MINUTES
BOARD OF HEALTH MEETING THURSDAY , NOVEMBER 29, 2007
3:P.M.



PRESENT:        PAUL LOTHROP,CHAIRMAN,  DR.STAN HOLT,  PAT LARVIERE,  BEVERLY KNOX,   JANE CROWLEY, HEALTH AGENT    (DR . JAMES TAYLOR ABSENT)


OPENING STATEMENT:

The Health Agent informed the Board that 300 people had requested a
       flu shot.  The flu clinic took place today and was a success. The next flu clinic will be held on Thursday, December 6, 2007.
Jane Crowley also updated the Board concerning the studies and documents accumulate from the town of Orleans and Eastham regarding water quailty conditions at Rock Harbor. The 3 years of sampling etc.would be presented to the Eastham selectmen at their work shop December 5, 2007 .

VARIANCES:



Lee Skoglund    830 Kingsbury Beach Road      Map-7   Parcel-159

Chris Wickson (East Cape Engineering) submitted plans to upgrade the septic system.  The variance requested is as follows:

Reductions Requested to Town of Eastham Board of Health Regulations
1.        24' +/-  the 25' required setback for proposed well to (2) road lines.
        (Well is proposed 1'+- from Kingsbury Beach Road and Old Field Lane)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:


No increase in flow allowed.
Deed restriction to 3 bedrooms.
Well to be tested for VOC and Routine parameters.
Well variance form reduction to street to be signed by home owner.

Comments from DPW and Board of Highway Surveyors requested for your consideration.
Dr. Stan Holt made the motion to approve the plan with the 5 conditions.
Beverly Knox seconded the motion.
SO VOTED UNANIMOUSLY




Robert & Gretchen Robinson      18 Asparagus Lane    Map-19 Parcel-36
        (Tabled until December 27, 2007)

Josie Kaufmann  140 Foxwood Drive       Map-18   Parcel-168

Jason Ellis presented plans to  upgrade the septic system.  The variance requested is as follows:

3' from proposed well to lot line (road layout)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1.       No increase in flow allowed
2.       Deed restriction to 3 bedrooms
3.       Well to be tested for VOC and Routine parameters
4.       Well variance to street form to be signed by homeowner
Pat Lariviere made the motion to approve the plan with the 4 conditions.
Beverly Knox seconded the motion.
SO VOTED UNANIMOUSLY



REVIEW:



Jason & Raquel Ellis    25 Brittany’s Way       Map-5   Parcel-129C
        ( Continued until septic plans are submitted )
An E-Mail from George Lee sent to the Health Agent was submitted stating his concerns about this project. Mr. Lee is an abutter.
Also submitted to the Board was a letter from Mr. George  O. King with his concerns about this project. Mr. King is also an abutter.
Maureen Dooley Lawrence an abutter spoke asking that any new plans submitted should be sent to her.



OIL TANK REQUEST:



Jenny Foster            80 Knowles Road          Map-12 Parcel-90


Jenny Foster the current owner of this property requested a variance to replace the oil tank. At the time the property was transferred Jenny Foster was not informed that replacement of single walled oil tanks was required if the tank is 10 years of age or older. The Eastham Board of Health granted the  request  for a one year extension to replace the oil tank.  This request was granted with the condition that the tank was made in the USA not Canada   Ms. Foster would call the Health Department with that information.

The meeting was adjourned at 3:45.
