Subject:
Order to authorize the Town Manager to execute the following agreements regarding Hat Trick Drive:

  • Public-Private Limited Development Agreement by and between the Town of Falmouth, Falmouth Plaza, LLC, Family Ice and Wal-Mart Real Estate Business Trust;
  • Easement Agreement by and between the Town of Falmouth, Falmouth Plaza, LLC and J.E.P., LLC;
  • Easement Agreement by and between the Town of Falmouth and Falmouth Plaza, LLC;
  • Mortgage Subordination Agreement by and between The Guardian Life Insurance Company of America, Falmouth Plaza, LLC and the Town of Falmouth; and
  • Agreement by and between the Town of Falmouth and Family Ice.   
ACTION: Council action is anticipated.
Summary:
These agreements are necessary to start and complete the construction of a new public easement/street linking Lunt Road to Clearwater Drive, such street to be located between Wal-Mart and Family Ice.

The Council previously approved all documents but based on new, lower than expected bid results, and a few other minor modifications, the Town Council will need to act on this matter.
