PLANNING COMMISSION MEETING MINUTES
February 21, 2012
EVENDALE MUNICIPAL BUILDING
The regularly scheduled meeting of the Evendale Planning Commission (EPC) was called to order by EPC Chairman (Council Representative) Doug Lohmeier at 6:00 PM on February 21, 2012. Attending were EPC members Natasha Cavanaugh and Chris Patterson. Supporting the EPC were Jack Cameron (Assistant to the Mayor), James Jeffers (Village Engineer), Pam Morin (Building Department Clerk), James Dobrozsi (Architectural Review Board Member), Ralph Terbrueggen (Architectural Review Board Member), and Kathy Farro (Legal advisor to EPC).
Public Hearing:
1. A public hearing on consideration of a text amendment to the Village of Evendale Zoning Code Section 1272.04(f), establishing penalties for violations of the Zoning Code was held. Mrs. Dorothy Dover spoke, asking that the Village of Evendale be required to enforce the code upon its own officers and employees.
A motion was made by Ms. Cavanaugh, seconded by Mr. Patterson to close the public hearing. The motion passed 3-0.
New Business:
1. Kinetic Vision, 10255 Evendale Commons Drive – Site review for modifications to the parking area.
Kinetic Vision recently applied for and was granted a lot split to allow for the purchase of additional acreage to facilitate the growth of their building. The current parking lot allows for 37 employees and 7 customers, the proposed parking lot will allow for 67 employees and 7 customers. James Dobrozsi asked if additional lighting would be required for the south end of the parking lot. Two additional lights had been proposed but James identified an area where another light might be needed.
A motion was made by Mr. Patterson, seconded by Ms. Cavanaugh, to approve the application with the conditions that zoning stalls be reduced to 9’x 18’, that lot line would be reduced to 0’ and that both individual lots would be treated as one zoning lot for purposes of this application. The motion was approved 3-0
2. Village of Evendale, consideration of a text amendment to the Village of Evendale Zoning Code Section 1272.04(f), establishing penalties for violations of the Zoning Code.
There was a discussion concerning who would enforce the ordinance and what the correct penalties might be. After brief discussion, a motion was made by Mr. Patterson, seconded by Ms. Cavanaugh, to table the motion until the March meeting of the PC. The motion passed 3-0.
Old Business:
1. Chris Patterson continued to present the recommended draft amendments from the ZCoWG.
a. Review of previous sections.
i. Tim Burke has suggested that for the wording in the noise section to work most suitably, he suggested that the language be left as it is written in the current code. As such ZCoWG suggests that this recommendation be incorporated into the proposed draft amendment language for the OR district as well as all the GI districts (GI, ITC, IF-1, and IF-2.)
ii. A motion was made by Ms. Cavanaugh, seconded by Mr. Patterson to recommend the proposed draft amendment for the Residential district (R.) The motion passed 3-0.
iii. A motion was made by Ms. Cavanaugh, seconded by Mr. Patterson to recommend the proposed draft amendment for the Office Research district (OR.) The motion passed 3-0.
iv. A motion was made by Ms. Cavanaugh, seconded by Mr. Patterson to recommend the proposed draft amendment for the General Industrial (GI), Industrial Truck Center (ITC,) Industrial Flex -1 (IF-1,) and Industrial Flex -2 (IF-2) districts. The motion passed 3-0.
v. A motion was made by Ms. Cavanaugh, seconded by Mr. Patterson to recommend the proposed draft amendment for the Public Facilities district. The motion passed 3-0.
b. Review of new sections
i. The new Planned Unit Development (PUD) changes the way the current zoning code looks at planned development. Currently, planned development is taken as one single process which can be applied in different ways, from packaging multiple variances to changing uses. The proposed changes stipulate the process for each area of the Village from Commercial, to Office, to Industrial. In addition there is a new classification, PUD Mixed Use, which will allow a more flexible, customized approach to development west of I-75. This approach will allow developers to develop properties which tie in to the Comprehensive Master Plan but may have more diverse uses than would be allowed under one of the other PUD categories.
2. The meeting minutes from January 17, 2012 were reviewed. A motion was made by Mr. Patterson, seconded by Ms. Cavanaugh to approve the minutes without amendment. The motion passed 3-0.

On a motion made and seconded, the meeting was adjourned at 7:30 pm on a 3-0 vote.
The next regular meeting is scheduled for Tuesday, March 20, 2012 at 6:00 PM.
