MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, JUNE 30, 2011,
3PM

Present: Dr. Lois Roth-Johnson, Pat LaRiviere, Dr. James Taylor, Dr. Martin Haspel, Beverly Knox, Jane Crowley, Susan Barker
Not Present:

I.      OPENING STATEMENTS

Jane Crowley reported on:
1.      Health Department is very busy with inspections.  Susan has inspected 62 Restaurants, 17 Pools, 20 Motel/Hotels and 132 Houses to date.
2.      Bathing Beach Quality is tested on Thursdays and the results are advised on Fridays.  Marine water is tested for Enterococci and Ponds are tested for E. Coli.  Two beach closures so far – Town Cove and Minister’s Pond – on Friday, June 24th.  Retesting is done whenever a risk test result is received and both of these beaches were reopened on June 25th.
3.      The wastewater management project is ongoing and Jane handed out the current proposed schedule which is very aggressive.  One point being worked on is the collaboration with Wellfleet regarding Wellfleet Harbor and the flow of water into Eastham.  The project is working with the DPW and Conservation regarding this situation.
4.      Jane recently attended 2 sessions that were very helpful and informative.  One was at the Mass Maritime where Peter Bristol spoke about Pharmaceutical Disposal.  Jane will bring this up at the next Workshop as Peter has offered to come to speak to the board.  The 2nd session was a marketing presentation on communication.  Jane will provide further information at the next workshop.
5.      Water Quality Project.  The response rate for the last mailing is 56% to date which is up from the previous mailing response rate of 48%.  The follow-up postcards worked to increase the response rate.  The next mailing being worked on is for Northern Eastham,  Jane is working with Gail in the Assessor’s office regarding maps for this mailing.
6.      Household Waste Disposal will be held on July 17th for Eastham and Orleans residents.
7.      Flu Clinics for this year will take a different approach as there has been a cut in the number of vaccines being sent to Eastham.  Jane is working with the VNA to hopefully set up clinics earlier and in the Nauset Regional High School for increased convenience.

II.     WINDMILL WEEKEND

Jane introduced Jean Roma, Director of the Cape Code Medical Reserve Corps (CCMRC).

Jean reviewed the history of the Board and advised that there are currently 432 volunteers on the Cape.  Jean joined the CCMRC in September 2009 at the height of the H1N1 and was charged with setting up the clinics to deliver vaccinations.  Jean did set up 70 clinics and in such a fashion as to save the government $62,000.

The Cape has shelters that are staffed by the CCMRC and these shelters have expanded to the state with a shelter that will house 5,000 people if needed.

Sun Safety is critical for the Cape as evidenced by the fact that the risk and incidence of melanoma is higher on the Cape.  The CCMRC has been setting up information booths on the beaches on the Cape and to attract attendance, Beach Balls were given to the young children that had sun safety facts noted on the ball.  T-Shrts with sun safety facts were given to teenagers and adjusts received lip balm and sunscreen.  Based on these booths, it was found that the young children were the most protected; wearing sunscreen, T-shirts and hats.  Teenagers skipped the hats and T-shirts but had the glasses and sunscreen.  However, the adults were not protected.

Another area the CCMRC is working on is teaching Choke Saving and CPR.  They have focused on those businesses that require permits to open and now moving into walking groups.

They have also set up a Jr. CCMRC program as many of the current members are aging and this will provide continuity as members leave the program.

The CCMRC is involved in many areas of the Cape, such as being present at Road Races as well as offering and conducting training to the various Towns.  Jean brought volunteer applications for anyone interested along with Preparation Bags for disasters.

Jane thanked Jean for all she has done in her role and for taking the time to meet with the Board of Health today.  Jean is an inspiration to Jane and all she works with.


III.    VARIANCE

1.      Kevin & Aileen Peters           330 Steele Rd           M-4     P-127

Matt Costa of Christopher Costa & Associates presented.  The plan has been redesigned as the original plan resulted in a high retaining wall that was close to the house.  The new plan meets all setbacks  and the waivers needed are:
1.      Soil Absorption System to Property Line from 10’ to 9.3’
2.      Soil Absorption System to Property Line         from 10’ to 1.5’
3.      Soil Absorption System to Crawl Space   from 10’ to 6.7’
4.      Soil Absorption System Size (24%)               from 446 sq. ft. to 340 sq. ft.
5.      Groundwater Separation Distance         from 5’ to 3’

A question was raised about the number of bedrooms with a requested remodel.  The remodel is to eliminate the current workshop and dining room.  The house would maintain 3 bedrooms.

Discussion around the use of the Recalculating Sand Filter took place.  Steve Korr, former MA DEP spoke as an expert for this type of innovative system and based on the testing he has seen, he recommends this approach.  Matt reviewed the safety factors of the system and the full plan with all.

Pat LaRiviere made the motion to accept as presented with the following conditions:
1.      Routine water quality test results be provided of existing well location to assure potability
2.      No increase in design flow be allowed (see proposed workshop detail and any other increase in habitable space)
3.      Secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use).  After 2 years period of time, reduction of testing could be requested to BOH by owner.  Effluent nitrate nitrogen not to exceed 19mg/1.
4.      Deed restriction for 3 Bedroom use and use of Omni Reticulation Sand filter alternative technology requirement to be recorded on deed.
5.      Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
6.      Any increase in habitable square footage would require Board of Health review and abutter notification
7.      Operation and maintenance agreement to be submitted to the EPOH.  Operation and maintenance agreement to be required for life of the system.  Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
8.      Require water tight test of septic tank and pump chamber.
Beverly Knox seconded the motion.

IV.       REVIEW

2.      Linda Warner            120 Hay Road                    M-18    P-295

Linda Warner explained that the Design Plan for the Septic System installed in 1990 cannot be found.   Ms. Warner contacted the previous owner who gave her the name of the builder, Tom Brady, and she called him to see if he had any files.  Tom Brady believes her built the Septic System but does not have any plans to confirm it.

Ms. Warner had an inspection done of the system and the report was that the system was in better than good condition.  The Real Estate Agent, Dee Higgins, passed out a copy of the letter from J.C. Ellis Design Company, Inc. regarding the inspection.

Jane explained that at the time of the sale of a property, an inspection is done and it is reviewed based on the plans on file.  The 1988 engineered plans on file were for a 2 Bedroom use.  In 1990 additional work was done on the system and a permit was obtained and the system was installed.  However, the plan submitted by Felco did not match what was on file.  Based on the discrepancy, a review by the Board of Health was required.

Jane stated that the house is a 2 Bedroom house on 20,000 sq. ft. lot and it functions hydraulically.  Based on this, Jane recommended that the plans we have on file are adequate regarding the “As Built” and Dr. Taylor agreed.

The assessor’s record shows the house as a 2 Bedroom, 2 Bath house.  But the plan shows the house as a 2 Bedroom, 1 Bath house.  Ms. Warner advised that the previous owner had added a small bathroom off the master bedroom.

Dr. James Taylor  made the motion to accept the As Built Plan as adequate for a 2 Bedroom Home.
Pat LaRiviere seconded the motion.

V.      MINUTES

The minutes of the April 28, 2011 and May 26, 2011 were approved and signed off on by Dr. Taylor.


VI.     CORRESPONDENCE/OTHER INFORMATION

Pond restoration project update - Jane advised that Liz Moran has put together an aggressive timeline for this fall and provided a handout of it for all.  Jane will keep us updated on progress.

Jane is working with IT to set up web links for the Board and to open communication to the public.  This will also help with information re Hazardous Waste Disposal.

Next workshop – Tuesday, July 19, 2011 at 9AM.

Jane advised that Sun Safety booths will be set up as follows if anyone is interested:
·       July 14th – 9:30AM to 2:30PM – Coast Guard Beach
·       August 11th – 9:30AM to 2:30PM – Nauset Light

Windmill Weekend – September 10, 2011 – who can cover?
·       Jean Roma can do 1 day
