Planning Board Present: Don Andersen (arrived at 5:40 pm), Michael Cole, Dan Coppelman, Tom Johnson, Howard Sandler
Planning Board Absent: Leslie-Ann Morse, Craig Nightingale, Richard Morello - Alternate, John Knox - Alternate
Staff Present: Sarah Raposa-Town Planner
Chairman Mike Cole opened the meeting of the Planning Board at 4:00 pm. He handed out a revised meeting protocol. Tom Johnson suggested that the "tracker" be explicit in the decision as a condition so that person has permission to go on the property after the decision is made. Town Planner to include draft condition in staff reports with other "standard conditions".
Report from Community Preservation Act Committee
Representative Howard Sandler updated the Planning Board on the activities of the Community Preservation Act Committee and the funds that are available. Discussion of the possibility of acquiring the old Tilcon plant as open space.
Recap of Recent Meetings
Don Andersen and Mike Cole went to the following meetings of the Chamber of Commerce to update them on happenings of the Planning Board and establish connections with the businesses in town, specifically on the Sign Code revisions and Future Needs: 11/4/09 (full Chamber meeting at Atlantic Oaks) and 11/17/09 (Board of Directors meeting at the Town Crier).
11/18/09 discussion with Board of Selectmen - heavy emphasis on the Sign Code
Sign Code
Discussion of grandfathering, lawful existence of signs, process of work committee and public hearings. Don Andersen updated the Board on a meeting (on 11/24/09) with Judy Cannon, John Knight, Randy Smith and Jorie Fleming.
Discussion of timeframe for public hearings for ATM 2010. Town Planner to put ATM items on the agenda for 12/16/09 to be voted out to the Selectmen. Must send articles to newspaper 5 weeks ahead of public hearing.

Town planner handed out existing definitions from the bylaw and Dan Coppelman handed out suggestions for discussion (see attached). Extensive discussion of the interconnectedness of accessory structures and setbacks, habitable space, site coverage concluding that the following clarifications will negate the need for amendments to the habitable space definition.
ACCESSORY BUILDING PROPERTY LINE SETBACK:
The distance to the adjoining property line shall be a minimum of 12' or the maximum height of the accessory structure, which ever is greater.
SITE COVERAGE:
The sum of the gross horizontal area of the floors of a dwelling used or intended to be used for living, sleeping, cooking or eating purposes, excluding cellar, attic farmer's porch and basement floor area not devoted to residential use, plus the square footage of any roofed permanent accessory structure or garage and screened porch or covered deck.
BUILDING, ACCESSORY:
A supplemental building or a portion of a main building, the use of which is incidental to that of the main or principal building, and which is located on the same lot therewith.
