The Village of Evendale
Regular Council Meeting
September 10th, 2013
The Village of Evendale Regular Council Meeting was called to order by Mayor Don Apking at 7:00pm.
Roll call- The following council members were present: Mayor Don Apking, Mr. Stiney Vonderhaar, Mr. John Ranz, Jr., Mr. Jeff Albrinck, Mr. Doug Lohmeier, and Mr. Chris Schaefer. Also present: Police Chief Niel Korte; Fire Chief, Mike Hauck; Village Solicitor, Tim Burke, Assistant to the Mayor, Jack Cameron, Recreation Director Dave Nichols and CFO Cynthia Caracci.
Mayor Apking presented the consent calendar. The motion to accept the amended consent calendar was made by Ms. Hartman, seconded by Mr. Schaefer and unanimously approved.
Committee Reports:
Police, Fire, Recreation Council Committee: Mr. Lohmeier stated that THE Fire Department will replace an ambulance in 2014.
Finance, Administration, Service, Engineering and GHF Committee:
Mr. Schaefer discussed the projections on the VOE having a tax holiday in the future. The council committee recommends not having a tax holiday because of the projections. In April of 2013, the VOE had over $700,000 in revenue that probably will not happen every year. Mrs. Carracci was asked to make the projections without the $700,000. Mr. Ranz challenged the projections that were provided. In the budgeting process, the estimated income tax receipts are always conservative. The projected unencumbered balance is $14,700,000 for the year end. Mr. Ranz feels that the increase in the earning tax shows the economy is improving but the projections reflect only a revenue of 12.4M in 2014. Council will continue to discuss this matter
Discussion on the tuition reimbursement took place. The ordinance needs to be reviewed to include the online programs.
Presentation of Ordinances and Resolutions:
The Mayor presented ORD. #13-31
ORDINANCE ESTABLISHING THE SALARY FOR MEMBERS OF EVENDALE VILLAGE COUNCIL. This is the 3rd reading.
Discussion: Ms. Candy Hart, resident of Evendale, addressed council expressing her objections on council considering on raising the salary of the Village of Evendale council members.
Ms. Hartman read to council the attached statement regarding the increase. Ms. Hartman asked the clerk to for her statement be made part of the minutes. Mr. Albrinck asked Ms. Hartman to correct the statement saying that he brought this matter to council. Mr. Schaefer stated that he was in agreement with Ms. Hartman and against the increase. A motion to delete part of the 1st WHEREAS “and have not be increased in eight years” was made by Mr. Lohmeier, seconded by Mr. Vonderhaar and unanimously approved.
A motion for the third readings of ORD. #13-31 was made by Mr. Lohmeier, seconded by Mr. Albrinck. The yea votes: Mr. Lohmeier, Mr. Albrinck and Mr. Ranz. Nay votes: Mr. Schaefer, Ms. Hartman and Mr. Vonderhaar. Mayor Apking broke the tie with a “yea” vote. ORD. #13-31 was passed.
The Mayor presented ORD. #13-34 ORDINANCE AMENDING SECTION 258.076, TUITION REFUND, AND DECLARING AN EMERGENCY. This will be tabled to go back to committee.
The Mayor presented ORD. # 13-48 APPROVING AN APPROPRIATION IN THE GENERAL FUND TO COVER ADDITIONAL SALARY EXPENSE IN THE POLICE DEPARTMENT AND DECLARING AN EMERGENCY.
A motion to read ORD #13-48 by title only was made by Mr. Albrinck , seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to suspend the second and third readings of ORD #13-48 was made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to agree to the emergency section is made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt ORD #13-48 was made by Mr. Schaefer, seconded by Mr. Albrinck and unanimously approved on roll call. Mayor Apking declared ORD #13-48 adopted as an emergency.
The Mayor presented ORD. #13-49 APPROVING AN ADDITIONAL APPROPRIATION IN THE EVENDALE COMMONS TIF FUND TO PAY ADDITIONAL 2013 TAX DUE AND DECLARING AN EMERGENCY.
A motion to read ORD #13- 49 by title only was made by Mr. Vonderhaar, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to suspend the second and third readings of ORD #13- 49 was made by Mr. Lohmeier, seconded by Mr. Schaefer and unanimously approved on roll call. A motion to agree to the emergency section is made by Mr. Schaefer, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt ORD #13- 49 was made by Mr. Lohmeier, seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared ORD #13- 49 adopted as an emergency.
The Mayor presented ORD. #13-50 APPROVING AN APPROPRIATION IN THE GENERAL FUND TO COVER THE COST OF A MAJOR AMBULANCE REPAIR NOT BUDGETED FOR IN THE FIRE DEPARTMENT AND DECLARING AN EMERGENCY. Discussion: The repair will take 2 weeks on #01.
A motion to read ORD #13-50 by title only was made by Mr. Vonderhaar, seconded by Ms. Lohmeier and unanimously approved on roll call. A motion to suspend the second and third readings of ORD #13-50 was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to agree to the emergency section is made by Mr. Schaeffer, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to adopt ORD #13-50 was made by Ms. Hartman, seconded by Mr. Lohmeier and unanimously approved on roll call. Mayor Apking declared ORD #13-50 adopted as an emergency.
The Mayor presented RES. #13-05 RESOLUTION AUTHORIZING THE MAYOR OF THE VILLAGE OF EVENDALE TO PREPARE AND SUBMIT AN APPLICATION TO PARTICIPATE IN OHIO PUBLIC WORKS COMMISSION STATE CAPITAL IMPROVEMENT AND/OR LOCAL TRANSPORTATION IMPROVEMENT PROGRAM(S) AND TO EXECUTE CONTRACTS AS REQUIRED. A motion to read ORD #13-41 by title only was made by Mr. Schaefer, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt ORD #13-41 was made by Mr. Lohmeier, seconded by Mr. Ranz and unanimously approved on roll call. Mayor Apking declared RES. #13-05 adopted as an emergency.
Mr. Lohmeier stated that he received some complaints on the south side of Wyscarver on the application of the asphalt.
Mr. Luther announced the Evendale Chamber Golf Outing. Candidate night will be at 7:00, October 9th at Raffels.
Mr. Vonderhaar stated that he has received complaints on the tardiness of the newsletter.
Sunflower festival is Oct 6th, 2014.
A motion to adjourn was made by Ms. Hartman and seconded by Mr. Albrinck and unanimously approved on roll call.
