TOWN OF EASTHAM BOARD OF HEALTH MEETING
THURSDAY, JUNE 29, 2006
PRESENT: Paul Lothrop, Chairman, Joyce Gibson, Pat Lariviere,
Stan Holt, Dr. James Taylor , Jane Crowley, Health Agent
Paul Lothrop called the meeting to order at 3:00 p.m.
OPENING STATEMENTS:
Jane Crowley informed the Board that the Hazardous Products Collections are a cooperative effort of the Town of Eastham and Orleans funded in part by Barnstable County. Hazardous Products Collections for Eastham and Orleans residents and taxpayers will be held 2 Saturdays -9am to 1 p.m.
July 15 - Eastham Natural Resources and DPW building

VARIANCES:
RE: Kane 18 Beach Plum Lane Map-13 Parcel-208
Mr. Farrell presented plans to upgrade the septic system with (Septitech processor model M400 ). The variances requested are as follows:
Local upgrade Approval : 310 CMR 15.00 & Eastham Board of Health Regulations
Variances: 310 CMR 15.211 (Setback) 310 CMR 15.405 (SAS Size)
1) Soil absorption system not 100' from private well (209) 72' held
28' variance requested
2) Soil absorption system not 100' from private well (Locus) 78' held
22' variance requested
3) Soil absorption system not 10' from north property line 6'held 4'variance requested
4) Soil absorption system not 10' from east property line 6' held 4' variance requested
5) Soil absorption system not designed at 100% capacity required for a 4 bedroom dwelling 79' held 21' variance requested
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under remedial use approval conditions per
DEP regulations including testing quarterly for total nitrogen, BOD, TSS,Nitrate (or 2 times per year for seasonal use) After this time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system.Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
Deed restriction for 4 bedroom use and Septitech processor model M400 alternative technology requirement to be to be recorded on the deed.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
7. Any increase in habitable square footage would require Board of Health review.

2. Healey 365 Harmes Way Map-1 Parcel-111
Tim Brady presented the plans to upgrade the septic system. The septic system. The system upgrade with septitech processor model M400n is allowed if provisional or piloting use is granted by DEP. The variances requested are as follows:
Reduction Requested to Town of Eastham Board of Health Regulations
21+- to the 100' required setback for proposed primary soil absorption system to edge of salt marsh (79' setback proposed)
41'+- to the 100' required setback for proposed reserve soil absorption system to edge of salt marsh (59' setback proposed)
100'+- to the 100' required setback for proposed soil absorption systems (primary and reserve) to landward toe of primary dune
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under provisional or piloting use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS,
Nitrate (or 2 times per year for seasonal use) After this time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19mg/l . Test for fecal coliform

Delia 40 Freeman Way Map -1 Parcel -72
Tim Brady presented the plan to upgrade the septic system. Since this is an environmentally sensitive lot the Board requested the applicant return with a plan requiring additional treatment to be added to the system.
Stan Holt made the motion to deny the submitted plan.
Joyce Gibson seconded the motion.

Eastham Inn 2470 State Highway Map-15 Parcel-165
Paul Lothrop recused himself from this review.
Tim Brady presented the plans for upgrade to the commercial motel and managers units which have a total flow of 4,070 gpd with Septi-Tech treatment. There are no local or Title 5 variances other than a 37% leach area reduction granted with remedial use approval and Zone 1 separation distance of 193 ft is required but can not be currently exists.
Finding that the plan achieves considerable environmental improvement and provides nitrogen reduction technology the Board approved the plan with the following conditions:
Condominium agreement should be provided that will detail ownership responsibilities related to operation and management of the septic system and shared facilities. The Health Agent recommend the Board of Health require escrow funds to cover operational costs and possible repairs that might become necessary. Town council shall review and approve such agreement prior to approval.

Jason Ellis submitted a plan with requests for alternative treatment to be added to the existing septic system so that an additional bedroom could be added. No variances are requested. The applicant has submitted the plan with Orenco Advantex AX20 alternative treatment under the provisions of Provisional use approval.
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under provisional use approval conditions per DEP testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use) After this time reduction of testing could be requested to BOH by owner. EXTENSION REQUEST
Edmounds 2 Nycoma Way Map-10 Parcel-322
Mr. Edmounds requested for an extension to upgrade his septic system. The Board on Thursday June 30, 2005 approved the plan to upgrade from cesspools to a Micro Fast system.
Dr. Taylor made the motion to grant a six month extension to upgrade the septic system.
Pat Lariviere seconded the motion.
THE VOTE WAS 5-0 FOR APPROVAL
