EASTHAM BOARD OF HEALTH MEETING
THURSDAY, NOVEMBER 19, 2009
AT 3PM
PRESENT: Dr. Stanley Holt, Chairman, Dr. James Taylor, Co-Chairman, Dr. Lois Roth-Johnson, Beverly Knox, R.N., B.S., Pat Lariviere, R.N., Jane Crowley, M.S., R.S., Health Agent, Susan Barker, Assistant Health Agent
Dr. Holt opened the meeting at 3PM
I. OPENING STATEMENTS
Jane Crowley notified the Board of H1N1 updates. There continues to be a shortage of the vaccine, local Health Agents participate in weekly conference calls regarding issues and supply of the vaccine. Lower Cape Health Agents have pooled their supplies and a clinic is planned for Monday, November 23, 2009 which will target the Lower Cape population because distribution to this area has been low. The high risk population targeted for this clinic will be pregnant women, individuals caring for children under six months of age, and children under the age of nine. The Lower Cape Health Agents will be
working together for this clinic and will be aided by the Medical Reserve Corps, County per diem nurses, as well as the Visiting Nurses Association. A second H1N1 clinic will be schedule when vaccine becomes available.
Jane Crowley also updated the Board on seasonal flu vaccine. Due to the fact that distributors were instructed to produce H1N1, the production of seasonal flu vaccine was cut short. The seasonal flu clinic scheduled for November 12, 2009 was cancelled because the required number of doses of vaccine for that clinic was not received.
II. CONTIUED FROM OCTOBER 22, 2009

Mr. John O’Reilly of J.M. O’Reilly and Associates Inc presented revised plans dated 11/2/2009 to upgrade the septic system. Variances include:
1) SAS not 10’ from North Property Line
3’ held, 7’ variance requested
2) SAS not 10’ from East Property Line
8’ held, 2’ variance requested
3) SAS not 100’ from well on Parcel 301
50’ held, 50’ variance requested
4) SAS not 100’ from well on Parcel 303
69’ held, 31’ variance requested
5) SAS not 100’ from well on Parcel 304
91’ held, 9’ variance requested
Finding that the revised plan achieves maximum feasible compliance, the variances were approved with the following conditions:
1) Routine water quality test results be provided of existing well location to assure potability.
2) No increase in design flow be allowed.
3) Secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing quarterly (or 2 times per year for seasonal use) for nitrogen, BOD, TSS, Nitrate-nitrogen not to exceed 19 mg/L. After 2 year period of operation time reduction of testing could be requested to Eastham Board of Health by owner.
4) Any increase in habitable square footage would require Board of Health review and abutter notification.
5) Operation and maintenance agreement to be submitted to the Eastham Board of Health and the Barnstable County Department of Health and Environment. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department.
6) Deed restriction for 2 bedroom use and alternative technology requirement to be recorded on deed.
7) Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
8) Identify location of blower and consider noise reducing/remote venting.
9) Homeowner to test Parcel 301 well for potability prior to upgrade.
Pat Lariviere made the motion to approve the plans with the nine conditions.
Dr. James Taylor seconded the motion.

III. DEPARTMENT OF PUBLIC WORKS-RECYCLING
Neil Andres, Superintendent of the Eastham Public Works Department, by request of the Board, discussed the matter of recycling at the Eastham Transfer Station. The Board discussed that it has become apparent that items which should be recycled were being thrown in with garbage items. Mr. Andres responded that the staff often deals with windblown items and in turn throws those items into the garbage, he stated that he would reiterate the importance of putting items in the appropriate bins.
Mr. Andres stated that the town currently recycles approximately 37% of the total load. In 2015 the town’s contract will expire with SEAMASS at which point the price per ton will increase from $40/ton to $80/ton. Mr. Andres stated that the town produces approximately 3000 tons/year.
IV. DOGS AT DYER PRINCE BEACH
Gail Hoffman 80 Dyer Prince Rd Map-19 Parcel-100
Ms. Hoffman addressed the Board regarding the excessive number of dogs on Dyer Prince Beach. Ms. Hoffman asked the Board for their support in closing the beach to dogs, stating that this beach is the only in the area that permits dogs.
The Board addressed Ms. Hoffman’s concerns and decided that because this is a Board of Selectman policy the issue should be brought to their attention. The Board agreed to support efforts to make Dyer Prince Beach prohibited to dogs.
V. SEPTIC POLLUTION OF WELLS
Mr. Tom Johnson addressed the Board and supplied them with a document stating “The Reasons for Mandatory Pumping”. Mr. Johnson stated that there is a correlation between failed systems and adjacent well water analysis. Mr. Johnson urged the Board to consider a regulation to require homeowners to pump their septic systems every 3 to 5 years.
Dr. Holt, Chairman, asked Ms. Crowley, Health Agent about the possibility of a regulation making pumping mandatory. Ms. Crowley responded that she was not aware of any town on Cape Cod which requires pumping, this is because the needs of each system to be pumped every 3 to 5 years differs with each property based on use of that system. The Health Department tracks septic pumping through receipts received by Tri-Town and those receipts and manually entered into a database. Properties which have not pumped in more than 3 years are notified through a once a year mail out which advises them of the importance of septic
system maintenance.
VI. 2010 LICENSES TO BE SIGNED
Licenses for the upcoming 2010 year were evaluated and it was discovered that some establishments were no longer in business which were on the list. The Board decided to continue the approval of the licenses until the December 17, 2009 meeting.

2. Notice to abate violations of 105 CMR 410 State Sanitary Code II at property address 1475 State Highway.
3. Notice to abate violations of 105 CMR 410 State Sanitary Code II at property address 999 State Highway, Units 1 A, B, C, D, E, F, and Unit 2.
