MINUTES
BOARD OF HEALTH MEETING
THURSDAY, JULY 30,2009
3: p.m.

                 Pat Lariviere, R.N., Jane Crowley, M.S.,R.S. Health Agent
                  Susan Barker, Asst Health Agent
                  (Dr. Stan Holt, Chairman absent)

Dr. James Taylor, Co-Chairman opened the meeting at 3: p.m.


OPENING STATEMENTS:

        Dr. Taylor introduced  Dr. Lois Roth-Johnson the new member of the Board.

        Jane gave the monthly update:



Massachusetts Swine Flu report as of the weekly update on July 23 -
        1, 361 confirmed cases /5 deaths.  The Board received a copy of the  report.

The Household Hazardous Products day took place July 18, 2009 in Eastham. at the D.PW. It was very successful with 207 cars
September 19, 2009 Orleans will hold a Hazardous Product Day September 19, 2009 and will accept Eastham Residents products.

Nitrate program has also been successful a response of 67.5 %
1,620 vials were just  sent this July. The area covered is area 2 (Central Eastham)

Plans for the flu clinic for the High School should be submitted for the   
           September Agenda of the Educational School Board.

David Lajoie asked for a continuance for this project until the August 27, 2009
        Beverly Knox made the motion to approve the continuance request.
        Pat Lariviere seconded the motion.

Barbara & Ronald Snider  205 Herring Brook Rd.   Map-17  Parcel-489

Chris Wickson and Katelyn Merrill - Sidell submitted plans to upgrade the septic system.  The variance requested include:

Reduction to the Town of Eastham Board of Health Regulations


28'+/-to the 100' required setback for proposed soil absorption system to top fo coastal
        bank. (72'+/- setback proposed)

Dr. Taylor read a letter from the Conservation Commission concerning this project. The letter stated two alternative to the plan were presented by the abutters that the commission felt had some validity-moving the leach field to 85' from the resource instead of 75', or requiring a nitrogen-reducing component.

Mr. Skiba an abutter had questions about using denitrification for this project. in order to protect the marsh and also shallow wells nearby.

Dr. Taylor recommended pressure dosing be added to the system.  The members of the Board agreed with his recommendation.

Mr. Wickson asked for time to speak with Mr. Snider before a motion was made about this project. He returned to the meeting after speaking with the applicant and stated that the condition to add pressure dosing would be included on the plan.

Finding that the plan achieves maximum feasible compliance with no reductions to area wells, the variance was approved with the following conditions:


No increase in flow allowed
Deed restriction to 4 bedrooms
Existing well to be tested for routine parameters
Any increase to in habitable area would require abutter notification and BOH review
Pressure dosing to be added to the system.
Dr. Taylor made the motion to approve the plan with the 5 conditions.
Beverly Knox seconded the motion.

David & Jane Demeo      585 Campground road     Map-7 Parcel-336



Mr. Stephen Hass (Eagle Surveying,Inc.) presented revised plans dated
July  28, 2009 to upgrade the septic system which includes secondary treat with a Singulair 960 DN unit. The variances include:

Section 15.029 Construction of Wells Near Existing Systems - variance requested to install a well closer than the required setbacks
Section 15.211:(1) Minimum setback distances
10' is required between the SAS and the property line.  1' is provided  - 9' variance requested
20'  is required between the SAS and a cellar wall.  10' is provided - 10' variance requested
100' is required between SAS and a well.  82' is provided   to the locus well.  An 18' variance requested
100 ‘is required between the SAS and a well.  52' is provided to the well on
parcel 07-337.   A 48' variance requested.
10' is required between the septic tank (singulair) and the property line.  5' is provided.  A 5' variance requested..
Section 15.240; (4) soil absorption systems
The area of SAS is 51% of the required minimum.  A 49% variance requested

Town of Eastham Well Regulations
25' is required between the well and the street line.  4' is proposed . A 21' variance is requested
10' is required between the well and the property line .  4' is proposed .  A 6' variance is required.

Finding that the applicant has submitted plans with secondary treatment (Singulair 960DN unit)were approved with the following conditions:




Routine water quality test results be provided of exiting well location to assure potability
2.      No increase in design flow be allowed
3.      Secondary treatment and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by owner. Nitrate-nitrogen not to exceed 19m9/1.
4.      Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance agreement required for life of the system. Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.


Restriction for 3 bedroom use and use Singulair 960 DN unit alternative technology requirement to be recorded on the deed
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
Well variance form to be signed by the owner.
Pressure dosing to be added to the system as required by remedial approval.
Any increase in habitable square footage would require board of Health review.
Test for routine parameters on Map-7 Parcel-337 when installed and test again in 1 year.
Pat Lariviere made the motion to approve the plans with the 10 conditions.
Beverly Knox seconded the motion.

APPEAL



Michael & Michele O’Connell             25 Deerfield Rd Map-12 Parcel-149

Since the Health Department failed to notify Mr.& Mrs. Connell about this meeting, this appeal will be heard on Thursday August 27, 2009 Board of Health Meeting. The Health Department will inform the Connells about the meeting in August and also apologize for not notifying them about the July meeting.






REDUCTION IN TESTING

A request was submitted for the Board to reviewed the inspection reports, which included test results for 2007 and 2008. The Board reviewed the test results and the request for reduction of  testing for once a year. The board  recommends testing once a year in the month of September.
Pat Lariviere made the motion to approve yearly testing in the month of September.
Beverly Knox seconded the motion

REQUEST FOR PLAN APPROVAL



McShane Construction            62 Dory Lane    Map-8  Parcel-191 AP
  
Mr Dumont representing the McShane Construction Co. submitted a plan change  for a Half Cape with loft (previously approved as a Stonybrook Ranch).
Beverly Knox made the motion to approve the plan change.
Pat Lariviere seconded the motion.
