MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY, SEPTEMBER 20, 2007 AT 3:P.M.

PRESENT:        Paul Lothrop,Chairman,  Pat Lariviere,  Dr. Stan Holt
                        Dr. James Taylor,  Jane Crowley,  Eastham Health Agent
                        (Berverly Knox - absent)


OPENING STATEMENTS:

Jane Crowley informed the Board that she had attended the Orleans Selectmen Meeting to discuss regional wastewater management infrastructure. The Town of Orleans has submitted an application for a grant to study economies of scale
with regard to regional wastewater management infrastructure. Orleans requested the Selectmen of Brewster and Eastham support their application.
       If the grant is awarded , the Town of Eastham will be an active participant in the project.
The Health Agent also updated the Board on the Rabies Baiting plan. Baiting will take place in November. Americorp members will distribute the bait.
An Americorp intern will be working in the Health Department starting in October 2007.          

        Jane also informed the Board that the Board of Selectmen will hold
        2 -  Work Sessions on Municipal Water System  - Sept. 26.2007 4:00p.m.  September  29. 2007 9:a.m.      
Eastham Special Town Meeting will be held  October 1, 2007 to decide if Eastham should establish a Town-wide public water system.

VARIANCE

        No variances this month.


REVIEW

1.      Hale            75 Bay View Drive       Map-13  Parcel-13

         David Lyttle requested a change of  technology from Advantex AX20 to     Singulair 960 NR under provisional use approval.


Finding that the applicant has submitted plans with Singulair 960 NR innovative alternative technology.   The Health Agent recommended that the Board of Health approve the plans with the following conditions:



Submit engineering plans with change in technology to include Singulair 960 NR technology


Routine water quality test results be provided of existing well location to assure potability
3.      No increase in design flow be allowed.


4.      Singulair 960 NR system be approved and monitoring under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). Nitrate-nitrogen not to exceed 19 mg/1. After  2 years time reduction of testing could be requested to BOH by the owner..


Operation and maintenance agreement to be submitted to Eastham Board of Health.  Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.


Deed restriction for 4 bedroom use and use of Singulair 960 NR alternative technology requirement to be recorded on deed.


Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
Subject to Conservation Commission approval.
9.      Any increase in habitable square footage would require Board of Health review.  


Dr.Stan Holt made the motion to approved the plans with the 9 conditions.
Pat Lariviere seconded the motion.

Kraemer         32 Bayberry Lane                Map-13     Parcel-13

David Lyttle  (Ryder/Wilcox) presented the plan to remodel the dwelling and add additional habitable space. Since this added habitable space is located on an environmentally sensitive lot 8,584 sq.ft. in size with 2 existing variances the building project is subject to Board of Health review. The Board disapproved the plan as presented and requested secondary treatment be added
         to the system.  
         Dr.Stan Holt made the motion to require secondary treatment be added to the    system.
        Dr. James Taylor seconded the motion.
        SO VOTED UNANIMOUSLY  


Eastham Inn             2470 State Highway         Map-15   Parcel-65

Mr. Laszlo S.Siegmund presented revised plans requesting a change of I/A Technology to a Singulair Model 960 NR. The Board denied the request because  modifications were made on the original plans submitted by East Cape Engineering. Inc. dated 6/2/2007. A letter from Timothy Brady (East Cape Engineering, Inc.) was submitted to the Board stating he cannot assume responsibility for information on any plan or document  beyond the scope of work shown on the original plan prepared by his office.
The Board requested that Siegmund Associates submit new plans showing complete engineering plans that include detailed calculations, elevations and technology.  In addition appropriate DEP-I/A approval must be submitted.  DEP approval and Barnstable County Health review will also be required.
Pat Lariviere made the motion that this project should be tabled until new     plans are submitted with detailed information calculations elevations and technology.
        Dr. Stan Holt seconded the motion.
        SO VOTED UNANIMOUSLY
