PLANNING COMMISSION MEETING MINUTES
May 28, 2013
EVENDALE MUNICIPAL BUILDING
The regularly scheduled meeting of the Evendale Planning Commission (EPC) was called to order by EPC Chairman (Council Representative) Doug Lohmeier at 6:00 PM on May 28, 2013. Attending were EPC members Chris Patterson and Mark Ferguson. Supporting the EPC were Jack Cameron (Assistant to the Mayor), James Jeffers (Village Engineer), Pam Morin (Building Department Clerk), James Dobrozsi (Architectural Review Board Member), and Ralph Terbrueggen (Landscape Architect,) and Kathy Farro (Legal Advisor).
Public Hearing:
1. Theresa Claypool, 4015 Glendale-Milford Road - Request for Conditional Use Permit submitted for a Type-A Family Daycare Home in the Residential District
There was no one present who wished to speak at the Public Hearing. A motion was made and seconded to close the Public Hearing. The motion passed 3-0.
New Business:
1. Theresa Claypool, 4015 Glendale-Milford Road - Conditional Use Permit for a Type-A Family Daycare Home in the Residential District
Theresa Hicks, resident, presented her application for a Conditional Use Permit for a Type-A Family Daycare Home in the Residential district. Ms. Hicks had previously spoken to EPC concerning this issue as part of the Zoning Code Review. At the time, Type-A Daycare in the Residential district was limited to 8 children. Since the Zoning Code Revision, Type-A Daycare in the Residential district is a conditional, not a permitted, use.
Ms. Hicks presented a sketch drawing of her planned improvements designed to bring her into compliance with the State of Ohio's statutes on Type-A Daycare. Ms. Hicks wants to install fencing starting on the east side of her home into the back yard, stopping 20' behind her home. The fence with then parallel the home along and inside the back property line before turning north to connect with the home by crossing the driveway. The fence will be screened by several shrubs along the front of the home, but nothing will protect the neighbors to the west. Fencing will include gates at the back door and the driveway to protect children as they enter and leave the premises. The design of the plan is to help guarantee at least 60 sf. of space per child. The applicant mentioned that she had discussed the plans with her neighbor and landlord, Rest
Haven Cemetary.
EPC members had a number of questions for Ms. Hicks. Mr. Lohmeier inquired as to whether the fencing would adjoin the property line or would be set back from it. In addition, he asked if the fence would have gating that could be closed to protect children at play during hours of operation. He also wanted to know the number of vehicles that could be anticipated during drop-off and pick-up hours and how long the facility would be open. Mr. Ferguson inquired as to the screening of the fencing as well as the intrusion into the neighbors' sightlines.
At the end of the conversation, a motion was made and seconded to approve her application for a Conditional Use Permit in the Residential district with the following conditions:
- The applicant must obtain a letter of consent from the State of Ohio.
- The applicant must obtain a letter of consent from her landlord, Rest Haven Cemetery, Inc.
- The applicant must install a gate or removable barrier across the driveway portion of the proposed fencing.
- The applicant must plant a staggered grouping of blue spruce along the northeast corner of the home to provide screening for the fence where it connects with the home.
- The applicant must ensure that during pick-up and drop-off times there are no more than two (2) cars parked in the driveway during any fifteen (15) minutes time frame.
- The applicant must obtain licensing from the State of Ohi for a Type-A Home Daycare facility.
The motion passed 3-0.
Old Business:
There was no Old Business before the EPC.

On a motion made and seconded, the meeting was adjourned at 7:20pm on a 3-0 vote.
The next regular meeting is scheduled for Tuesday, June 18, 2013 at 6:00 PM.
