MINUTES
EASTHAM BOARD OF HEALTH MEETING
THURSDAY APRIL 24, 2003
(CORRECTED)

PRESENT:        Paul Lothrop, Stan Holt, Felix Conte, Dr. James Taylor, Joyce Gibson, Jane Crowley, Health Agent



Paul Lothrop, Chairman opened the meeting at 3:05.


OPENING STATEMENTS:

        There were no statements made.


VARIANCE:

        Louise & Katherine Sclafani     600 Campground Road     Map-7   Parcel-317
        
        Paul Lothrop, Chairman of the Board read a letter from Benjamin Zender the lawyer
        representing  Louise & Katherine Sclafani .  This letter requested a continuance of the
        Sclafani project, until the next available Board of Health hearing and pending a                     determination of the Middlesex Superior Court. The Board granted the continuance.              The variance hearing will be rescheduled for the next Board of Health Meeting on
           May 29, 2003 at 3:p.m.


         REVIEW:        First Encounter Beach Title 5 plan designed by Jason Ellis dated        March 15, 2003
Due to the constraints of the lot Jason Ellis has requested a 10,000 gallon tight tank be installed at First Encounter Beach to accommodate the seasonal municipal public park toilet waste. Jane Crowley recommended approval with the following conditions: 1. Subject to DEP approval       2. Subject to Conservation Commission approval.  The Board voted to
                            approve the plan. 5-0 in favor.

                

WORK SESSION    (TOBACCO REGULATIONS)
        

   BobCollett and Jeff Dinger from the Cape Cod Regional Control Program made a presentation concerning the changes in Massachusetts law relative to the way tobacco is sold which are not reflected in the Eastham regulations (section D 1. ) The Board agreed that this section could be revised prohibiting self service displays and allowing hand to hand exchange behind counter only pending public hearing.  There was much discussion concerning health problems due to second hand smoke etc.  Dr Taylor stated he favored the elimination of smoking variances .   It was also noted any variance granted by the Board would be reviewed annually.
