Members Present:  Howard Sandler-Chairman, Kevin Holland-Vice Chairman, Leslie Ann Morse-Clerk, Debbie Abbott,  Michael Cole, Peter McDonald, Craig Nightingale, Tim Klink-Alternate and Frank Salomone-Alternate

Members Absent: All Present

Mr. Sandler (Chairman) called the meeting to order at 7:00 PM.

Lot Release Request - Definitive Subdivision
CASES PB#2004-12 & 13 - KAIT’S WAY SUBDIVISION- off Oak Leaf Road.

Chet Lay (Surveyor) presented an as-built plan and the request to release the last lot, Lot C, from the Covenant.  Mr. Lay noted that the turnouts had not been built as approved on plan and that the Applicant was prepared to provide $500 cash security.

A MOTION was made by Ms. Morse and seconded by  Mr. Holland to release Lot C from the Covenant, subject to submission of $500 cash security for turnouts to be constructed with one month, with security to be returned to the Applicant upon completion of the turnouts.   VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Nightingale and Morse


Mr. Klink and Mr. McDonald recused themselves from deliberating on Case PB#2004-07


Continued Hearing - Residential Site Plan Approval
CASE PB#2004-07 - WALTER & MARY MAKAR, 60 Pleasant Street, Berlin, MA 01503, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV to construct new two-story residential dwelling resulting in a Site Coverage Ratio exceeding 15% of the lot area for property located at 220 Pierce Road, Eastham, Map 04 Parcel 526.
CASE PB#2004-07 - WALTER & MARY MAKAR (continued)

Ben Zendher (Attorney) requested a continuance to July meeting.

A MOTION was made by Mr. Nightingale, seconded by Mr. Holland to continue hearing to July 14, 2004.  VOTE: Unanimous (6-0): Sandler, Abbott, Cole, Holland, Morse, and Nightingale.


Mr. Klink and Mr. McDonald rejoined the Board to deliberate on the remaining cases.


New Hearing - Residential Site Plan Approval
CASE PB#2004-13 - DENNIS IRISH, 36 Sever Street, Worcester, MA 01609, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to enlarge existing dwelling, add two-car garage with living area above and construct screen porch, resulting in Site Coverage exceeding 3,000 sq. ft. for property located at 25 Boreen Road, Eastham, Map 10 Parcel 163.

Jay Horowitz (Architect) presented an overview of the proposed project.  Ms. Morse questioned the placement of the garage.  The Chair asked for public comment on this case and there was none.

A MOTION was made by Mr. Nightingale and seconded by  Mr. Cole to Approve - Site Plan Approval-Residential for CASE PB#2004-13.  The Planning Board finds that the issuance of this Residential Site Plan Approval is consistent with the standards and criteria specified in Section XIV (E) of the Zoning By-Laws.  VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Nightingale and Morse


New Hearing - Residential Site Plan Approval
CASE PB#2004-14 - RENEE & STUART ROTHMAN, 60 Ober Road Newton, MA. 02459, requests Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV, to add screen porch, sunroom and stairway to an existing dwelling resulting in a Site Coverage Ratio exceeding 0.15 for property located at 14 Gile Road, Eastham, Map 07 Parcel 538.

Duane Landreth (Attorney) provided an overview of the project and recent building permits issued for the site.  Peter Fenn (119 Bay Road) spoke on behalf of the neighborhood and raised the following  concerns: largest house the area would get even larger, landscaping grade changes, and potential for increased nitrogen impacts. Jon Stankiewicz (16 Gile Road) expressed his concerns regarding the proposed upper deck impacting his privacy and opposition to the project as submitted.  The Board expressed its concerns with the proposed sunroom and lack of a landscape plan.  Attorney Landreth requested a continuance to develop a landscape plan.

A MOTION was made by Ms. Morse, seconded by Mr. McDonald to continue hearing to July 14, 2004 with plan to be submitted by July 8, 2004.  VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Nightingale and Morse


New Hearing - Residential Site Plan Approval
CASE PB#2004-15 - MICHAEL SARCIONE, 28 Dorothy Road, Millbury, MA 01527, requests Residential Site Plan Approval Under Eastham Zoning By-Laws Section XIV, to demolish existing structure and construct a new dwelling resulting in Site Coverage exceeding 3,000 sq. ft. for property located at 50 Ellen Drive, Eastham, Map 04 Parcel 346.

Jerry Tobin (Builder) presented an overview of the proposed project.  Roberta Strongen and Pat Roberts (40 Ellen Road) expressed concerns with the location of the garage, driveway and scale of the project.  The Board discussed the need for a landscape plan to screen the garage and driveway.

A MOTION was made by Mr. Nightingale, seconded by Mr. Cole to continue hearing to July 14, 2004 for a landscape plan to be submitted by July 8, 2004.  VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Nightingale and Morse


Waiver Request - Site Plan Approval - Special Permit:
CASE PB#2004-18 - KEVIN AND ELAINE CONLIN, 220 Bridge Road, Eastham, MA 02642, requests a Waiver from the Site Plan - Special Permit requirements under Eastham Zoning By-Laws Section XIII-D, to construct a two-story building containing inn amenities, sleeping quarters and office for property located at 220 Bridge Road, Eastham, Map 20 Parcel 062.

Kevin Conlin (Applicant) and Mike Murray (Builder) presented an overview of this request.  The Chair asked if there was any public comment on this request, and there was none.

A MOTION was made by Ms. Morse, seconded by Ms. Abbott to Approve Waiver of the requirements for Site Plan Approval - Special Permit to construct a two-story building containing inn amenities, sleeping quarters and office for property located at 220 Bridge Road, Eastham, Map 20 Parcel 062 upon the Condition:  bedroom be abandoned from existing cottage to become storage shed.  The Planning Board finds that the proposed alteration does not substantially change the site’s relationship with abutting properties and that an Application for Site Plan Approval - Special Permit is not required for the project as proposed. VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Morse, and Nightingale.

Other Business

40 Tomahawk
Matt Miller (Architect) representing the owners of 40 Tomahawk Trail came to speak to the Board  informally about a pending Residential Site Plan Approval filing as a result of a recent Conservation Commission hearing.  The Board agreed to Mr. McDonald representing the Board at an upcoming Conservation Commission site visit for coordination purposes.

Approval of Minutes
A MOTION was made by Ms. Morse, seconded by Mr. Holland to accept the minutes of the April 14, 2004 meeting as drafted.  VOTE: Unanimous (7-0): Sandler, Abbott, Cole, Holland, McDonald, Nightingale and Morse
