MINUTES
EASTHAM BOARD OF HEALTH
THURSDAY, May 28, 2009

The Chairman, Dr. Stan Holt opened the meeting at 3: p.m.


OPENING  STATEMENTS

Jane Crowley gave the monthly report.

1.      At the town meeting approval was voted for Article #17 municipal water supply system .  The first phase, addressed in this article, will establish the quality and quantity of water available for a municipal water supply from internal and external sources.  


Eastham Ponds Study Report - Public Presentation was Tuesday May 26 at
7: 00 p.m in the Town Hall.  Ed Eichner of (School of Marine Science & Technology) Umass, Dartmouth and Tom Cambereri Cape Cod Commissioin presented the results of the six year study of 9 Eastham Ponds.
Request for funding to support Model Flu Clinic Fall 2009 at Nauset Regional High to include the towns of Eastham , Brewster, Wellfleet, Truro and Orleans.
Volunteers will be needed for the flu clinic.  Jeanne Morello offered to bring some nurses to help with the proposed clinic.



VARIANCE

1.      Marjorie Douglas                25 Oquamoshod  Rd.              Map-4   Parcel-131

        Jason Ellis(Ellis Design Co, Inc) submitted plans to upgrade the septic system.         Dr. Taylor recommended the proposed well be moved a minimum of 5ft. north.

The Board supported the recommendation and requested that the plan submitted be revised to move the proposed well a minimum of  5 ft. north. The revised plans submitted May 29, 2009 results in the following variances:

Finding that the applicant has submitted plans with secondary treatment (Microfast 0.5 unit) with pressure dosing the plan was approved with the following conditions:
1.      Voc & Routine water quality test results be provided of proposed well location to assure potability
2.      No increase in design flow be allowed
3.      Secondary treatment with and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen BOD, TSS, Nitrate (or 2 times per year for seasonal use).  Nitrate-nitrogen not to exceed 19mg/1.  After 2 years period of time reduction of testing could be requested by owner.
4.      Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance agreement required for life of the system.  Operator to report results via Carmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department


Deed restriction for 2 bedroom use and use Microfast 0.5 unit alternative technology requirement to be recorded on deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
Any increase in habitable square footage would require abutter notification and Board of Health review.
Covers within 6 inches final grade.

Vent to be installed with charcoal filtration.  Blower location to be identified and mitigated for sound if possible.
Well test on (PLC.128) for routine parameters from original plan dated 4/28/09

Well variance form to be signed by the owner
Dr. Taylor made the motion to approve the revised plans to move the proposed well a minimum of 5ft. when submitted with the 12 conditions.
Pat Lariviere seconded the motion.

Thomas & Susan Nally            169 Sunset Ave          Map-19   Parcel-52

Stephanie Sequin (Ryder/Wilcox Engineering) submitted plans to upgrade the septic system. Variances requested include:


        Variances to-State Environmental Code Title 5, 310 CMR 15.211 (1)Soil absorption system to be 15.6' +-from cellar wall. (4.4'+-variance)
SAS to be 6'+- from side property line. (4+- variance)

Variances to-Eastham Board of Health Regulations Section I, C. Septage Disposal Regulations:
SAS to be 78'+- from top of coastal bank. (22'+-variance)

        Section II, E Well Location: #1. Minimum Distances
Well to be 4'+- from front property line /road layout . (21'+- variance)
Well to be 2'+- from side property line. (8' +- variance)

Finding that the plan achieves maximum feasible compliance the plan was approved with the following conditions


No increase in flow allowed.
Deed restriction to 3 bedrooms.
Proposed well to be tested for routine and VOC parameters.
Any increase in habitable space would require BOH review and abutter notification.
Well variance form to be signed by the owner.
Dr. Stan Holt made the motion to approve the plan with the five conditions.
Jeanne Morello seconded the motion.

PUBLIC HEARING APPEAL

3.      Beanstock Coffee Roasters       180 Brackett Road      Map-8   Parcel-188A
                
John Simonian and Jonathan Kelly requested to appear before the Board to responded to complaints concerning smells from roasting coffee beans.
Mr. Paul Benjamin an abutter to their establishment was present. He stated that the smell was so strong it was affecting his health.  Suggestions from the Board were to roast at night or install an extension pipe to vent the odor.
The Chairman of the Board stated he would visit the establishment when roasting is taking place. This appeal was tabled until the BOH meeting Thursday, June 25, 2009.

Jane Fischer a resident of Eastham addressed the Board concerning the use of fertilizers on lawns etc. The Board understood her concerns and recommended she contact the Water Resources Advisory Board - (Sandy Bayne or Karl Weiss)



OTHER BUSINESS



Draft Revised Regulations - would be advertise as a public hearing for June 25, 2009 BOH meeting.
