BOARD OF HEALTH MEETING
THURSDAY, MARCH 25, 2010
3:00 P.M.
PRESENT: Dr. James Taylor, Chairman, Beverly Knox R.N.,B.S.

(Absent Dr. Lois Roth-Johnson)
The chairman opened the meeting at 3:05p.m.
I. OPENING STATEMENTS
Jane Crowley gave the monthly update:
A regional free flu clinic is tentative plan for May 5, 2020 from 3:00-7:00p.m.at the Orleans Council on Aging
Eastham Rabies Clinic will be held Saturday ,April 3, 2010 from 10am-12p.m
$10.00 fee for one year rabies vaccination for cats &dogs.With official proof of current vaccination, a three-year booster will be available
also for $10.00.
Wild life baiting funded by U.S.A. is plan May 3, 2010.
The Americorp members will help with the distribution.
Sue Barker sent out reminder cards to property owners on the importance of septic system maintenance.
II. VARIANCE
Joseph & Marie Clancy 385 Candlewood Dr. Map-12 Parcel-232
Matt Farrell (J.M. O’Reilly Assosciates, Inc.) submitted a plan to upgrade the septic system. The variances requested include:
Local Upgrade Approvals -310 CMR 15.00 & Eastham Board of Health Regulations
Soil Absorption System not 10' from south property line - 5' held - 5' variance requested
Soil Absorption System not 3' below grade: -5' held -2' variance requested
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
No increase in flow allowed
Deed restriction for 3 bedrooms
Proposed well to be tested for VOC and Routine parameters
Any increase in square footage would require BOH review and abutter notification
Pat Lariviere made the motion to approve the plan with the 4 conditions.
Beverly Knox seconded the motion .

III. PRESENTATION - NSTAR - AMIE VOS - Americorp
NStar has converted its transmission right of ways (ROWs) from a strictly mechanical maintenance program to an Integrated Vegetation Management Program (IVM) based on 3-5 year selective herbicide application and where appropriate mechanical treatment cycle.Amie Vos Americorp volunteer explained the project she, Sue Barker and the Cape Cod commission has been conducting:
Identify properties abutting Nstar Right of Ways.
Go through property plans to locate where the well heads are on the property.
Go out into the field using a GPS to plot the locations of the well heads
Work with the Cape Cod Commission on creating maps of all the well locations.
Amie also lists the proposed herbicides that Nstar might use.
Representatives from NStar, Mr. Hayes, Senior Arborist and David Polson, Construction Manager were present to answer questions about the yearly plan.
Sandy Bayne a property owner at 315 Herring Brook Road read a letter which she had sent to Mr.Scott Soares,Agricultural Commissioner. The letter expressed her concerns with NStar Vegetation Management Plan. The letter stated that the town of Eastham is in a very sensitive area and served by onsite private wells which should be protected. Sandy stated she was opposed to the use of herbicides.
The following residents where present and had concerns about the use of herbicides:
Catherine Richardson - 100 Armour Drive
Michael Kain - 415 Ireland Way
Claudia Michaelis - 90 Ireland Way
Maria Lamadrid - 75 Milbrode Ave
NStar representatives Mr. Hayes and Mr Polson answered questions about the plan and the herbicides to be used.
Jane Crowley the Health Agent was concern that the GPS used to find the wells was not precise enough and all the existing wells have not been found.
The Health Agent and the Board request NStar to delay spring/winter surface and foliage treatments for an additional period of one year. The Board also wanted more data about the herbicides that will be used.
IV. REVIEW
Maria Lamadrid 75 Milbrode Ave Map-7 Parcel-11
Maria Lamadrid submitted proposed remodeling plan. The proposed project will add a small loft with egress to add light and air to the structure.
The project was approved with the1 bedroom deed restriction already recorded at the registry of deeds.
Dr. James Taylor made the motion to approve the remodeling plan.
Beverly Knox seconded the motion.

V. REDUCTION REQUEST CONTINUED
Philip Brady 18 Boat Meadow Way Map-19 Parcel-11
The Board reviewed the request to reduce operation and maintenance on the system to semi-annual inspection and semi-annual effluent testing only. The Property is served by Clivus I/A with UV disinfection and recirculating sand filter. The Board approved your request, testing will be required in the months of June and September for PH, BOD,TSS. TN, Nitrate-Nitrogen not to exceed 19mg/1.
Pat Lariviere made the motion to approve reducing testing to the months of June and September.
Beverly Knox seconded the motion.

VI. PERMIT EXTENSION REQUEST
Diane Sundberg 85 Asa’s Rd. Map-4 Parcel-88
Mr.David Lajoie submitted a letter requesting an extension of provisional use approval for the Waterloo Biofilter Model UP-550 which will expire May 29, 2010 without a finding. The Board requests that the owner or representative on behalf of the owner come before them to state why another extension is necessary.
Beverly Knox made the motion to continue this request until the owner or representative explains why another extension is needed.
Pat Lariviere seconded the motion .
SO VOTED UNANIMOUSLY
VII. CORRESPONDENCE /OTHER INFORMATION
1. A letter was submitted to the Eastham Board of Selectmen
RE: Request for revised policy under Charter C5-2 (F) for the Board of Health meeting attendance.
2. A letter was sent to Mr. Michael McClean ,Director of Rights of Way Program /Pesticide Bureau -Department of Agriculture and
Mr Scott Soares, Agriculture Commissioner - Department of Agriculture Resources
RE: Requesting to delay the spring/winter cut surface and foliage treatments for an additional period of one year.
