EASTHAM BOARD OF HEALTH
THURSDAY, FEBRUARY 23, 2006
3:P.M.


PRESENT:        Paul Lothrop, Chairman, Pat Lariviere, Joyce Gibson
Jane Crowley, Health Agent  
                         (Absent Stan Holt - Dr.  James Taylor)


        OPENING STATEMENTS

Jane Crowley updated the Board on the above ground tank education  program which the Americorp volunteer and Eastham Fire Department and Health Department presented to the towns of Brewster and Yarmouth.
        
A copy of the  letter from the Brewster Board of Health sent to Albertson’s Inc. and Stop and Shop supermarket company regarding the removal of all phosphate products from their shelves to protect our groundwater and ponds and lakes was submitted to the Board. The members of the Board  agreed to support this request but wanted to also include lawn care products. It was also noted that the town only had small stores not any large chains and these stores should be notify requesting phosphate products be removed from the shelves.
                  
                A letter was submitted to the Board that had been  sent to Ann & Alvin Roscoe at  875 Brackett Rd.  Map-9   Parcel-43 concerning violations 105 CMR 410 State Sanitary Code II. Jane told the Board that these violations were being corrected and once the work is completed a reinspection would be needed.
        
II.     1.      PUBLIC HEARING UNDERGROUND TANK REMOVAL

                John Haffa              50 Old Orchard Road      Map-8    Parcel-75
                        

                Mr. Haffa  requested an extension of 90 days to remove the
 underground oil tank.    Pat Lariviere made the motion to approve the 90 day extension.  Joyce Gibson seconded the motion .
THE VOTE WAS 3-0 FOR APPROVAL     (The extension will expire May  24, 2006)

                Maryanne Delconte       55 Maurice Road         Map-4 Parcel-386

Ms. Delconte requested an extension of 60 days to remove the underground  oil tank.     Joyce Gibson made the motion to approve the 60 day extension.  Pat Lariviere seconded the motion.
THE VOTE WAS 3-0 FOR APPROVAL   (The extension will expire April 24, 2006)
        
                


        MOTION FOR RESCIND OF PERMIT 2002-135  
                
                This motion was made by member Joyce Gibson
Upon the request of Attorney Benjamin Zehnder made at the December 29, 2005 meeting on behalf of his clients, beneficiaries of septic permit 2002-135 and corresponding variances granted January 31, 2002 related to 600 Campground Road Eastham,
Map-7 Parcel-317, I move to revoke and rescind permit 2002-135 and any and all variances granted relating thereto.”
                Pat Lariviere seconded the motion .    
                SO VOTED UNANIMOUSLY.



         SIGN MEMORANDUM OF UNDERSTANDING

The Board signed the memorandum of understanding -
                ( Infectious Disease Emergency)
This agreement is made and entered into between Town of Eastham   and the Nauset Regional School District  to coordinate communications, emergency preparedness, planning, response actions and the use of the building and facilities at the Nauset Regional High School  in event of an Infectious Disease Emergency.






        VARIANCES

3:15    1.      Prifty  17 Nycoma Way           Map-10     Parcel-328

                Chris Wickson presented plans to upgrade the septic system.
The variances requested are as follows:
                Reduction Requested Under Title 5:
                Section 15.405 : Contents of Local Upgrade Approval


4'+- to the 10' required setback for proposed soil absorption system to property line.


       5'+- to the 100' required setback for proposed soil absorption system to existing well serving parcel 319


25'+- to the 100' required setback for proposed soil absorption system to proposed  locus  well
                Reduction requested to Town of Eastham Board of Health  
                Section 5:


8'+- to the 100' requested setback for proposed soil absorption system to top of coastal bank

The applicant has submitted plans with secondary treatment with denitrification  using Septitech Processor. Finding that the plan phosphate products achieves maximum feasible compliance, and the aforementioned variances were approved with the following conditions:



Voc and routine water quality test results be provided of new well location to assure potability prior to approval
        2.      No increase in design flow be allowed
        3.      Secondary treatment and monitoring under remedial use approval conditions perDEP regulations including testing quarterly for total nitrogen, BOD, TSS,Nitrate (or 2 times per year for seasonal use) to meet minimum standard of 19mg nitrate nitrogen/l.  After this time reduction of testing  could be requested to BOH by owner


Operation and maintenance agreement to be submitted to Eastham Board of Health.  Operation and maintenance agreement to be required for life of the system.  Operator to report results via Carmody Data Base provided through   Barnstable County Health or directly to the Eastham Health Department if not available.
Deed restriction for 3 bedroom use and use alternative technology requirement to be recorded on the deed.
6.      Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
        7.       Well disclaimer form to be signed by the owner.


Subject to Conservation Commission approval
        9        Base line water test on parcel 319 for routine parameters
       10.      Footprint freeze on dwelling
Joyce Gibson made the motion to approve the plan with the 10 conditions.
Pat Lariviere seconded the motion.    THE VOTE WAS 3-0 FOR APPROVAL





Naugler        40 Milbrode Ave                 Map-7     Parcel-19


Emily Beebe presented the plan to upgrade the septic system.
       The variances requested :
        Eastham Board of Health Regulations   Section 2A - Part D
        1.     10' setback is required for well to sideline -1' is provided

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



       1.      No increase in flow allowed


Deed  restriction to 2 bedroom
Proposed well to be tested for VOC and Routine parameters
Owner to sign well variance form
PAT Lariviere made the motion to approve the plan with the 4 conditions.
Joyce seconded the motion.         THE VOTE WAS 3-0 FOR APPROVAL




Johnson 650 Campground Road             Map-7A   Parcel- 36

Judy Bersin presented the plan to upgrade the septic system The variances requested are as follows:

Town of Eastham Board of Health Private Well Regulations -Well Location


Proposed locus well shall be installed 12 feet from the roadway where 25 feet is required.  13 foot variance requested

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:



        1       No increase in flow allowed


Deed restriction to 3 bedrooms
Proposed well to be tested for VOC and routine parameters
Owner to sign well variance form
Joyce Gibson made the motion to approve the plan with the 4 conditions.

St.Aubin           245 Turnip Field Road                Map-7   Parcel-511
        
        Jason Ellis     presented plans to upgrade the septic system. The proposed
system includes secondary treatment with a Microfast 3.0 Unit and pressure dosed leach field.

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

Routine water and VOC quality test results be provided of existing  well location to assure potability


        No increase in design flow be allowed


        3.      Secondary treatment and monitoring under general use approval conditions perDEP regulations including testing quarterly for total nitrogen, BOD, TSS,
Nitrate (or 2 times per year for seasonal use)  After this time reduction of testing  could be requested to BOH by owner to meet minimum standard of 19mg/l nitrate nitrogen per liter.


4.      Operation and maintenance agreement to be submitted to Eastham Board of Health.  Operation and maintenance agreement to be required for life of the system.


Deed restriction for 22 bedroom use and use Microfast 3.0 alternative technology requirement to be  to be recorded on the deed.
       6.      Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
       7.      Subject to Conservation Commission review
       8.      Any increase in habitable square footage would require Board of Health review.  
        9.      Operation and maintenance agreement to be submitted to EBOH.  Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
       10.     Owner must obtain DEP approval of public water supply.
       11.     Subject to DEP approval


        Exterior clean out for any plumbing in any slab
Joyce Gibson made the motion to approve the plan with the 11 conditions.
Pat Lariviere seconded the motion.      THE VOTE WAS 3-0 FOR APPROVAL

        Jason Ellis     presented plans to upgrade the septic system. The proposed

Jason Ellis presented the plans to upgrade the septic system. The board requested more detail information on this plan. 
Paul Lothrop made the motion to table this project until the March 30, 2006 BOH Meeting.  Pat Lariviere  seconded the motion.
        THE VOTE WAS 3-0 TO TABLE

The meeting was adjourned at 4:55
