of the Town of Falmouth, Maine, in Town Council assembled:
That the Town accepts the Easement Deed and Bill of Sale from Falmouth on the Green Homeowners Association to the Town of Falmouth, dated September 15, 2009, and assumes the sewer system thereby conveyed as a public sewer; and
That the Town accepts the sewer system extension constructed by the Falmouth on the Green Homeowners Association within Winn Road pursuant to permission granted under Falmouth Code sec. 18-231 and hereby affirms the acceptance of such extension previously made by the Town Council and accomplished by virtue of Falmouth Code sec. 18-232." |
