MINUTES

PRESENT:        Commissioners Dennis Murley, David Hoerle, Lorraine Giovinazzo, Glenn Collins, Steve Smith.

STAFF PRESENT:  Deputy Natural Resources Officer Amy Usowski, Norah Scholl, Clerk.

ALSO PRESENT:   Sonny Kazanjian, Christine Athorn, James Athorn, John Stankiewicz, Maria Brugnoli, Doris Harrahy, Victor Arruda, Anne-Marie Beaudoin, Attorney Jack McCormick, Peter Markunas of Woods Hole Group, John and Cornelia Paardenkooper, Russell Perry, Joe Flaherty, Stephanie Sequin of Ryder & Wilcox, Inc., Eric Mitchell of J.C. 7:05 P.M.       Chairman Murley opened the meeting.

7:06 P.M.       Approval of Minutes of 09 September 2008.

Mr. Hoerle MOVED and Mr. Smith SECONDED the Motion to approve the Minutes of 09 September 2008 as submitted.

SO VOTED UNANIMOUSLY.

7:07 P.M.       Request for Certificate of Compliance, Kazanjian DEP SE 19-1138, 120 Lawton Road, Map 14, Parcel 040.

Mr. Kazanjian was present and there was discussion about trees in the back yard which had been trimmed and weren’t supposed to be.  Deputy Usowski said she was pleased with the plants which are there now.

Mr. Collins MOVED and Mr. Hoerle SECONDED the Motion to grant a Certificate of Compliance for DEP SE 19-1138.


SO VOTED UNANIMOUSLY.

7:14 P.M.       Administrative Review, Miriam and Fred Vanderkloot, 145 Shurtleff Road, Map 10, Parcel 239.

Deputy Usowski explained this request to reinforce the existing retaining wall to the right of the driveway at this property.  She said the area is already disturbed and this project won’t disturb it any further.

Mr. Hoerle MOVED to ratify this Administrative Review and Ms. Giovinazzo SECONDED the Motion.

SO VOTED UNANIMOUSLY.

7:17 P.M.       Request for Extension Permit, Ducibella, DEP SE 19-1061, 55 Bay View Drive, Map 13, Parcel 016.

Deputy Usowski said the site is well vegetated and there is a lot of sand.  Mr. Collins MOVED and Ms. Giovinazzo SECONDED the Motion to grant a 3-year Extension for DEP SE 19-1061.

SO VOTED UNANIMOUSLY.

7:20 P.M.       Notice of Intent filed by Victor Arruda & Anne Marie C. Beaudoin, 51 Longstreet Lane & Town of Eastham’s half of Liberty Ave. at Crest Ave., Map 10, Parcel 344.

The Applicants were present along with their representative Peter Markunas of Woods Hole Group and their attorney, Jack McCormick.  This proposal is for reconstruction of an existing rock revetment, extension of the existing rock return footprint, construction of public beach access stairs, reconstruction of existing private beach access stairs, and maintenance provisions for the rock revetment and bank replenishment.

There was lengthy discussion relative to the erosion rate, the ownership of the properties and the state of disrepair of the existing revetment.  Removal and reconstruction of the revetment was discussed and when the work would be undertaken.  Abutters expressed concern that the revetment will create further erosion directly near erosion directly near their homes.  

Mr. Collins said he feels that the Commission should consult with a specialist relative to this proposal.

Mr. Collins MOVED to continue this hearing and Mr. Smith SECONDED the Motion.

SO VOTED UNANIMOUSLY.




8:15    P.M.    Notice of Intent filed by Patrick J. & Kristen L. McCutcheon, 123 Bay Road, Map 07, Parcel 522.

This proposal is to construct a second story onto an existing single-family dwelling.  Stephanie Sequin of Ryder & Wilcox, Inc. was present for the applicants.

Ms. Sequin said that there will be no excavation and no change in footprint.  She said a fabric silt fence will be placed at the Limit of Work, runoff shouldn’t be a problem, and the plan has been approved by the Board of Health.

Deputy Usowski said there were many questions from abutters, very few of which were relative to conservation.  Mr. Hoerle commented that if the footprint isn’t changing, the Conservation Commission doesn’t really have any jurisdiction, except to ensure that further activity does not impinge on the small piece of land.  Mr. Collins said he thought the Limit of Work could be tightened and Chairman Murley expressed the same opinion and concern for the vegetation.

Mr. Smith MOVED and Mr. Collins SECONDED the Motion to issue an Order of Conditions with a tighter work limit and the following Conditions: 1-18, 19, 20, 21, 22 (7' Limit of Work on all sides), 29, 33, 35, 38.

SO VOTED UNANIMOUSLY.

9:00 P.M.       Notice of Intent filed by Candace Bechgaard, 93 Sunset Avenue,
Map 19, Parcel 055.

Because of a paperwork error, Mr. Mitchell, of J.C. Ellis Design Co., requested that this hearing be re-scheduled til October 28th.  Mr. Hoerle MOVED and Mr. Collins SECONDED the Motion to continue this hearing until 28 October 2008.

SO VOTED UNANIMOUSLY.

9:07 P.M.       Notice of Intent filed by Frank & Janet Bianco, 290 Salt Works Road, Map 04, Parcel 005A.

Eric Mitchell of J.C. Ellis Design Co., Inc. was present for the Applicants along with Russ Perry, their builder.  This proposal is for the demolition and reconstruction of a single-family dwelling within the 100' Buffer Zone to a Coastal Bank.


There was discussion relative to the driveway, the foundation and relocation of the septic system.  Mr. Collins commented that he thinks this is too much redevelopment in a sensitive area and that it is unreasonable to nearly double the footprint.  Raising the structure or the garage was discussed, but would be very costly.  
The possibility of using the existing foundation and just building up and putting the garage under the proposed house was discussed.
Mr. Mitchell said he would talk to the Applicants and requested a continuance.  Mr. Hoerle MOVED and Ms. Giovinazzo SECONDED the Motion to continue this hearing.

SO VOTED UNANIMOUSLY.

9:40 P.M.       Administrative Review filed by Estate of Adelaide Dietrich, 175 Whelpley Road, Map 02, Parcel 074.

This proposal, filed for the estate by Laura Schofield of Schofield Brothers of Cape Cod, is a request to dig two test holes for a septic system upgrade within 100' of the Bordering Vegetated Wetland.  

Ms. Schofield was present and told the Commission that the back of the house is heavily vegetated and the goal is to keep the septic system a far away from the wetland as possible.  She said that there will be machines on the site for an hour to drill the test holes.

Mr. Collins MOVED and Mr. Hoerle SECONDED the Motion to ratify this Administrative Review.

SO VOTED UNANIMOUSLY.

9:45 P.M.     Tom Lapham, a property owner at 435 Shurtleff Road, spoke with the Commission about beach nourishment requirements and guidance on how to proceed.  He said the elevation of the beach is fairly constant and is concerned about kids walking on the dunes.  He requested that sand nourishment be required of everyone.

10:08 P.M.      Request for Extensions, Vanderkloot DEP SE 19-1183 and DeRemer  DEP SE 19-1984, 145 Shurtleff Road, Map 10, Parcel 235 and125 Shurtleff Road, Map 10, Parcel 238.

Deputy Usowski said that both of the revetments look good and both applicants are nourishing.  

Mr. Collins MOVED and Ms. Giovinazzo SECONDED the Motion to grant an Extension for Vanderkloot DEP SE 19-1183 & DeRemer DEP SE 19-1184.

SO VOTED UNANIMOUSLY.








10:13 P.M.      Change in Plans, Kimler DEP SE 19-1207, 27 Bayberry Lane, Map 13, Parcel 155.

The Commission had previously denied a request for an Extension of this Order of Conditions due to some variations between the site and the approved site plan.  The Commission felt it would be proper for the Applicants to request an Amended Order of Conditions.

Mr. Smith  MOVED to adjourn at approximately 10:20 P.M. and Ms. Giovinazzo SECONDED the Motion.

SO VOTED UNANIMOUSLY.
