MINUTES
EASTHAM BOARD OF HEALTH
THURSDAY, MAY 26, 2005
3:P.M.


PRESENT:        Paul Lothrop, Chairman,  Joyce Gibson,  Pat Lariviere, Stan Holt, Dr. James Taylor, Jane Crowley, Health Agent



I.      OPENING STATEMENTS

The Health Agent informed the Board about the  rabies virus educational Program  that was held for the students at the Elementary School . The program informed the students about avoiding contact with wild  animals.  They were also reminded that their pets should be vaccinated to protect them. Jane Crowley stated the program was conducted by Lisa Crowner from the Department of Public Health .
        

VARIANCES



Deane           1925 State Highway              Map-15    Parcel-109

        Chris Wickson presented the plan to upgrade the septic system.
         The variances requested are as follows:
        Title 5 Regulations:
        Section 15.221:  General Construction Requirements

(7)     2.5'+- to the 3' maximum covers over proposed soil absorption system


(7)     2.5'+- to the 3' maximum cover allowed over proposed distribution box


2.5'+- to the 3' maximum cover allowed over proposed septic tank

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following condition:
1. Add clean out for new bathroom


Stan Holt made the motion to approved the plan  with the one condition.
Joyce Gibson seconded the motion.       
VOTED  UNANIMOUSLY  FOR APPROVAL




Andrews         22 Asparagus Lane             Map-19      Parcel-32

        Stephanie Sequin presented the plans to upgrade the septic system.
        The variances requested are as follows:

1.      Proposed soil absorption system to be 7+-  from a cellar wall (13' variance)
2.       Proposed soil absorption system to be 7+-  from a property line
        (3' variance)
3.      Proposed septic tank to be 9'+-from  a property line (1' variance)
4.      No reserve area provided
5.      Proposed soil absorption system to be 54+- from a coastal bank (46'variance)
6.      Existing well to remain on separate "lot" (private road layout)

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      No increase in flow allowed
2.      Deed restriction to 4 bedroom and use of alternative system to be recorded on deed


3.      Well to be tested for routine parameters


Plan to show a future well location to be installed when the property is sold or when the well needs to be replaced (which ever is first) plan to list required variances for future well site
5.      Secondary treatment to be added to the system and monitoring under general  use approval conditions per DEP regulations including  testing quarterly for total nitrogen  TSS and BOD
6.      Operation and maintenance agreement to be submitted to EBOH. Operation and maintenance to be required for life of the system


7.      Well disclaimer form signed by owner


Approved variances to allow replacement of well
System operator to report results via Barnstable County web based Carmody Data Base when available or report directly to Eastham Board of Health if not available.

Stan Holt made the motion to approve the plans  with the 9 conditions.
Dr. Taylor seconded the motion.  
 VOTED  UNANIMOUSLY  FOR APPROVAL

Jason Ellis presented plans to upgrade the septic system .The variances requested are :



S.A.S located less than 100' to isolated fresh wetland   (73' provided 27' variance)
        310 CMR 15.248
No reserve area provided

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:


No increase in flow allowed
Deed restriction to 3 bedroom
Requires Requires Conservation Commission approval

Stan Holt made the motion to approve the plan with the 3 conditions.  Dr. Taylor
seconded the motion.    THE VOTE WAS 5-0 FOR APPROVAL

        Jason Ellis presented the plans to upgrade the septic system.
        The variances requested are as follows:



310 CMR 15.211

1.      5' from proposed s.a.s. to lot line (pcl.257)
2.      5' from proposed s.a.s. to lot line
3.      No reserve area provided

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      No increase in flow allowed
2.      Deed restriction to 4 bedrooms

Joyce Gibson made the motion to approve the plans with the 2 conditions.
Stan Holt seconded the motion.           VOTE WAS  5-0 FOR APPROVAL  


Epstein         21 Marion’s Way   Map-7 Parcel-557

Jason Ellis presented the plan to upgrade the septic system with requests for variances to include a 2,500 gallon tight tank. Variances requested:

        310 CMR 15.211
        1.      25'  from proposed tight tank to proposed well (locus)
        2.      25'  from proposed tight tank to well  (pcl. 570)
        3.      21'  from proposed tight tank to well  (pcl. 558)
        4.      2'    from proposed tight tank to foundation wall
        5.      3'    from proposed tight tank to lot line (pcl. 558)

        Eastham Board of Health Regulations
        6.      24'  from proposed well to lot line (Marion's Way)
        7.              6'    from proposed well to lot line (pcl. 558)


Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      Voc and routine water quality test results be provided of proposed well location to assure potability

2.      No increase in design flow be allowed
3.      Subject to DEP approval
4.      Approval contingent on Conservation commission review
Dr. Taylor made the motion to approve the plan with the 4 conditions .  Pat
Lariviere seconded the motion with the 4conditions.    
VOTE WAS  5-0 FOR APPROVAL




REVIEW



O’Hara          35  Cove Road           Map-18 Parcel-43

        Terry Ryder presented plans for review by the Board.  There was no vote
on this because the plans must be legally advertised and all abutters official notified.   


Eastham Inn             2470 State Highway         Map-15       Parcel-65

        Paul Lothrop recused himself from this variance request.

Chris Wickson presented plans for upgrade to the commercial motel and managers units which has a total flow of 4, 070 gpd with secondary Septi-Tech treatment. This approval is contingent on the review by the Barnstable County Department of Health, Director George Heufelder.

Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:

1.      Routine water quality test results be provided of existing well location to assure potability
2.      No increase in design flow be allowed

3.      Secondary treatment and monitoring under remedial use approval conditions per DEP regulations including testing for total nitrogen, BOD, TSS, Nitrate (or 2 times per year  for seasonal use)  After this time reduction of testing could be requested to BOH by owner. Operator will be required to submit results via the web based  Carmody Data base system operated by Barnstable County Department of Health and the Environment (when the data base is available) or provide reports to the Eastham Board of Health
4.      Operation and maintenance agreement to be submitted to EBOH.  Operation and maintenance agreement to be required for life of the system.
5.      Deed restriction for 37 bedroom use and use alternative technology requirement to be recorded on deed.
6.      Designer to verify proper operation of the system prior to issuance of  Certificate of Compliance
Dr. Taylor made the motion to approve the plans with the 6 conditions. Joyce Gibson seconded the motion.            VOTE WAS 5-0 FOR APPROVAL





CORRESPONDENCE/ OTHER INFORMATION

        Cape Cod Household Hazardous Waste Report for 2004 was submitted to
the Board.   The Health Agent informed the Board that Orleans and Eastham plan on working together on collections next year.

A letter from George Heufelder, Director of the Barnstable County Department of Health and Environment stating he had conducted an inspection of the recirculating sand filter at the Gift Barn. Mr. Heufelder
observed Mr Stockford collection of samples of the system as well as his inspection of the system. He found that his sampling of the system was appropriate for the determination of the system performance. The Board expressed concerns that although Mr. Stockford has  qualified  himself as a Wastewater Treatment Plant Operator they would prefer that an independent operator collect the water samples at the Gift Barn.

         Stan Holt had to leave the meeting at 5:00 P.M.

The Chairman announced a public hearing for the Board Health    Regulations.
        A few corrections were made on the submitted draft.
Dr Taylor made the motion to adopt the regulations as presented with the corrections made at this meeting.  Joyce  Gibson seconded the motion.
        THE VOTE WAS 4-0 FOR APPROVAL.


The meeting was adjourned at 5:45
