BOARD OF HEALTH MEETING
October 23, 2008

Susan Barker, Assistant Health Agent
The Chairman, asked Susan Barker to inquire at the Administration office for approval to proceed with the meeting without TV coverage. Approval was granted.
Chairman, Dr Stan Holt opened the meeting at 3:00 p.m.
OPENING STATEMENTS
Jane Crowley informed the Board that two flu clinics will be held at the Council on Aging on October 23 and November13, 2008 from 9-12 A.M.
Jane also told the Board that the Rabies baiting program would take place this year on November 3, 2008.
The Board was also informed that the Waste Water Management Planning
Committee and the Water Resource Advisory Board would be meeting with the
Board of Selectmen on November 5, 2008. This meeting will discuss Change
and Combine Charges.
VARIANCES
Daniel Elliott 100 Ellis Road Map-22 Parcel-13
Chris Wickson (East Cape Engineering) presented the proposed plan to upgrade the septic system. The following variances are requested::
Reduction requested Under Title 5
(310 CMR 15.405 contents of local upgrade approval)
5'+- to the 10' required setback for proposed soil absorption system to road property line
(5+- setback proposed)
10+- to the 20' required setback for proposed soil absorption system to foundation wall.
(10+- setback proposed)
Reduction requested to Town of Eastham Board of Health
24+- to the 100' required setback for proposed soil absorption system to top of coastal bank. (76'+- setback proposed)
Finding that the plan achieves maximum feasible compliance the plan was approved with the following conditions:
No increase in flow be allowed
Subject to Conservation Commission approval
Subject to Orleans Town Water hook up being approved by Orleans Water Department. Require approval from Eastham Plumbing Inspector to confirm the existing well is properly disconnected from the potable water supply private irrigation wells. The existing well when properly disconnected to be used strictly for irrigation as required by regulation to prevent cross contamination.
Subject to Assessing Department to determine accuracy of field data.
Dr Taylor made the motion to approve the plan with the 4 conditions.
Beverly Knox seconded the motion.

Estate of Adelaide Dietrich 175 Whelpley Road Map-2 Parcel-74
Laura Schofield (Schofield Brothers of Cape Cod) presented the plan to upgrade the septic system requesting the following variances:
Title V, the State Environmental Code
15.405(1)(a) Reduction between a property line and a leaching facility
10 feet required -5 feet minimum provided to parcel-75
15.405(1)(g) Reduction between a private water supply and a leaching facility
100 feet required -82 feet minimum provided to well serving parcel-82
Eastham Board of Health Septage Disposal Regulations
Section I (C)(4) - Reduction from setbacks from private water supply wells.
100 feet required - 63 feet minimum provided
Section I (C)(6) - Reduction of the s.a.s. setback from a vegetated wet land and /or
fresh water course.
Finding that the plan achieves maximum feasible compliance the plan was approved with the following conditions;
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under remedial use conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use) After 2 year period of time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l .
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
Deed restriction for 3 bedroom use and use Waterloo Biofilter System Alternative Technology requirement to be recorded on the deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
7. Subject to Conservation Commission approval - (Nov.10th)
8. Any increase in habitable square footage would require Board of Health review.
9. Require well testing on Map-2 Parcel 82
Pat Lariviere made the motion with the 9 conditions.
Jeanne Morello seconded the motion.

EXTENSION REQUEST
Clifford Swenson 1900 Herring Brook Rd. Map-10 Parcel-58
George Reilly (Land Design Associates) representing Mr. Swenson request
extension for a plan dated 3/11/06 and previously approved April 27, 2006.
Bob Sheldon the Real Estate Agent for this property also requested approval for an extension.
The Board approved a 6 months extension with these conditions:
Routine water quality test results be provided of existing well location to assure potability

Six month extension approval contingent on the buyer to submit floor plans for proposed dwelling which comply with Eastham Board of Health bedroom limitations subject to Eastham Board of Health approval.
(This extension will expire April 23, 2009)
Dr. Stan Holt made the motion to approve the extension with the 8 conditions.
Dr. James Taylor seconded the motion.

APPEAL TO HEALTH AGENT DECISION
Salt Air Cottages 450 Aspinet Road Map-5 Parcel-349
Mr. Michael Hanlon , Treasurer, Salt Air Condominium requested a variance from Title regulation (310CMR 15.226(3). The system is not in compliance with state regulations and will need to be upgraded to comply with current title 5 regulations.
Dr Stan Holt made the motion to deny this request.
Dr. James Taylor seconded the motion.

CORRESPONDENCE/OTHER INFORMATION
31 Martha Avenue Rear Map-10 Parcel-202
Stephanie Sequin (Ryder/Wilcox) requested that this project be withdrawn at this time. Ms. Sequin withdrew the plan and will request an amendment to condition #6 stated in the Board of Health Decision dated 4/29/2004 stating “no increase in square footage”. This project is subject to Conservation Commission approval.
VII. MINUTES
September 18, 2008 Approved
Dr. Holt requested an Executive Meeting be held at 2:30 November 20, 2008 to
review an amendment to condition #6.
The meeting was adjourned at 5 o’clock.
