EASTHAM CONSERVATION COMMISSION
Wednesday 3rd November 2010

MINUTES

PRESENT: Lorraine Giovinazzo, Vivien Cook, David Hoerle, Sandra Larsen, Stephen Smith, Linda Haspel

NOT PRESENT: Steven LaBranche


STAFF PRESENT: Deputy Natural Resource Officer Amy Usowski.

ALSO PRESENT: Noel Byle, Peter Markunas, Seth Wilkinson, Keith Johnson, David Lyttle, Ben Zehnder, Peter Coneen.

Chairman Smith opened the meeting at 5:30 P.M.

5:31 P.M.  Continuation of Hearing on Notice of Intent filed by Anthony Julian, MAF Realty Associates, 15 Shurtleff Road, Map 10, Parcel 231.

Chairman Smith read a statement from Tim Brady asking for a continuance of the hearing due to a lack of opinion from town counsel, he is asking for a continuance until November 9th.

Lorraine Giovinazzo MOVED, Vivien Cook SECONDED the Motion to grant the continuance.

SO VOTED UNANIMOUSLY.

Noel Byle spoke before the commission about the importance of Eastham bayside beaches as a tourist attraction. He also spoke of his support of the Town Natural Resource Department and Conservation Commission.

5:39P.M.  Request for an Administrative Review Permit for the Eastham United Methodist Church, 3200 State Highway, Map 12, Parcel 55.

The Applicant presented a plan to install downspouts and drywells on and property to control run-off that is currently uncontrolled. The site location is 75ft from the resource.

A brief discussion about the current conditions of the site occurred and it was noted that currently the water runs off directly into the basement or into the pond.~ Any improvement was a good improvement.

Lorraine Giovinazzo MOVED and Vivian Cook SECONDED the Motion to grant the Administrative Review Permit.

SO VOTED UNANIMOUSLY.

5:40P.M.   Request for a Administrative Review Permit by Karen Klingel, 90 Old State Highway, Map 20, Parcel 117B.

The applicant has requested an expansion of a previously permitted deck from 6ft to 10ft wide. The deck is located over 90ft from the resource.

David asked about what would be used as footings, Deputy Usowski said that the plan stated sonotubes.

Lorraine Giovinazzo MOVED and David Hoerle SECONDED the Motion to grant the Administrative review permit.

SO VOTED UNANIMOUSLY.

5:45P.M.  Continuation of Hearing Notice of Intent filed by Gregory DeLissovoy, 185 Mill Road, Map 15, Parcel 026.

Chairman Smith introduced the project, and introduced Seth Wilkinson from Wilkinson Ecological Design and Keith Johnson, Senior Plant Manager.

Seth spoke to the commission about the applicants desire to withdraw his application for remediation planting. Discussion occurred in regard to if the electrical line would be removed from the site, and if any planting would occur if the application were withdrawn. Mr. Wilkinson stated that his applicant would like to withdraw his planting plan at this time.

The commission stated that the owners needed to remove the electrical line, and that any future work would come in front of conservation commission.

Lorraine Giovinazzo MOVED and David Hoerle SECONDED the Motion of withdrawing the planting plan with the exception that the proposed plants near the edge of the pond need to be planted and removal of the electrical line.

SO VOTED UNANIMOUSLY.

Commissioner Vivien Cook left the meeting at this time.

6:20P.M.   Continuation of Hearing on Notice of Intent filed by Betty Lucas Friedman, 45 Bay Shore Lane, Map 13, Parcel 136D.

Chairman Smith introduced the hearing welcomed Peter Markunas of the Woods Hole Group to speak to the project.

Mr. Markunas stated that the last time the project was in front of the commission they had wanted periodic monitoring of the site (monthly) as well as after episodic events and that an annual report is submitted. Previously the commission had been concerned about its ability to review the project in the future if an issue occurred.  A brief discussion occurred about the non-leach ability of the PVC encasement, which the commission was very impressed with.

Sandra Larsen MOVED and David Hoerle SECONDED the Motion to approve the Notice of Intent with special conditions, 1-18, 19, 20, 21, 22, 25, 26, 27, 29, 30, 31 (296cuyds), 32, 33, 34, 36, 38, 39.

SO VOTED UNANIMOUSLY.

The commission signed the signature page for the Arruda/Beaudoin project that had previously been approved by the commission but was not signed at the hearing.

6:30P.M.  Continuation of Hearing on Notice of Intent filed by Gary and Colleen Wolf, 500R Ocean View Drive, Map 24, Parcel 7.

Chairman Smith introduced the project and welcomed Emily Beebe and Ben Zehnder to speak to the project.

Emily Beebe introduced a new site plan after discussion with the National Park service. The plan included a split rail fence delineating the property boundaries.  A brief discussion was had about the work limit around the house, maintaining the work limit 5-8 ft off the existing dwelling off the east side. Chairman Smith expressed concern about the timeframe in which the demolition material would be removed from the site, Mrs. Beebe stated that a wind protocol would be easy to include in the construction protocol.

Discussion occurred about the addition of T-Base within the buffer zone, for the access of the crane as well as for a future parking area. Chairman Smith mentioned removing T-Base after the crane had been removed from the site.
Sandra expressed her concern about the use of herbicides in the fall to control invasive species; Ms. Beebe amended the plan to remove that sentence.
Discussion occurred about the proposed work limit and not disturbing any additional vegetation, the final work limit can be discussed at the final pre-work site visit on site after everything is staked.

Lorraine Giovinazzo MOVED and David Hoerle SECONDED the Motion to approve the Notice of Intent with the following special conditions:~ 1-18, 19, 20, 21, 22, 23, 24, 26, 27, 28, 29, 30, 32, 33, 35 Pre-construction meeting on site w/ agent, contractor, and engineer, No Mow Zone (exception of 3ft wide footpath around building) 39.

SO VOTED UNANIMOUSLY.

8:05P.M. Continuation of Hearing on Notice of Intent filed by Anthony Schoener, 16 Keene Way, Map 19, Parcel 043H.

Chairman Smith opened the hearing. David Lyttle spoke to the project, presenting a new plan for the boardwalk, with a bigger span between posts eliminating 12 posts. There was discussion regarding impacts on the ACEC due to the ramp. Sandra Larsen asked if there were indeed for bedrooms and not five. David Lyttle replied that it was fine to have five.

Lorraine Giovinazzo MOVED and David Hoerle SECONDED the Motion to approve the Notice of Intent with conditions 1-18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 32, 33, 35, 38, 39, 40 + monthly log.

The vote was 4 in favor with 1 opposed.  MOTION CARRIED.

8:25P.M.  Request for an Administrative Review Permit by Chris O’Brien, 85 Bay View Drive.

Applicant wishes to rebuild the existing sand drift fence in current location.  The permit was approved last year but the work was never completed.

Lorraine Giovinazzo MOVED and Linda Haspel SECONDED the Motion to ratify the Administrative Review Permit, stipulating that the snow fence be removed and only using untreated lumber used.

SO VOTED UNANIMOUSLY.

8:30P.M.  Lorraine Giovinazzo MOVED and Linda Haspel SECONED the Motion to Adjourn.
