BOARD OF HEALTH MEETING
THURSDAY, JANUARY 25, 2007 AT 3: P.M.

The Chairman opened the meeting at 3:P.M.
OPENING STATEMENTS:
Jane Crowley updated the Board about plans to hold a work shop to explain the
the programs being worked on to move toward a municipal water supply. She asked the Board if it would be convenient to hold the work shop on Thursday February 15, 07 at 2: P.M. The 3 Board Members that were present approved that date.
VARIANCES:

John Schnaible presented the plan to update the septic system
The variances requested are :
310 CMR 15.00 (Title 5)
15.211 Minimum Setback Distances
Soil absorption system to private water supply well (100' distance required)
a) Proposed well to soil absorption system on Parcel 334 (abutter) - (13' variance requested)
Proposed well to soil absorption system on Parcel 333 (locus) - (10' variance requested)
Proposed well to soil absorption system on Parcel 331 (abutter) - (11' variance requested)

Regulation 2A
Well location
1) Septic leaching facility to well (100' distance required)
Proposed well to septic leaching facility on Parcel 334 (abutter)
(13' variance requested)
Proposed well to septic leaching facility on Parcel 333 (locus)
(10' variance requested)
Proposed well to septic leaching facility on Parcel 331 (abutter)
(11' variance requested)
Finding that the plan achieves maximum feasible compliance the Board of Health approve the proposed plan with these conditions:
1. No increase in flow allowed
2. Deed restriction to 3 bedrooms
3. Well to be tested 2 times a year( Spring & Fall) for nitrogen for 3 years.
4. Well disclaimer to be signed by owner
5. Well to be tested for VOC and Routine parameters
Footprint & shadow be frozen. Any increase in habitable space added would be subject to BOH review.
Joyce Gibson made the motion to approve the plan with the 6 conditions.
Dr. Taylor seconded the motion.

Colburn 290 Saltworks Road Map-4 Parcel-5A
Linda Pinto presented the plan to upgrade the septic system with Septitech Model M 400 secondary UV treatment. The variances requested are as follows:
Title 5 -310 CMR 15.000 and Local upgrade approvals 310.CMR 15.403
Title 5 -15.211 (Minimum Setback Distances)
1. Soil absorption system not 10' from property line:
6' held 4' variance
Town of Eastham Section 1C (Septage Disposal Regulations) No. 6
2. Soil absorption system not 100' from Coastal Bank
58' held 42' variance
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Septitech Model M400 and monitoring under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use) After this time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l .
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
Deed restriction for 3 bedroom use and use of Septitech M 400N Processor alternative technology requirement to be recorded on deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.
7. Subject to Conservation Commission approval
8. Any increase in habitable square footage would require Board of Health review
Dr. Taylor made the motion to approve the plan with the 8 conditions.
Joyce Gibson seconded the motion.

Stephanie Sequin presented the plan to upgrade the septic system using Microfast 0.5 Model secondary treatment. The variances requested are as follows:
The proposed soil absorption system is located approximately 5' from a property line.
5' variance from 310 CMR 15.211(1)
The proposed soil absorption system is located approximately 70' from coastal bank.
30'variance from SectionC.6 of the Eastham Board of Health Regulations
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
